DGFT Committee Minutes

MINUTES OF EFC NO. 12/AM12  DATED 19.05.2011   Meeting No. 02/AM12 of EXIM Facilitation Committee (EFC) was held on 19.05.2011 under Chairmanship of Shri Amitabh Jain, IAS, Additional Director General of Foreign Trade.   2.             Following officers attended the meeting: 1.             Ms. Shubhra,  Jt.DGFT                                                                      DGFT 2.             Shri K.K. Sinha, IA                                                                               DIPP 3.             Shri V.K. Tyagi, Dy. IA                                                                        Pharma 4              Representative from                                                                           MHA   Import Cases (Total 148 Cases)   2.             Following decisions were taken: 2.1          All the cases for import of Aluminium Scrap shall henceforth be referred only to M/o Environment & Forest and not to MSME.   2.2          The subject of import of GPS/ GPRS equipment used in vehicle tracking etc. was discussed.  It was brought to the notice of the committee that DOT has sent their comments in some cases whereby they are asking importers to get a licence from WPC wing of DOT. MHA has also cleared case(s) subject to conditions (i) Only those reputed firm who will not use it other than the vehicle tracking application (ii) The record of sale in units with Serial number, vehicle number, number of output port used should be maintained,  unused port

firm who will not use it other than the vehicle tracking application (ii) The record of sale in units with Serial number, vehicle number, number of output port used should be maintained,  unused port must be sealed / disconnected to be used externally. Complete unit should be housed in a tamper proof box, (iii) the regular check of system should be maintained remotely and physically once in a month and (iv) any stolen vehicle with system be reported to Police indicating the device fitted with, on recovery of vehicle, the device must be checked etc. The Committee observed that these conditions too difficult to verify as there is no specific agency responsible to do it.  Therefore, it is not practical to impose these conditions and issue licence. It was therefore, decided that a detailed reference be made to DOT asking the basis for imposing licensing (to be obtained from DOT) and to MHA inviting their attention to impracticality of the situation.  It was further decided to examine ITC and current Foreign Trade Policy and proceed with Inter­ Ministerial Committee as above.   3.             After deliberations, following decisions were taken:   3. 1         Following 28 applications for import were approved.
