Subject: Corrigendum in respect of Case No. 2 of Meeting No. NC/2/MEET/DEC/202425/15 dated 23.12.2024- reg.

In respect of case No. 2 of Meeting No. NC/2/MEET/DEC/202425/15 dated 23.12.2024, the following norms were fixed against the Advance Authorizations issued to M/s JSK Industries Private Limited.

The Committee considered the case as per agenda and decided to ratify the ad-hoc Norms for the purpose of redemption of the four Advance Authorisations, as per comments of (DPIIT) via mail vide U.O No. P-47011/126/2024-TSW dated 20.12.2024, as under:

I. Aluminium Wire Rod: As 1.01 Kgs. /Kg. content in the export items. ii. High Carbon Steel Rod: As 1.02 Kgs. /Kg. content in the export items.

RA concerned may take suitable consequential action accordingly.

The firm has represented vide email dated 06.01.2025 for modification in the minutes for grant of EODC for closure purpose instead of fixation of adhoc norms.

Revised Norms Committee decision:

The Committee considered the case as per agenda and technical opinion. The applicant submitted that they have exported Alumunium Conductor Steel Reinforced under these licenses issued under SION C-7 which allows Alumunium Ingot or

Alumunium Wire Rod as one of the inputs. The said SION allows optional input namely Alumunium Ingot/ billets or Alumunium Wire Rod.

After completing exports, applicant found it difficult to import the input Alumunium Ingot, and therefore approached RA for change of input from Alumunium Ingot to Alumunium Wire Rod. The RA accepted the request made the post export change from Alumunium Ingot to Alumunium Wire Rod. Accordingly applicant replenished it by import of the changed input. When applicant approached to RA for issue of EODC, RA refused to do the same as SBs mention exempted input as Alumunium Ingot, whereas applicant has imported Alumunium Wire Rod.

The Committee accepted the request of applicant based on post export change of input, though the SBs mention the exempted material as Alumunium Ingot, and also that SION C-7, gives option to applicant and both the optional inputs pertain to Alumunium raw material only. It is also seen that Alumunium Wire Rod has lesser wastage of 1% and both the optional inputs have same import duty as well. The Committee also decided that this decision shall be strictly for issue of EODC and no further export and import shall be allowed.
