Subject:- Requirement of membership of CB Association for all Customs Brokers — M/Reg.

Attention of trade, Customs Brokers and all other stakeholders is invited to Notification No. 52/2022 - Customs (N.T.) dated 24.06.2022 issued by the Central Board of Indirect Taxes and Customs (CBIC), New Delhi. Vide the aforesaid notification, the CBIC has amended the Customs Broker Licensing Regulations, 2018 and substituted sub-regulations (1) and (2) of Regulation 20 of CBLR, 2018 and inserted a new Regulation 21, which are as follows:
i In the Customs Broker Licensing Regulations, 2018 in Regulation 20, for sub-regulations (1) and (2), the following subregulations shall respectively be substituted, namely:-
“(1) Each Customs Broker shall enrol himself as a member of the Customs Brokers' Association at every jurisdiction he operates, if there is such an Association registered in the Customs Station, where the Customs Broker is operating and recognized by the Principal Commissioner of Customs or Commissioner of Customs, as the case may be.
(2) No Customs Broker shall enrol himself in more than one Association, at a given time, in a particular jurisdiction.”
ii. After regulation 20, the following regulation shall be inserted, namely:-
“21. Power to relax - Where an applicant or a Customs Broker or NACIN makes a representation to the Board that he or it, as the case may be, is unable to comply with his or its duties or obligations within the time period as specified under any provision of these regulations, for the reasons beyond his or its control, but otherwise satisfy all other conditions, if any, as provided under such provision, the Board may, after consideration of the representation, and for reasons to be recorded in writing, allow a further time period for compliance of such duties or obligations.”
In view of the above, all the Customs Brokers, who are registered and operating under the jurisdiction of Custom House, Mundra are required to enrol themselves as member of Mundra Customs Broker Association, M-5, Ratnakala Arcade, Opp. Shubham Petroleum, Adani Port Road, Mundra - 370 421 (Distt. Kachchh) and are advised not to enrol themselves in more than one association at a time, under the jurisdiction of this office.
