Party Name: BOTIL OIL TOOLS INDIA PVT LTD(FORMERLY BAKER OIL) Meet No/Date:2/80­ ALC2/2014 15.04.2014 Status: Deferred HQ File :01/80/050/00199/AM14/ RLA File :05/23/040/00113/AM14/ Lic.No/Date:0510358721 04.07.2013 Defer Date:27.05.2014 Decision : The Commiĥee noted that PC‐VI secĕon has inĕmated vide their OM No. 01/92/180/MISC./AM‐13/PC‐ VI/11 dated 11.04.2014 that the issue of producĕon/requirement of Essenĕality Cerĕficate from the Directorate General  of  Hydro  Carbons  was  taken  up  with  the  Tax  Research  Unit(TRU),  Department  of  Revenue,  Ministry  of Finance  who  have  inĕmated  vide  O.M.  No.  354/148/2013‐TRU  dated  28.2.2014  that  under  Noĕficaĕon  No. 12/2012‐CE dated 17.03.2012 (Sl No. 336 of the Table) all goods supplied against ICB are exempt from excise duty subject  to  the  condiĕon  that  the  said  goods  are  exempted  from  the  duĕes  of  customs  leviable  under  the  First Schedule to the Customs Tariff Act 1975 and the addiĕonal duty leviable under Secĕon 3 of the said Customs Tariff Act when imported into India. It has been further inĕmated that under Noĕficaĕon No. 12/2012‐Customs dated 17.03.2012 (Sl No.  356  of  the  Table)  goods  specified  in  the  list  13  and  imported  in  connecĕon with petroleum operaĕons are exempt from BCD and CVD subject to fulfilment of the condiĕon No. 41 of the said noĕficaĕon. Condiĕon  No.  41  has  several  provisions,  one  of  them  being  producĕon  of  an  essenĕality  cerĕficate  from  DG,

and CVD subject to fulfilment of the condiĕon No. 41 of the said noĕficaĕon.
