items of export and import are the  same  in  all  licences,  RA would  be  advised  to  consider the  excess  shipping  bills against    licence  No.  2134421 dated  30.6.1995  towards  EO fulfillment  of  other    EPCG  licences  viz  0023628  dated 31.7.2003,  0023638  dated 31.12.2003, 3430000003  dated 25.7.2000,  3430000039  dated 18.12.2001,  3430000088  dated 3.1.2003  and  3430000916 dated 18.9.2006 of the firm. 2. (65)  of Agenda Part – I Purewal &Associates Ltd. 18/70/AM­ 10/EPCG­I 2288001500 Dt. 13­10­2003 Permission  to export  alternate products. The Committee considered the requests  as  per  Agenda  and decided  to  allow  export  of  alternate  products  namely Turned  Gears,  Wheels  and Pinions  through  Supporting Manufacturer    viz.  P.A. Pinions, Dharampur, Himachal Pradesh  by  shifting  the machinery to the latter, subject, however  to  the  condition  that the  firm  would  submit Installation  Certificate  from

(61)  of Agenda Part ­ I Videocon Exports  Pvt. Ltd., Aurangabad 03501002 Dt. 28­10­98 Inclusion  of Alternate  Product namely  Tape recorder  & Combination  with Radio, etc. The  representative  of  Deptt. of  Revenue  stated  that  the policy  for    inclusion  of alternate products was not in existence  during  the  policy period  1997­2002.  The Committee, however.  observed that  the  firm  had  applied  on 27.03.2004 for inclusion of the said  alternate  products,    after introduction  of  the  provision for  inclusion  of  alternate

Agenda Part ­ I Imaging  India (P) Ltd. 01/36/218/15/ AM07/EPCG­I Dt. 18.10.2000 digital  imaging solutions  using scanning, proofing,  Digital printing  and finishing. of  Revenue  stated  that  the policy  for    inclusion  of alternate products was not in existence  during  the  policy period  1997­2002  in  view  of Notification  No.  28  dated 28.1.2004.    The  Committee decided  to  allow  extension  in export  obligation  period  for two  years  upto  17.10.2010 from  the  date  of  expiry  of  the original  period  and  to  allow  exports  of  alternate  upto  50% under  the  provisions  of  Para 5.11 of HBP Vol. I and Para 5.5 (i)  of  FTP,    respectively  .The firm  will  deposit  2%  of  duty saved  amount  in  proportion  to duty saved  on unfulfilled E.O. for  each  year.  They  will  also

(113)  of Agenda         Part ­ II M/s.  Rubco Sales International Pvt. Limited F.No.18/63/AM­ 10 /EPCG­II 1030000136 Dt. 16.11.2000 Extension in EOP, condonation  in block  –  wise  EO performance  and refixation  of export  obligation on  duty  saved amount basis. The  representative  of  Deptt. of  Revenue  stated  that  the requests for refixation of EO  cannot  be  acceded  to  as  the firm  failed  to  maintain  the block­wise  performance.  The Committee,  however,   decided  to  allow  extension  in EOP  for  two  years  , condonation  of  block  –  wise EO performance and refixation of  EO  on  duty  saved  amount basis  as  per  the  provisions  of

Para  5.11,  5.8.3  and  5.19  of

current  HBP  Vol.  I, respectively.  The  extension  in EOP  and  condonation  of Block­wise  performance  will be  allowed subject to payment
