Reference our personal hearing before the Norms Committee-1 under the Chairmanship of Dr. L.B. Singhal on 19% August 2014 and subsequent correspondence resting with our letter dated 15" Sept. 2014.

Vide our above referred letter dated 15 Sept. 2014, we had requested you to kindly relook at our cases for the requirement of submission of certificate from the Office of DGHC certifying that the goods are for use in the Petroleum Operations, since TRU, Deptt. of Revenue’s OM No. 354/148/2013-TRU dated 28.02.2014 specifically referred that the certificate is required for “Seamless Pipes & Tubes manufacturing Industry in India’ and not from Oilfield Equipment manufacturing industry as a whole and BOTIL end-products neither includes the manufacture of Casing Pipes or the Tubing referred to by TRU nor do we supply the listed commodities to ONGC Ltd / Oil India Ltd under the Deemed Export Scheme. Your response to our above letter is still awaited, Would appreciate a response.

Meantime and based on our request, ONGC Ltd., had taken up the matter with the Office of DGHC for issuing the required certificates against the Orders placed by them on us for which BOTIL had obtained the duty free Advance Authorization for duty free import of essentially required components/ raw materials under Deemed Export Scheme.

Based on your letter referred above, ONGC had approached Directorate General of Hydrocarbons (DGH) in connection with issuance of Essentiality Certificate in respect of Corporate MM purchase orders cited in your letter. We have been informed by DGH that they do not issue EC for items which have already been supplied or against purchase orders which have already been executed (copy of communication from DGH is enclosed).

In this regard, we draw your attention to the BEC/Tender Conditions w.r-t Deemed Export Benefits which interalia stipulated that:

“Applicable documents for availing of Deemed Export Benefits (available against PEL/MI issue or renewed after 1.4.99), will be provided by ONGC on bidder's request/responsibitity.”

Accordingly, at your request, ONGC had issued the requisite Project Authority Certificate (PAC) in the format specified in Trade Policy and it is observed from your letter that BOTIL had also obtained the import licence/advance authorization from DGFT. In view of the above, we would like to state ONGC position that we do not accept any liability for reimbursement / refund of Deemed Export Benefits denied / withdrawn by the DGFT/Govt. of India for want of Essentiality Certificate from DGH, which was not sought from ONGC prior to the execution of Corp MM purchase order/supply of ordered goods/materials.

In this regard we would like to bring to your kind notice that, earlier in NC-I’s Meeting No. 5/15 dated 27/05/2014, the Committee had fixed the adhoc norms in respect of Advance Authorisation No.0710091489dated 22.10.2012 which was also for the same Export product, total quantity 11 numbers each.

4. Boeing, USA had placed a repeat purchase order on Dynamatics for the Cabinets in Aug 2013. Since by then the norms for the earlier license 0710091489 had not been fixed, we had to raise a fresh request for Advance authorisation and same was granted vide license No. 0710101865 dated 03.02.2014.

You are perhaps aware that ONGC Orders specify delivery time limits in their Order and to meet this requirement, we imported the raw materials against subject Advance Authorization and also have already executed the entire Order to the satisfaction of the Project concerned after manufacture of the ordered material in India. Also the requirement of DGHC certificate was never raised by the Advance Authorization issuing authorities, i.e. Office of Jt. DGFT, CLA, New Delhi, prior to issuing the said Advance Authorization.

The export obligation of subject Authorization was fulfilled by us as per conditions of the Order and Advance Authorization as detailed below:

• 1. Materials earmarked for ONGC Rajahmundry Project were despatched under BOTIL Invoice No. 270/XOI-1663/2013 dated 13.02.2014 for INR 12,19,850/- (equivalent to US$ 19,611.74 - Material value) thru’ M/s Omkara Transport P. Ltd., vide L.R. No.

Based on your letter referred above, ONGC had approached Directorate General of Hydrocarbons (DGH) in connection with issuance of Essentiality Certificate in respect of Corporate MM purchase orders cited in your letter, We have been informed by DGH that they do not issue EC for items which have already been supplied or against purchase orders which have already been executed (copy ofcommunication from DGH is enclosed).

In this regard, we draw your attention to the BEC/Tender Conditions w.r.t Deemed Export Benefits which interalia stipulated that:

“Applicable documents for availing ofDeemed Export Benefits (available against PEL/M1 issue or renewed after 1.4.99), will be provided by ONGC on bidder's request/responsibility.”

Accordingly, at your request, ONGC had issued the requisite Project Authority Certificate (PAC) in the format specified in Trade Policy and it is observed’ from your letter that BOTIL had also obtained the import licence/advance authorization from DGFT. In view of the above, we would like to state ONGC position that we do not accept any liability for reimbursement / refund of Deemed Export Benefits denied / withdrawn by the DGFT/Govt. of India for want of Essentiality Certificate from DGH, which was not sought from ONGC prior to the execution of Corp MM purchase order/supply of ordered goods/materials.
