Subject: Procedure for clearance of import cargo categorized as “Hazardous Goods”-reg.

2k offake of Reference from field formation has been received informing difficulties raised in examination of hazardous cargo found suspicious on scanning. The matter has also been brought before members of NAC chemical -1 and while discussing the issue, by and large National Assessment Centre members agreed and informed that they are following the procedure provided in Public Notice number 46/2017 dated 31.03.2017 of JNCH. However it is gathered that said public notice does not elaborate on procedure to be followed in case the container is marked suspicious on scanning. Hence in order to devise a uniform mechanism towards examination of hazardous cargo imported in India following procedure is Clarified; 2. Basically “hazardous cargo” is categorized into 9 classes from 1 to 9 depending on the nature of the cargo.

The technical details about these 9 classes are enclosed as Annexure-“A” to this Public Notice. A note about “Reading Hazardous Materials Placards” is also enclosed as Annexure-“B” to this Public Notice.

“HAZARDOUS CARGO” OF CLASS 5, CLASS 8 AND CLASS 9, [REFER ANNEXURE-“A”] there Analysis of the degree of danger in each class of the“hazardous cargo” reveals that exists a health and environmental hazards in case of all classes of such substances, However, it appears that in case of class 5, class 8 and class 9, there is relatively low probability of potential health hazard as compared to others. Hach cargo should be accompanied by

i. Cargo analysis report; or ii. Material safety Data Sheet (in order to distinguish the category and class of the “hazardous cargo”). In such cases a percentage of cargo should be opened and examined: in CFSs (authorised to handle“hazardous cargo”) under expert supervision of trained personnel isprovided by the Importer (at the time of examination), whenever examination of such cargo required.

It has been decided that following procedure should be adopted for verification of cargo contained in such Containers so as to comply with RMS instructions: (i) In case of other cargo, especially for the goods falling under the category of other classes, the goods cannot be opened and examined in the yard as it poses great danger to health as well as the environment. Hence, the containers / goods, which are earmarked for examination (as per RMS Instructions) should be scanned at JNCH scanning site at Distripark.

----- Start of picture text -----<br> ii. For such consignments, examination of the cargo may be temporarily waived and cargo<br>may be allowed Out of Charge (OOC) as per the existing procedure. On its way to CFS as the<br>case may be, the container need to be scanned at the scanner and due stamping by the<br>scanning officer need to be taken on the movement slip certifying it clean and goods to be as<br>declared. While allowing the container outside the CFS the slip need to be checked and<br>ensured it to be stamped clean<br>by the scanning officer before allowing it outside the CFS.<br>iii.

In case the container is marked suspicious, the same may be allowed to be released on<br>provisional basis, manually, subject to examination in the factory premises of the Importer,<br>under supervision of factory expert, at the cost of Importer. Release of goods should be<br>allowed, on submission of “no use bond” as annexed with this Public notice (Annexure C).<br>Examination will be carried out by the jurisdictional ‘Customs authorities in whose<br>jurisdiction factory premises is located as per Public Notice no. 82/2017-Customs (N.T.)<br>dated 24.08.2017, as amended from time to time. Such container should be released with<br>Customs seal only from the concerned Docks with necessary endorsement by the Docks<br>Officer. On receipt of examination report from Customs formation having jurisdiction over<br>the factory, assessment would be completed on system and OOC will be granted.

In case the<br>seal is found to be broken or goods not found as declared or any contravention of Customs<br>Act or Allied Acts is found at the time of examination at factory premises by the<br>jurisdictional Customs Officer, goods may be seized and matter may be referred to SIIB<br>(Import) for further investigation.<br>5. The importers are also advised to mention the class/sub class of the imported<br>Hazardous goods in the description of the bill of entry and on labels pasted on the goods<br>packaging.<br>6. Action to be taken in terms of decisions taken in this Public Notice will be considered as<br>Standing Order for Officers/ staff.<br>7.
