Decision :- After deliberation, the Committee has noted the performance of the unit for the period 2013-14 and 2014-15, that the unit has achieved Positive NFE on cumulative basis in terms of Rule 54 of SEZ Rules, 2006 and directed to process the Debonding of unit, subject to all regulatory compliances and payment of outstanding dues, if any. Decision :- After deliberation, the Committee has noted the performance of unit for the period 20 J 0-11 to 2014-15, that the unit has achieved Positive NFE on cumulative basis in terms of Rule 54 of SEZ Rules, 2006. The Committee also directed to: a . verify the legal aspect as to whether the Official Liquidator can take over the premises in 2017 when the LOA had already expired before i.e. in the year 2015. b. Initiate action for eviction proceedings under Public Premises Act, 1971 as the unit failed to clear outstanding dues on Recovery Notice. c. Take all necessary action for Recovery of Outstanding arrears rental dues of Rs. 17,89,693/- and recovery of customs duty. Peerless Fabrikerene (India) Ltd. for the block period 2013-14 to 201 7-18, that the unit has achieved Positive NFE on The Committee held the view that following action may be initiated:- a. Initiate action indicating that sub-letting is not possible in terms of the prevailing Exit Policy. However, in cases of any directions received from DOC in this regard, the same may also be examined. b. Unit should pay the rental dues and submit the proposal for sub-division of plot. c. The sub-let units to independently pay rental dues to SEEPZ SEZ Authority as per the prevailing rates of rental charges d. It was informed to Committee that action has been initiated against the unit i.e. issuance of SCN for mis-declaration of data in APR as pointed out by the CRA. Decision: The representative of the unit attended the Meeting, however, the Committee deferred the proposal. a.
