RLA File No: 03/94/040/00449/AM15/ and fixation of ad-hoc norms Case History: The Committee considered the case as per agenda and noted that the case was rejected in Meeting No. 06/80 dated 20.06.2017 due to non-submission reply of deficiency letter. However, the applicant had requested for review and fixation of ad-hoc norms. The Committee reconsidered the case and noted that a deficiency letter seeking certain information as raised by DHI was sent to the applicant on 29.10.2020.

The applicant's reply was sent to DHI on 25.02.2021 for examination of the case. DHI vide letter dated 16.06.2021 informed that the applicant's reply is deficient and it contains only copy of Advance Authorization. Therefore, a deficiency letter was sent to the applicant on 06.08.2021 to furnish the following information as per comments of DHI:

As per NC decision, a deficiency letter as raised by DHI was sent to the applicant on 06.08.2021 followed by reminders on 27.09.2021 & 11.11.2021. The applicant’s reply was sent to DHI on 07.01.2022 for examination & comments. In NC meeting dated 08.02.2022, the Committee noted that DHI vide email dated 28.01.2022 informed that the applicant had submitted same information as of earlier. Therefore, the Committee decided to ask again from the applicant to furnish following information as per comments of DHI:

SI. No. 11 of SDF: Starting from the specification of the export product, basic calculation as to how of raw material proposed for import has been arrived at, including the net weight of components to be manufactured out of these imported materials, wastages claimed at each stage of manufacturing with complete justification and supported by documentary evidence/drawings etc.

A deficiency letter dated 09.03.2022 followed by reminders on 19.05.2022 & 24.06.2022 were issued to the applicant. The applicant vide email dated 01.08.2022 had shared a link against the deficiency letter, but the link was not accessible. Therefore, the applicant, again vide email dated 01.08.2022, has been requested to send the requisite information. As per NC decision, a reminder was issued on 29.09.2022 to the applicant. The applicant's reply received via email dated 01.10.2022 and the same was sent to DH! on 03.10.2022 for examination of the case. However, no comments have been received as yet.

The Committee last considered the case on 28.04.2023 and called for PH with complete set of application, product catalogues and other details. The applicant was again called for PH on 03.04.2024.

Decision: The Committee considered the case as per agenda and noted that the firm appeared for PH before NC-1 on 03.04.2024 through their representatives S/Shri Mahesh D Ayare, Account Executive & Sanjeev Sharma and they explained the case in detail. The applicant stated that they do not want to claim any wastage on the items imported against the above mentioned Advance Authorization. The Committee asked the firm to submit the revised list clearly indicating the items imported and not imported along with actual quantity imported and their net content in the export product along with the letter stating that they do not want to claim any wastage on the import items. The case was again considered in the NC meeting dated 18.04.2024 and the Committee decided to review and to fix the ad-hoc norms in respect of above Advance Authorization as per comments of MHI dated 05.04.2024 (as per copy attached).

RA concerned may take suitable consequential action accordingly.

During the PH, the firm informed that they have not imported all the items mentioned in the application. They also stated that they do not want to claim any wastage on the items imported against the above mentioned advance authorizations issued to them. The committee asked the firm to submit the revised list clearly indicating the items imported and not imported along with actual quantity imported and their net content in the export product. The committee also asked the firm to give a letter from their authorized signatory stating that the do not want to claim any wastage on the items imported and hence the norms for the above AAs may be approved with NIL wastage. 3.
