MINUTES OF EPCG COMMITTEE HELD AT 11.00 AM ON 15.07.2010 IN ROOM NO. 04, UDYOG BHAWAN, NEW DELHI UNDER CHAIRMANSHIP OF SHRI V.K. GUPTA, ADDITIONAL DIRECTOR GENERAL OF FOREIGN TRADE. Minutes of last Meeting dated 03.06.2010 were confirmed. 3. The Agenda comprised of two parts, that is, PartI and PartII. It consisted of two types of cases i.e. Policy related cases and Nexus approval cases. At first, the Committee took up the cases relating to Policy and took the decisions as indicated against each of the case below : S. Rajkot. 2430000900 dated 05.03.2008 Regularization of location for installation of Capital Goods under Policy Relaxation. The Committee considered the case as per Agenda. It was noted that the firm has installed the capital goods in its own unit at a different address other than the unit endorsed on the licence and got the installation certificate of Central Excise Authorities thereof. However, the firm did not obtain prior permission of the same from Regional Authorities. The Committee further noted that the firm is a SSI unit and had got endorsement of the new location in its RCMC and IEC before installation of capital goods. Had the firm given this address in the application, there would
have not been any irregularity. This appears to be an inadvertent mistake by a new comer. In view of this, the request of the firm for regularization of location at Lodhika, G.I.D.C., Metoda, Rajkot instead of unit at 44, AJI G.I.D.C. Rajkot has been allowed subject to the condition that the new location should also be endorsed on the SSI certificate. 2. 2 of Agenda M/s M&M. Cocoa Product Pvt. Limited, Chandigarh (i) 2230000444 dated 26.10.2006 (ii) 2230000514 (iii) 2230000575 and (iv) 2230000576. Acceptance of Cocoa Beans in the form of Cocoa powder/Butter/Chocolates as Agriculture Products for fulfillment of export obligation against EPCG authorizations. The case was considered as per Agenda and with specific reference to the comments of the Policy 3 section . The Committee noted that the export product cannot be construed to be an agricultural product for the purpose of Para 5.7..6 of HBP.Vol under EPCG Scheme. Export product is Processed Food Item and not a basic agricultural product. Therefore, the request of the firm for nonmaintenance of Annual average export obligation benefit under Para 5.7.6 of FTP has been rejected. 3. 3 of Agenda M/s Hyundai Motors India Limited EPCG Authorizations issued during 19972010. Recognition of Vendors for redemption of EPCG Authorizations. Shri Mukundrajan, General Manager appeared before the Committee and made submissions in support of the request. The Committee noted that the firm has got the capital goods installed in the premises of technically specialized vendors and obtained installation certificates from the Excise authorities and the certificate has endorsement of both M/s
Hyundai Motors Limited as well as the name of the vendors. The Committee further noted that these vendors are only for manufacturing of specific components of the Hyundai Motors. M/s Hyundai Motors could have got endorsement of as many vendors as they wanted in their licences as supporting manufacturers. Committee noted their large turnover, investment, export potential and peculiar nature of Auto Car Industry wherein large number of vendors or supporting manufacturers are required. The firm has fulfilled 210% export obligation in respect of all the EPCG licences issued so far. It was decided to allow endorsement of the vendors as supporting manufacturers for regularization of the licences against which entire export obligation has been fulfilled subject to verification of details by Regional Authority. 4. 4 of Agenda M/s Insulator & Electrical Company, Bhopal 1130000113 dated 11.02.2003. Nexus Approval in respect of licence No. 1130000113 dated 11.02.2003. Shri S.C. Kaushik, Export Manager, appeared before the Committee and made submissions that the Committee had certified the nexus in respect of licence No.11300000104 dated 12.12.2002 having the same import items/export product as in the subject licence. The Committee noted that he Beams are refractory material and enquired from the representative that the beams imported were for the new
furnace or old. The representative submitted that the beams imported against the subject licence were for the new furnace and are for initial lining which is permitted under FTP. The Committee decided to certify the nexus subject to furnishing a Chartered Engineer Certificate that the Beams imported against the subject licence were for the new furnace only. 5. 5 of Agenda M/s Haldiram, Kolkatta. 02500228 dated 28.12.1999 Regularisation of extension from 20062008 and grant of Extension from 2008 to 2010 for redemption of EPCG authorization. Nonmaintenane of Annual Average export obligation for agriculture products. The Committee regularized the extension in EOP from 200608 and allowed extension in EOP from 2008 2010 under the provisions of Para 5.11 of HBP.Vol.I. However, in regard to the request for nonmaintenance of Annual Average Export Obligation, the Committee noted that the export products are processed food items and as such it is not Agricultural products and is therefore not eligible for waiver of Average export obligation. 6. 6 of Agenda M/s Duropack India Limited. Delhi. 0530130652 dated 01.11.99 Extension in EOP for 12 years under BIFR provisions and condonation of shortfall in meeting the threshold limit of 90% under Zero duty Scheme. The Committee considered the case as per Agenda. The Committee noted that the firm is a BIFR unit and Rehabilitation package approved by BIFR does not specify the period of extension. The Committee therefore decided to extend the EOP for 12 years as per
Para 5.5.1 of FTP. It was also
decided to allow conversion of the EPCG authorization from zero duty to 10% duty
scheme subject to payment of applicable duty by the firm. 7. 7 of Agenda M/s Astra Lighting Limited, Chandigarh 3493790 dated 26.10.1998 Condonation of Procedural Lapse of not mentioning EPCG License number and date on Export Shipping Bills. The Committee noted that the Grievance Redressal Committee extended the Export Obligation Period in its meeting held on 27.2.2006. However, since the extension granted by GRC was endorsed only in 2009, the custom authorities did not allow mentioning of licence number and date on the shipping bills in absence of the validity of the licence. In view of this, the Committee decided to accept the export made by the firm during the extended period under the provisions of Circular No. 7 dated 11.7.2002 which is already in effect. Further, the Committee desired that the above circular may be incorporated in the ensuing FTP/HBP.Vol.I. 8. 8 of Agenda M/s Chatha Foods Private Limited, Mohali , Punjab 0043420 dated 08.10.1998 (i) Extension in export obligation period for four months from 08.10.2009 to 05.02.2010 for regularization of Shipment bill. (ii) Condonation of Shortfall of 4.68% in the export obligation. Shri Kulbeer Walia, General Manager, appeared before the Committee and made submissions in support of the request. It was brought to the notice of the Committee that RA had corrected the export obligation vide their letter No. EPCG/24/AM99/246638 dated 10.5.2010 thereby increasing the EO by US $ 1.33 lakhs The Committee noted that the firm has already fulfilled the export obligation within the extended period. However, the last shipment was though sent from the factory
premises within the validity of the EOP, but the same was cleared from Custom Authorities only on 5.2.2010. Therefore, the Committee decided to extend the period four months for regularization of the licence. With regard to condonation of shortfall of 5% export obligation, the Committee observed that the provisions are already available in Para 5.12 HBP.VOl.I and as such it may be condoned by RA. 9. 9 of Agenda M/s Sumi Motherson Innovative Engg. Limited, Nodia. 0530133740 dated 15.01.2003 Fixation of Nexus approval Shri Brajesh Chhabra, General Manager appeared before the Committee and made submissions that the UPS and the Batteries were imported separately and showed Bill of Entries in support of the above facts. The Committee therefore decided to certify the nexus subject to execution of an undertaking that the Batteries imported separately were meant for use in the UPS which was imported without the battery component. 10. 10 of Agenda M/s Rubamin Limited, Vadodara Clarification for issuance of EPCG licence for import of Catalyst for initial charge required for technologically upgraded existing plant. Shri Sumit Bhargava, Manager appeared before the Committee and made submissions in support of the request. The Committee noted that the firm has an existing Plant for manufacturing of Cobalt and Cobalt Compounds; the
capital goods installed therein have been technically upgraded; and catalyst i.e. (CYANEX272 EXTRACTANT) is an essential input for initial charge of the upgraded Plant. Hence, the Committee decided to allow import of 4600Kgs of CYANEX272 EXTRACTANT as catalyst for initial charge as per Para 9.12 of FTP. The topup quantity to make up the losses of the catalyst would be imported on payment of full customs duty. The Committee further decided that import of refractory material/catalyst for initial charge in cases of upgradation of Plant and Machinery should be permitted only with the approval of the EPCG Committee. 11. 11 of Agenda M/s Sterlite Technologies Limited, Mumbai. 0330003529 dated 22.04.2003 (i) Extension in EOP from 8 years to 12 years in respect of EPCG licence No.0330003529 dated 22.04.2003 due to licence being of more than 100 Corores. (ii) Inclusion of alternate product. The case was considered as per Agenda. The Committee noted that though the application for issuance of the licence was submitted in AM02, the licence was actually issued in AM04 and hence the policy applicable to the subject licence is AM04. As per the Policy for AM04, the licences with cif value of and above 100 crores are entitled for 12 years EOP. In view of this, the Committee decided to accede to the request for enhancing the export obligation period upto 12 years from the date of issuance of the subject licence.
12 of Agenda M/s Vardhman Textiles Limited, Ludhiana 01500737 dated 17.03.1999 Inclusion of alternate products, viz Yarn from 26.07.2005 and carry forward of EO performance from 2nd and 3rd Block to 4th block Shri Rajesh Chopra, Vice President, appeared before the Committee and made submissions in support of the request. The Committee noted that as per the provisions of Para 5.8.3 of HBP.Vol.I , the blockwise performance may be condoned subject to payment of 2% composition fee in proportion to the shortfall in the export obligation at the end of each block and allowed refixation of the export obligation on duty saved amount basis as per
Para 5.19 of the HBP.Vol.I.
The Committee also acceded to the request for inclusion of ‘Yarn’ as an alternate product from 26.7.2005 (date of application). 13. 13 of Agenda M/s Paramount Textiles Pvt. Limited (i) 3530000119 dated 24.05.2001 (ii) 3530000129 dated 12.07.2001. (i) Extension in EOP for 2 years and condonation of block wise fulfillment of Export obligation. (ii) Refixation of EO on duty saved amount. The Committee decided that as per the provisions of Para 5.8.3 of HBP.Vol.I, the block wise performance may be condoned subject to payment of 2% composition fee in proportion to shortfall in the export obligation at the end of each block and refix the export obligation on duty saved amount basis as per
Para 5.19 of the HBP.Vol.I.
The Committee also acceded to the request for extension in EOP for 2 years subject to payment of 2% composition fee for each year of extension, or enhancement of 10% EO for each year of extension, as per the choice of the
exporter, under Para 5.11 of HBP.Vol.I. 14. 14 of Agenda M/s Pioneer Industries Limited, Pathankot. 3030000183 dated 11.05.2001 Condonation of Blockwise Export Obligation fulfillment under Para 6.11 of (RE2001) FTP. The Committee decided to allow the condonation of Blockwise EO fulfillment under para 5.8.3 of HBP.Vol.I. However, the Committee noted that since the firm is a BIFR Unit, the condonation may be allowed without insisting for composition fee. 15. 15 of Agenda M/s Garware Wall Ropes Limited, Pune 3130000080 dated 30.11.2000 (i) Request for relaxation in terms for
Para 4.14 of EXIM
Policy 19972002 from the condition of
Para 6.11 (B) Read
with Para 6.15 of HBP 19972002. (ii) Fulfillment of EO Blockwise and (iii) Extension in Export Obligation period from 2nd block period to 3rd block. The Committee considered the request as per Agenda. It was noted that the firm has fulfilled the entire export obligation within the validity of the licence. The Committee decided to allow condonation of shortfall in maintenance of blockwise export obligation under Para 5.8.3 of HBP.Vol.I,i.e. subject to payment of 2% composition fee in proportion to shortfall in EO at the end of each block. 16. 16 of Agenda M/s Larsen & Toubro Ltd, Mumbai Import of Shipyard Transporter under EPCG Scheme. The case was considered as per Agenda. Shri Ashok Sahijwani, DGM appeared before the Committee and made submissions in support of the request. The Committee noted that the Shipyard Transporter is a specialized equipment for hull elevation and assembly purposes and is specially designed to be used for lifting of ship hulls and other load vessels in dockyard and boatyard for assembly of hulls. The equipment cannot
ply on road. In view of this, the Committee allowed import of Shipyard Transporter under EPCG Scheme. 17. 17 of Agenda M/s Bombay Dyeing & Mfg. Co. Ltd. As per enclosure Deletion of annual average in respect of 23 EPCG Authorizations issued during the period 2.08.2006 to 27.05.2008 ( As per R.A. Report ) enclosued. Shri Bhanwar Singh, General Manager, appeared before the Committee and made submissions in support of the request. The Committee noted that the firm had only Two units. One of the two units was closed down as per the order of Maharashtra Government. However, the export made by the closed unit was included for fixation of annual average export obligation against the licence issued subsequent to the closure of the unit. The Committee however asked the firm to submit details of the export figures, yearwise, to arrive at exact figures of export included for fixation of annual average export obligation against the licences issued after closure of the unit. Hence, the case was deferred. 18. 18 of Agenda M/s KLT Authomotive & Tubular Products Ltd, Mumbai 0330000744 dated 05.12.2000 Nexus Approval (Amendment in description of export product). Shri Mayank Jain, Vice President appeared before the Committee and made submissions in support of the request. The Committee noted that there is clear nexus between the imported goods and export products as endorsed on the licence. Hence, the nexus was certified. 19. 19 of Agenda M/s Sterlite Industries (India) 8 licences as detailed in column Nexus approval in respect of EPCG Shri G. Senthilnathan, Associate General Manager
Limited, Mumbai 2 of Statement at ‘X’ of Agenda authorizations contained in the Statement at ‘X’ of Agenda appeared before the Committee and made submissions. The Committee maintained the rejection of nexus in respect of licence No. 0330004099 dated 11.8.2003 issued for import of Stainless Steel Plate ASTM and Annealed Pickled Specification ASME for export of Anode Slime, Copper Cathodes and Rods. However, nexus has been certified in respect of licences, viz (i) 0330004460 dated 7.10.2003; 0330003424 dated 25.3.2003; (iii) 0330002644 dated 3.10.2002; (iv) 0330004270 dated 4.9.2003; (v) 0330003476 dated 31.3.2003; (vi) 0330003462 dated 28.3.2003; and (vii) 0330003776 dated 19.6.2003. 20. 20 of Agenda M/s Shri Shakti LPG Limited, Hyderabad 01500526 dated 03.10.1996 Waiver of Export Obligation under Para 2.5 of FTP. Shri D.V. Manohar, Chairman, Shri Shakti Group appeared before the Committee and made submissions in support of the request. The Committee informed the representative that there is no provision for waiver of export obligation and hence the request cannot be acceded to. The representative then expressed willingness to fulfil the export obligation in case the export obligation period is extended in lieu of the period of seizure of the capital goods by the Custom authorities. The Committee
observed that the period of seizure was about 3 years and 9 months and final decision on appeal filed by party is awaited. It was therefore decided not to allow extension in time. 21. 21 of Agenda M/s Malwa Industries Ltd., Ludhiana 3030000258 dated 01.03.2002 Regularization of EPCG Authorization and issuance of EODC.
