EXIM FACILITATION COMMI1TEE (EFC) MEETING for the month of September, 2024 Meeting No.06 (2024-25) of EXIM Facilitation Committee (EEC) was scheduled in physical mode under the Chairmanship of Shri Rakesh Kumar, Addl. DGET at 12 Noon on 30.09.2024, Vanijya Bhawan, New Delhi to consider the applications for export of 'restricted' items. Meeting notice and agenda were shared with the EEC members, however, no EFC member except Shri Dilip Srivastava, Deputy Commissioner (QC), D/o A&FW was present to attend meeting in time. 2. In terms of Para 2.48 (c) read with Para 2.68 of HBP, 2023, EXIM Facilitation Committee (EFC) meeting held once every month to consider applications on merits for issue of export Authorization. 3. EEC meeting for the month of September was not held due to non-participation of EEC members however in order to facilitate exports, it has been decided to approve those cases in which comments! NOC from Nodal Ministry/Departments has been received. 4. However, based on the NOCs already received, decisions have been taken. Out of the 151 applications to be considered, based on the comments/recommendation of respective nodal Ministries/Departments, 52 cases are approved, 32 cases to be rejected & closed and 10 cases are under deficiency. Remaining cases are deferred due to want of comments/NOC from the concerned administrative Ministry/Department or information from the applicants. The cases are tabulated as under:- SI. Accordingly, EEC has decided to reject the application by informing the same to the firm. Note: Deferred cases: Cases shown as deferred imply that approval is pending for want of comments/NOC from the concerned Technical Agencies, requirement of additional information/clarification from the applicant firm or necessary examination of specific documentary evidence of the firm. Approved cases: Cases which got approved by EEC are issued export authorizations by DGET (Hqrs.) to the firm(s). As per Appendix 2K of FTP-2015-20, the fee for obtaining export license is Rs. 1000/- only (per application) irrespective of item/quantity/FOB value etc. ii. Approved post-facto: Cases shown as Approved post-facto imply that approval against those cases have already been issued by DGFT (Hqrs), with the approval of Chairman, EEC in terms of

Para 2.51(c) of HBP (Handbook of Procedure 2015-20). In order to facilitate export, Para 2.51

gives power to Chairman, EEC to issue authorization in those cases, which have been discussed by EFC at least once in previous meeting and got deferred, and where NOCs / recommendations have been received subsequently from the concerned agency (ies) with no divergence in views. However, such cases shall be brought before EFC in its subsequent meeting for approval on ex- post facto basis. iv. Dropped. Cases shown as Dropped imply that the firm is not responsive to the queries of DGET or to the concerned Administrative Ministry/Dept. and has not furnished documents/information/ clarification as called for despite reminders. Such cases are dropped from active agenda of EEC. However, the case can be reopened once the documents are received from the firm with fresh date of application. V. Rejected. Cases which are shown as Rejected imply that the EEC, after consultation with the Administrative Ministry / Dept., decided not to grant authorization due to reasons such as, proposal not supported by the concerned technical agency, not furnishing the relevant documents within the stipulated time period, not replying to the deficiency letter within the

prescribed time period. No further communication will be issued by DGFT (Hqrs) in such cases. However, the firm can request for review of the decision of the Committee before DGFT, vi. Closed. Cases which are shown as Closed imply that the EFC, after consultation with the Administrative Ministry/Dept. has decided to close the case due to the reason that the proposed item to be exported is 'Free' as per the present ITC (HS) Export Policy, 2018 and does not require license from DGFT.
