Minutes of the 4th Meeting of EPCG Committee of AM­07 held on 19.07.2006 at 3.00P.M   The  4th  meeting  of  the  EPCG  Committee  for  the  licensing  year  2006­07  was  held  on  19.07.2006  at  3.00P.M.  in  Room  No.4  under  the chairmanship of  Shri Surat Singh, Addl. DGFT to  consider the cases under the EPCG Scheme of Foreign Trade Policy.                            The following were present in the meeting:      1.           Shri Surat Singh, Chairman 2.           Shri V.C.Agarwal,Addl. Industrial Adviser, DIPP 3.           Shri Anurag Bakhshi, STO, Deptt. of Revenue, (Drawback) 4.           Shri Jasbir Singh, Industrial Adviser, Deptt. of C & PC 5.           Shri A.K.Agarwal, Dy. IA, C & PC 6.           Shri Ashutosh Jindal, Jt. DGFT. 7.           Shri C.V.L.N.Prasad,Dy.DGFT 8.           Shri Brajesh Sikka,FTDO, EPCG­I 9.           Shri S.S.Prasad , FTDO, EPCG­II 10.       10.Shri Arvind Kumar, FTDO. EPCG­III              The EPCG Committee discussion, the Chairman welcomed the members of the Committee and thereafter individual cases of exporters under EPCG Scheme were discussed and following decisions were taken as under:­   “Part­C­II”           C­II/01                                M/s.Popatlal Nathalal Shah, Mumbai   04/AM07 dated 19.07.2006   F. No.01/36/218/20/AM­06/EPCG­I     The Committee considered the agenda  note and decided to certify nexus for items No. 1,2,& 3 of the list of the capital goods imported only with  the  export  product  (s)  against  EPCG  licence  No.  0330003023  dated  01.01.2003  on  the  basis  of  comments  of  DIPP  vide  letter  No. IPP/6/81/2003­TSW/94 dated 29.06.2006.  As regards the remaining items the specific use of each item has not been furnished and appear to be in the nature of spares/consumables & are, therefore, not certified by the Technical Authority i.e. DIPP.            C­II/02                                M/s. D.A. Jhaveri, Mumbai    04/AM07 dated 19.07.2006   F. No.23/1621/AM­03/EPCG­I   The Committee considered the agenda  note and decided to certify nexus between the capital goods imported and the export product(s) against EPCG licence No. 0330002790 dated 31.10.2002 subject to applicant /supporting manufacturer holding valid Industrial Approval for manufacture of the items of export at the locations indicated in the application on the basis of comments of DIPP vide letter No. IPP/6/1/2003/TSW dated 19.07.2006.

C­II/03                                   M/s. Ester Industries Ltd., New Delhi     04/AM07 dated 19.07.2006      F. No.20/777/AM­96/EPCG­I   The Committee considered the agenda note and decided to allow condonation of blockwise fulfillment of EO against EPCG licence No. 01500252 dated 20.02.1996.       C­II/04                                M/s. Pyramid Plastics, Mumbai       04/AM07 dated 19.07.2006      F. No.23/227/AM­00/EPCG­I        The Committee considered the agenda note and decided to defer the case since the Revenue Department has asked for a report from their port offices.  It was decided, however, to inform RLA concerned that the abeyance period may be extended further.  They may also pursue the matter with concerned authorities and get the matter expedited further.              C­II/05                              M/s. Galaxy Surfacatants Ltd., Mumbai         04/AM07 dated 19.07.2006    F. No.01/36/218/84/AM­06/EPCG­I   The Committee considered the agenda  note and decided to defer the case. The Technical Authority advised that the firm has mentioned export product as Chemical and allied products which is very broad term.  The firm may be requested to furnish specific items of Chemicals and allied products to be exported which are manufactured by the import item like Reactor etc.      C­II/06                                M/s. Gel Consultants Pct. Ltd. Mumbai        04/AM07 dated 19.07.2006    F. No.01/36/218/85/AM­06/EPCG­I      The Committee considered the agenda note and decided to certify    nexus of the import items with the export product against EPCG licence No. 0330002999 dated 27.12.2002 on the basis of observations and recommendations as recorded by the Technical Authority i.e. Deptt. of C & PC.        C­II/07                               M/s. EI  Dupont India Ltd., Baroda        04/AM07 dated 19.07.2006    F. No.01/36/218/04/AM­07/EPCG­I      The Committee considered the agenda note  and decided  to defer the case.  The Technical Authority advised that the firm may be requested to furnish specific items of products to be exported which are manufactured from the import items.       C­II/08                               M/s. Kaizen Engineers, Mumbai        04/AM07 dated 19.07.2006    F. No.01/36/218/69/AM­06/EPCG­I     The Committee considered the agenda  note and decided to reject the case for non­ submission of information /clarification asked for by the technical authority i.e. DIPP vide letter No. IPP/6(210)/03­TSW/321 dated 29.12.2005.     C II/09 M/ R l t P t Ltd M b i

The Committee considered the case as per agenda. As the date of installation of CGs was not clearly indicated in the Chartered Engineer’s certificate,  the  Committee  decided  to  defer  the  consideration  of  the  case  and  directed  to  ask  the  firm  to  furnish  the  date  of  installation  of  the machinery  for  further  consideration  of  their  request  in  the  next  meeting.  The  firm  may  also  give  factual  details  of  the  cited  reason  for  delay  in installation of CG and as to why they have applied so late.    Case No. Name of the Firm File No & Meeting date.   2. M/s.Arthanari Loom Centre, Coimbatore. 18/16/AM.07/EPCG.II  Dt.19.07.2006         The Committee considered the case as per agenda.  The representatives from DIPP and Deptt. of Revenue expressed some reservations on the issue.  The Committee deferred the consideration of the case and directed to prepare agenda afresh alongwith letter of firm and RLA and all details & back ground of the case.   Case No. Name of the Firm File No. & Meeting Date.    3. M/s.Anburam Knitweaer Process, Tirupur. 18/16/AM07/EPCG­II Dt.19.07.2006         The Committee deferred the consideration of the case as the representative from Deptt. of Revenue stated that they will ask the concerned Custom authorities to clarify as to how they collected 10% duty on a 0% duty licence.       Case No.4. Name of the firm File No. & Meeting dt.19.7.2006   M/s Eesha Tools, Mumbai 18/30/AM06/EPCG­II        The Committee considered the case as per agenda.  The representative of the firm explained their request before the Committee.  It was decided to recommend the case to PRC for consideration, in view of the letter from Central Excise and also the since the exports are made through third party, on the firm’s request for condoning procedural lapse of not mentioning EPCG licence on the shipping bills.   Case No. 5 M/s S.Kumar Nationwide Ltd., Mumbai 01/36/022/52/AM08/EPCG­II Dt.19.07.06.         The Committee considered the case as per agenda and directed to ask the firm to indicate option of                         paying 2% composition fee or 10% of unfulfilled export obligation as per para 5.11, before conveying approval for further extension   Directorate General of Foreign Trade

Directorate General of Foreign Trade (EPCG­III Section)   MINUTES OF 04rd MEETING OF EPCG COMMITTEE OF AM­2007 HELD ON 19.7.2006 at 3.30 PM   The 04rd meeting of the EPCG Committee during the licensing year 2006­07 was held on 19.7.2006 at 3.30 PM under the Chairmanship of Sh.Surat  Singh,  Addl.DGFT  to  consider  the  cases  of  Miscellaneous  export  products  (Other  than  Engineering,  Chemicals  and  Allied  Products).  The following were present in the meeting:­   1. Shri V.C.Agarwal, AIA, DIPP 2. Shri Anurag Bakshi, STO 3. Shri Jasbir Singh, IA, M/o C&PC 4. Shri Ashutosh Jindal, Jt.DGFT 5. Shri Ram Kumar, Dy.DGFT 6. Shri CVLN Prasad, Dy.DGFT 7. Shri Brajesh Sikka, FTDO 8. Shri Shyam Lal, FTDO 9. Shri S.Prasad, FTDO 10. Shri Arvind Kumar, FTDO             The individual cases of exporter under EPCG Scheme were discussed and the following decisions were taken:­     Case no. Name of the firm Licence number C­II/1 04/AM07 19.7.2006 M/s Vaneet Knittings (P) Ltd, New Delhi F.No.20/672/94/EPCG­IV P/CG/ 2133436 dated. 5.9.94   The case was considered as per agenda. The representative of the firm appeared for PH before the Committee. The firm had requested for inclusion of additional export product namely ‘PVC leather cloth’ for fulfillment of EO. The firm’s representative stated that they got EOP extension t 2008 b GRC d th t th t t t “PVC l th l th” i t d f “k itt d

upto  2008  by  GRC  and  that  they  now  want  to  export  “PVC  leather  cloth”  instead  of  “knitted yarn” for which the CG was imported. They stated that there is no more market for knitted yarn and they will get this knitted yarn coated with PVC through some job work and then they will export  the  same.  The  Committee  observed  that  para  5.4  of  FTP  does  not  allow  the  use  of supporting manufacturer or job work for obtaining a value added item for export. Accordingly, it was decided to refer the case to PIC to take a view whether such a value added item/alternate product which is manufactured by the help of third manufacturer or by way of job work can be allowed for export under EPCG regime.         Case no. Name of the firm Licence number C­II/1 04/AM07 19.7.2006 M/s Surabhi Garments , New Gurgaon   F.No.20/725/92/EPCG­IV P/CG/2100819 dated. 17.9.1992   The case was considered as per agenda. The Committee noted that the firm’s request to count Average EO from the start of financial year and not from the date of issue of licence was also considered  by  the  EPCG  committee  in  its  meeting  dated.9.10.1995  and  the  Committee  had rejected  the  firm’s  request.  The  Committee  also  observed  that  the  firm  had  submitted  Bank Guarantee only for two years claiming that they will fulfill EO in one year only, however since the exact circumstances for such EO fulfillment conditions were not clear so it was decided to defer the  case.  The  detailed  agenda  bringing  out  the  facts  and  the  prevailing  instructions  in  this regard, if any, may be put up before the Committee in next meeting.     Case no. Name of the firm Licence number C­I/3 04/AM07 19.7.2006 M/s Kanco Enterprises Limited, Ahmedabad F.No.20/068/2005­06EPCG­III     The Committee considered the case as per the agenda. The firm wanted a clarification whether Glass wool, which was to used in the Humidification plant can covered under CG definition. After detailed  discussion,  Committee  decided  to  defer  this  case  as  the  comments  of  technical authorities  had  not  been  received  so  far.  Reminder  to  technical  authorities  may  be  issued. Thereafter it may be again placed before the Committee.
