Please Note For information of exporters, Norms Committee - I handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 81 to 84, 86 to 93 .Communications in respect of cases/pertaining to NC- I may be sent to email address: nc1.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. II. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less. Specific list of export items with their quantities and net weights. 1. Detail technical drawings with dimension of each export product, Catalogue, if any, may also be furnished. 2. Weight of each Export Product. 3. Weight of each of the imported and indigenous input, separately for each product, for the purpose of material balancing. Net weight (Gross weight minus wastage) for each imported and indigenous input in the export product may be indicated. Net weight along with details of other imported input to be used in the resultant product and sought to be imported/procured from sources other than the license, if any, may also be indicated. 4. Starting from the specification of the export product, basic calculation as to how of raw material proposed for import has been arrived at, including the net weight of components to be manufactured out of these imported materials, wastages claimed at each stage of manufacturing with complete justification and supported by documentary evidence/drawings etc. 5. norms Deferred. Norms Committee Decision: The committee considered the case as per agenda. The representatives of the firm Shri Lakshmi Narayana T. and Shri N. K. Chopra attended the Personal Hearing before Norms Committee-1 and explained the case in detail. They sought review of the rejection of their case by NC-1 in its meetings dated 17.04.2025 and 18.08.2025. Against the said rejection, they made the following submissions:- Item of import under the instant AA is second hand engines and it should be allowed for export after refurbishing under Advance Authorization Scheme. i. As per Para 2.31(iii) of FTP 2023 , second-hand goods are allowed freely subject to condition that the items imported for the purpose of refurbishing/re-engineering are re-exported back as per the Customs Notification. We have imported Second Hand 02 Engines along with 127 New Parts required for refurbishment and physically incorporated in export product as also declared in the License Column of Shipping Bills. ii. The provision to allow freely import of second-hand goods for refurbishment is a new provision introduced vide para 2.31(iii) in Foreign Trade Policy 2015-2020 as on 31.03.2023.This provision was not existing in prior policy. iii. New parts imported under AA are physically incorporated as per para 4.03 (a) of FTP. iv.
Para 4.11 of FTP does not prohibit export of second-hand Goods under Advance Authorization Scheme.
v. In view of the above submission, the Committee decided to refer the case to PC-4 to seek clarification as to whether imported second hand engines will be eligible for exports after refurbishing under Advance Authorization Scheme.
