At the outset, the Committee noted that the procedure for allocation for year 2024-25, for import of (i) Calcined Petroleum Coke (CPC) for Aluminium Industry and (ii) Raw Petroleum Coke (RPC) for CPC manufacturing industry was notified vide Public Notice No. 49/2023 dated 11.03.2024.

The Committee noted that in pursuance to the Public Notice No. 49/2023 dated 11.03.2024, 22 applications were received for import of RPC and 4 applications were received for Import of CPC.

The Committee noted that the Commission for Air Quality Management (‘CAQM’) vide its order dated 15.02.2024 has decreed that the import of RPC for CPC manufacturing industry has been revised to 1.9 Million MTs. Further, Import of CPC for Anode making for Aluminium Industry in 2024-25 shall been limited to 0.5 Million MTs.

- Committee noted that pursuant to the recommendations of CAQM issued vide Order dated 14.02.2024, DGFT vide Notification 68/23 dated 07.03.2024 has notified that – Total import of 1.9 Million MTs of RPC for manufacturing CPC and 0.5 Million MTs of CPC for Aluminium Industry respectively shall be permissible during 2024- 25, subject to the following conditions: i. Import of RPC & CPC shall be permitted only as a feedstock / raw material and under no circumstances shall be used as fuel. ii. Import of RPC and CPC shall be permitted to cater entirely to the domestic needs of Aluminium industry (including Vedanta SEZ), for the
processes as permitted under the relevant regulations / statutes.
iii. Import of RPC by Calciners shall be on Actual User basis and shall not
be transferred to any other unit(s) including SEZ unit(s). Export of CPC by
Calciners shall not be permitted.
iv. Import of CPC by Aluminium Industry shall be on Actual User basis.
Export of Anode by Aluminium Industry shall not be permitted.
v. All other conditions as mentioned in the Commission for Air Quality
Management in NCR & Adjoining Areas Order No- F. No. 160014/16/2021-
MERD/PetCoke-35 dated 14.02.2024 should also be complied with.

The production capacity of Calciners was converted to RPC Input requirement at an industry average conversion rate i.e., 1:1.36 ii. In case the RPC Input permitted in the CTO, was lower than the quantity at the conversion rate, the lower of the 2 values was considered. iii. The import quantity is divided on a proportionate basis as per the following formula: – QA = Q * (QAD / QTD) Where: QA = Pro-rata Import allocation to applicant ‘A’ Q = Total Import Quantity for allocation QAD = Demand by Applicant ‘A’ QTD = Sum of demand by all applicants For RPC – Demand is calculated based on installed capacity certified by SPCB and the conversion factor of CPC: RPC = 1:1.36.

In cases where import quantity requested is lower than the import quantity eligible, the arising surplus is redistributed among other applicants proportionately. Accordingly, based on the above principles, the Committee decided the import allocation as stated at Annexure-I for CPC & Annexure-II for RPC, subject to conditions as notified by DGFT.

The copy of the Restricted Import Authorisation issued by DGFT shall be submitted to concerned SPCB, CPCB and MoEF&CC for monitoring purposes.

Subsequent to obtaining the Import Authorisation for the year 2024-25, in cases where the applicant is not in a position to import and utilise the allocated quantity, the applicant shall intimate suitable quantities for surrenders via through email at import-dgft@nic.in on or before 31.10.2024

The above allocation has been made as per the documents submitted by the applicant along with the online application. If at any point any discrepancy is found in the said documents provided, or the firm is found to be in violation of any of the conditions specified on the authorization, the allocation will be cancelled ab-initio. Appropriate action shall be initiated thereafter under the relevant provisions of the FT(D&R) Act, 1992, as amended from time to time.
