No. 14010/60/2006/Ch.III dated 19.6.2007 and decided to approve this case on repeat basis as under:-

The Committee considered the case as per agenda. The firm has also sent a representation dated 23/7/2008 addressed to Commerce Secretary which was also considered and discussed in the meeting. It was noted that the norms at A-3016 allows 8 inputs. Out of these, Item No.7 “former relevant to the export product” was deleted by Public Notice No.23/2004-09 dated

PRO version 11/11/2004 which, upon the representation of exporters was restored under P.N.No.55 dated 19/9/2005 w.e.f. the date of its deletions i.e. dated 11.11.2004. However, an additional condition was included in the foot-note at (iii) i.e. “For the shipments made from the date of this Public Notice, the exporter will declare the quantity of each individual Former in the export documents”. The firm has represented that they have difficulty in declaring the quantity of individual formers due to the magnitude of operations and difficulties being faced to name the formers and quantity used for each batch by segregating from the local sale and those which goes for exports. The firm has also enclosed a copy of technical literature etc. The firm has also produced certificate from Central Excise stating that inorganic oxides are used as glass formers, as per SION A-3016 of Chemical & Allied products for home consumption as well as for exports. The firm has also stated that formers are non-sensitive items which is not appearing under Para 4.55.3 of HBP. The Committee noted the problems faced by them in regard to the condition imposed by Note No. (iii) below SION A 3016. The matter was also considered by Technical Authority viz. DIPP and they have forwarded their written comments vide their U.O. No. 7/191/2008-TSW dated 12.8.2008 recommending change in the foot-note of the above SION as under:

(i) Item No.4 i.e. Selenium shall be allowed only if glass bottle and / or Pressed Tumbler/ Bottle to be exported is of Yellowish pink colour.

(ii) Under the import item at S.No.7 i.e. Formers – the quantity of Borax/Boric Acid should not exceed 0.10 Kg under the overall quantity of Formers allowed.

It is observed that note at (i) above already exists as a Note below SION A 3016. The technical authorities have not recommended continuance of Note No. (iii) and the firm has also represented that this condition is difficult to comply with. Also there was no restriction in import of different formers which are non-sensitive items since beginning and the condition was imposed by Public Notice No.55 dated 19.9.2005. Taking into consideration, the written comments No. 7/191/2008-TSW dated 12.8.2008 from DIPP and the representation of the firm, the Committee recommended that following amendments may be made in SION A-3016.

(i) Note No.(iii) below SION A-3016 inserted by P.N.No.55 dated 19/9/2005 is deleted ab initio

(ii) Note No.(iv) be added from the date of present Public Notice as under:-
