MINUTES OF EPCG COMMITTEE MEETING HELD ON 1.10.2007 AT 3.00 P.M. UNDER CHAIRMANSHIP OF DR. SHYAM AGARWAL, ADDITIONAL DIRECTOR GENERAL OF FOREIGN TRADE ……….. EPCG Committee took following decision after deliberations: 2.1 Case No.1 : Connectwell Industries (P) Ltd., Mumbai – (EPCG Licence No. 0330003293 dated 21.02.2003 ) Committee approved Nexus between the imported Capital Goods (CGs) and export product as per DIPP letter No. IPP/EPCG/95/2001/TSW/108 dated 21.08.2007. 2.2 Case No.2: Pamban Apparel Limited, Aundipatti, Distt: Theni, Tamilnadu (EPCG Licence No. 2154215 dated 16.06.1997) Committee approved condonation of blockwise fulfillment of export obligation observing that firm has fulfilled the entire Average E.O. through 3rd party exports.

Committee suggested that introduction of policy provisions to ensure that fulfillment of EO through third party exports should not be more than 50% in any case may be examined by DGFT. 2.3 Case No.3: Reliance Logistics Limited, Mumbai – (EPCG Licence No. 0330003716 dated 04.06.2003) Committee approved request subject to the condition that the firm has already fulfilled the export obligation. 2.4 Case No.4: A.P.Dairy Development Coop Federatioon Ltd., Hyderabad (EPCG Licence No. 0196283 dated 17.02.2000) Committee deferred the case pending report called for by DOR in this regard. 2.5 Case No.5: Margra Industries Ltmited, New Delhi – (EPCG Licence Nos.: (i) 2117551 dated 17.11.1995, (ii) 103248 dated 18.1.1999, (iii) 94909 dated 1.7.1998, (iv) 128232 dated 4.3.1999, (v) 96122 dated 12.8.1998) Committee observed that since the licence Nos 94909 dated 1.7.1998 and 96122 dated 12.8.1998 have been issued in the same fiscal and do not have any liability towards

2.6 Case No.6: Flora Textile Ltd., Coimbatore – ( EPCG Lic.No. (i) 2133600 dated 9.11.1994 (ii)2133940 dated 1.3.1995 (iii) 2156068 dated 8.9.1995) Committee deferred the case with observations that the firm has to submit actual performance of Exports in Shirting fabric and Grey fabrics, separately and also furnish the extent of direct exports, third party exports and domestic sales. P/CG/2129103 dated 6.11.1992) Committee rejected request because any of the following requests are not provided for in extant policy guidelines. (i) Waiver of average EO fulfillment; and (ii) Nonenhancement of EO with higher cif value. 2.8 Case No.8: Sree Rayalaseema Alkalies and Allied Chemicals Ltd, Kurnool (A.P.) ( EPCG Lic. Committee agreed to consider application of firm received on 17.11.2004 as it is within extended period of 2 years (which is extendable to EPCG License holders on payment of 2% composition fee) subject to payment of 2% composition fee for late submission of request. Performance of actual exports till date in terms of direct, third party and deemed exports etc may be put up separately for consideration of other requests of EPCG license holder. 2.9 Case No.9: Videocon International Ltd., Aurangabad – (EPCG Lic. No. 0330000229 dated 30.3.2000) Firm has submitted installation certificate of concerned Jurisdictional Central Excise Authorities in support of actual user condition. Committee desired that comments of technical authority may be obtained for nexus. 2.10 Case No.10: Reliable Wares Pvt. Ltd., Cochin – (EPCG Licence No. 2335228 dated 30.6.1999) 2.11 Case No.11: Ballarpur Industries Ltd., Mumbai Both the cases ( 2.10 & 2.11) were deferred.
