Please Note For information of exporters, Norms Committee - I handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 81 to 84, 86 to 93 .Communications in respect of cases/pertaining to NC- I may be sent to email address: nc1.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. Further, the firm vide their representation dated 08.10.2017 have requested for re-fixation of ad-hoc norms against said decision for which they were called for PH before the NC. However, they could not attend PH as the person who was handling the case earlier, left the job and case remained unattended for a long time. Consequent to that the case was rejected – Case no. 11/24/80-ALC2/2013 – M.No. 13/80- ALC2/2019 dated 23.10.2019. 3. The firm has now stated that the subject advance authorization has been obtained by them for import of parts and consumables for manufacture of Pollution Control Equipment. The norms Committee has allowed item s. no 1 to 14 on net to net basis. However, as per NC earlier decision dated 01/04/2014, item no. 15 & 16 have been allowed at 2% of FOB Value of export item which is too small to manufacture above 46 sets of export item. The subject advance authorization was backed by a special order from overseas customer in which buyer had specially ordered export item with specific quality anti-corrosion coating material to protect the equipment for corrosion. The equipment / item exported and installed at the end user’s works is highly corrosion prone due to process liquids & gasses passing through this equipment, thereby, in order to have longer life of this equipment, the overseas buyer specifically required this high quality corrosion protection paint to be used in their equipment ordered on us, M/s L&T Ine, USA are the only manufacturer of such paints from whom it was imported and used in the equipment exported. The entire quantity of import item s. no. 15 & 16 has been consumed in export product as reflected in shipping bill approved/passed by customs authority. They have not diverted the imported input for any other purpose. There is no recoverable/ irrecoverable wastage in any import item. 5.
