Please Note

  • i. For information of exporters, Norms Committee-II handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 72 to 76, 78 to 80 & 85. Communications in respect of cases/pertaining to NC-II may be sent to email address: nc2.dgft@nic.in

  • ii. In certain cases the decision of the Norms Committee refers to the Recommendations/ Observations/Deficiencies received from the concerned Technical Authority. Wherever applicable, a scanned copy of such document has been placed at the end of the Minutes, in running serial orders. The concerned applicant/company may go through the same and respond accordingly.

  • iii. Similarly, a scanned copy of the blank Standard Deficiency Format, which may find a reference in NC decisions, has also been attached in the end. This may also be referred to by the concerned applicant/company and may be responded accordingly.

  • iv. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC.

  • v. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less.

  • vi. As per Policy Circular No. 23/2015-20 dated 15.05.2019, exporters may note that, after issue of AA under Para 4.07 of the Hand Book of Procedures, 2015-20 it is the responsibility of the applicants to send hard copy (and soft copy through email) of complete application and other related documents directly to the FTDO of the concerned Norms Committee in the o/o DGFT, Udyog Bhawan, New Delhi-110001 for ratification of the norms. In case, the application details are not made available by the exporter to the concerned Norms Committee within two months, the Norms Committee may reject the case due to non-availability of application.

Meeting No. 13/81 of Norms Committee-II for the year 2020-21 (Originally scheduled for 30.12.2020) held on 08.01.2021 under the Chairmanship of Shri R. P. Goyal, Additional Director General of Foreign Trade to consider the following applications for ratification of norms in respect of advance authorizations under Duty Exemption Scheme (Chapter-4) of Foreign Trade Policy 2015-20.   • i. Draft Minutes of Meeting No. 11/81 scheduled for 24.11.2020 and held on 01.12.2020 were circulated among all the members of the Committee on 29.12.2020. On receipt of comments, the minutes were finalized and uploaded on DGFT’s website on 08.01.2020. Therefore, the minutes are unanimously approved.

  • ii. As decided in the last Meeting, the issue of referring cases to the Technical Consultants was discussed in the Meeting. Representative of DHI/DPIIT requested the Committee to forward the cases for the products falling under their administrative domain to them only. The matter was deliberated at length and it was informed that, earlier, before the appointment of Consultants, such cases were referred to the respective administrative ministries only. To cut down the delays in finalization of norms, Consultants were appointed by the DGFT. The Committee was also informed that to speed up the

disposal in NC-I & NC-II, DGFT has engaged three Consultants, who are retired as Industrial Advisor from DHI; Industrial Adviser from DPIIT and Deputy Industrial Advisor from MoS. In the past, these Consultants used to attend meetings of Norms Committee on behalf of their respective Ministries. Now these Consultants not only eased workload of administrative Ministries but also made valuable contribution in the form of experienced Technical advice. Representative of DHI/DPIIT agreed with the view and informed that these consultants are having vast experience in this field. It was also informed that many a time, Technical Authorities of the Administrative Ministries do not attend the meeting. In fact, the attendance has been lower particularly during COVID although the meetings were held online. Representatives of MoS and DoT are still not attending. The Committee requested the representatives of DHI/DPIIT to regularly participate in the meeting so that they can participate and contribute in the decisions on all the matters including recommendations given by any technical member before ratification. All the members are free to give their inputs if they feel that the recommendations given by a particular technical member needs a change. The Chairman advised the members not to make the issue a turf war as there is no reason to doubt the competency of the members. Main role of the Norms Committee is to make expeditious disposal. In view of above, it was decided that the Committee, in the interest of expeditious disposal of work of norms fixation, may take a decision to whom the cases should be referred. The Chairman advised to bring this to the notice of DG

iii. Representative of DHI also informed that the cases are sent to it in piecemeal manner through emails. He requested to forward the case alongwith complete set of application containing all annexures, queries raised and replies of the applicants every time. In this regard, it was informed that DGFT has launched an online module for management of Norms Committee. In future all the cases would be referred to the concerned Technical Authorities through the module only which would have complete information. The Chairman requested all the Technical Authorities to register themselves in the module.

Decision: The Committee considered the case as per agenda and noted the comments given by Consultant (TEC-3) vide email dated 08.11.2020. However, it was observed that the applicant has filed review in many cases against the lower wastages approved by the NC. Hence, the committee decided to refer the case back to Consultant (TEC-3) with an advice to examine the case to see the actual wastages during manufacturing process and give his recommendations accordingly.
