The New Education Policy 2020 emphasises Internationalisation

(relevant extract of NEP 2020 attached) Accordingly, University Grants Commission (UGC) has brought out UGC (Setting up and Operation of Campuses of Foreign Higher Educational Institutions in India) Regulations, 2023, (Copy attached) providing a regulatory framework allowing the entry or higher-ranked foreign universities, for the internationalization of Indian higher education as envisaged in National Education Policy, 2020 to provide an international dimension to higher education, enable Indian students to obtain foreign qualifications at affordable cost, and make India an attractive global study destination and for fulfilling the need to facilitate the entry of foreign higher educational institutions into India. At the same, because of various reasons, huge built-up or otherwise space is lying vacant in Indian SEZs including in IT/ITES SEZs located in various metro cities which can be put to use for setting up of such campuses of reputed foreign universities. CASE STUDIES OF FHEIs SET UP IN INDIA Australia’s Deakin University has already set up its first international branch campus in Gujarat International Finance Technology (GIFT) Similarly, University of Wollongong Australia, with branches already in Malaysia, Hong Kong and Dubai has set up its operations in GIFT City with the new branch commencing classwork in November 2024. Western Sydney University is planning to commence its Bengaluru, India campus by 2025. It already has branches in Indonesia and Vietnam. This will be the third Australian University that showed interest in establishing a FHEI in India, indicating the immense traction towards FHEIs by top ranked institutes.

This will provide an international dimension to higher education, enable Indian students to obtain foreign qualifications at affordable cost, and help in making India an attractive global study destination. (v)                    Accordingly, University Grants Commission (UGC) notified UGC (Setting Up and Operation of Campuses of Foreign Higher Educational Institutions in India) Regulations ,2023. (vi)         Earlier, the International Financial Services Authority (IFSCA) has also permitted foreign universities and institutions to set up campuses in the GIFT International Financial Services Centre, an SEZ, through the IFSCA (Setting up and Operation of International Branch Campuses and Offshore Education Centres) regulations, 2022. (viii)      These higher education campuses will provide opportunities for employees working in SEZs to enhance their skills and stay updated with the latest knowledge in their fields. Additionally, students graduating from these universities will be well- equipped with the specialized knowledge and skills required by SEZ units, increasing their chances of being recruited directly into these businesses. This synergy between world-class universities and SEZ industries will not only help in producing highly skilled professionals but will also foster significant growth in research and development, driving innovation and contributing to the overall development of the SEZ ecosystem.   1. लघु िीर्ाक, प्रयोग एिं प्रितान:- (1) इन जिजनयिों को जिश्वजिद्यालय अनुदान आयोग (भारत िें जिदेिी उच् चतर जिक्षा संस्ट्थानों के पररसरों की स्ट्थापना र संचालन) जिजनयि, 2023 कहा िाएगा।
    (2) ये जिजनयि स्नातक, स्नातकोत्तर, डॉक्टरेट र पोस्ट्ट डॉक्टरेट स्ट्तरों पर प्रिाण-पत्र, जडप्लोिा, जडग्री, अनुसंधान र अन्य कायाक्रिों के संचालन के जलए इन जिजनयिों के अंतगात अनुिोदन प्राप्त करने िाले जिदेिी उच् चतर जिक्षण संस्ट्थानों के पररसरों पर लागू होंगे। (3) ये जिजनयि आजधकाररक रािपत्र िें अपने प्रकािन की जतजथ से प्रितान िें आएंगे।

के जलए इन जिजनयिों के अंतगात अनुिोदन प्राप्त करने िाले जिदेिी उच् चतर जिक्षण संस्ट्थानों के पररसरों पर लागू होंगे। (3) ये जिजनयि आजधकाररक रािपत्र िें अपने प्रकािन की जतजथ से प्रितान िें आएंगे। 2. पररभार्ाएँ- (i) इन जिजनयिों िें, िब तक दक संदभा से अन्यथा अपेजक्षत न हो:- (क) "अजधजनयि" से जिश्वजिद्यालय अनुदान आयोग अजधजनयि, 1956 (1956 का 3) अजभप्रेत है; (ख) "पररसर" का अजभप्राय एक जिदेिी उच् चतर जिक्षण संस्ट्थान द्वारा भारत िें स्ट्थाजपत एक पररसर से है, िो इन जिजनयिों के अंतगात सम्यक अनुिोददत स्नातक, स्नातकोत्तर, डॉक्टरेट र पोस्ट्ट डॉक्टरेट स्ट्तरों पर प्रिाणपत्र, जडप्लोिा, जडग्री, अनुसंधान र अन्य कायाक्रिों को संचाजलत करता हो; (ग) "पाठ्यक्रि" का अजभप्राय उन इकाइयों िें से एक है जिसिें अध्ययन का एक कायाक्रि िाजिल है; (घ) "िुल्क" का अजभप्राय, पाठ्यक्रि या कायाक्रि के जलए नािांदकत छात्रों द्वारा देय सभी प्रकार के िुल्क से है, िैसे जिक्षण िुल्क र जिकास िुल्क इत्यादद, जिन्हे जिस भी नाि से बुलाया िाता है; (ड.) “जिदेिी उच् च िैक्षजणक संस्ट्थानों“ िें, दकसी जिदेिी देि िें जिश्वजिद्यालय या िैजक्षक संस्ट्थान दोनों िाजिल हैं, िो दकसी भी प्रदक्रया िें, िैसे दक रस्ट्ट या सोसायटी या कंपनी या सांजिजधक जनकाय या अपने िूल देि िें अन्य कोई कानूनी संस्ट्थान के रूप िें जिजधित िान्यता प्राप्त र स्ट्थाजपत या जनगजित है, र अपने अजधकार क्षेत्र के भीतर र बाहर, िैसा भी िािला हो, स्नातक या उच् चतर स्ट्तरों पर अकादजिक एिं अनुसंधान कायाक्रिों को प्रदान करने के जलए जिजधित रूप से
अजधकृत है;

त र स्ट्थाजपत या जनगजित है, र अपने अजधकार क्षेत्र के भीतर र बाहर, िैसा भी िािला हो, स्नातक या उच् चतर स्ट्तरों पर अकादजिक एिं अनुसंधान कायाक्रिों को प्रदान करने के जलए जिजधित रूप से
अजधकृत है; (च) "कायाक्रि" से अजभप्राय ऐसे अध्ययन से है जिससे इन जिजनयिों के अधीन अनुिोददत जिदेिी उच् चतर जिक्षा संस्ट्थान
के पररसर द्वारा प्रिाणपत्र या जडप्लोिा या जडग्री प्रदान की िाती है। (2) इन जिजनयिों िें प्रयुक्त र अपाररभाजर्त, बजल्क अजधजनयि िें पाररभाजर्त िब्दों र अजभव्यजक्तयों का अथा िही होगा िैसा की उन्हें क्रििः अजधजनयि िें पाररभाजर्त दकया गया है। 3. पात्रता- (1) भारत िें पररसर स्ट्थाजपत करने का इच्छुक जिदेिी उच् चतर जिक्षण संस्ट्थान को आिेदन के सिय पर जनम्नजलजखत िानदंडों िें से दकसी एक को पूरा करना होगा: (क) उसने आिेदन के सिय पर, आयोग द्वारा सिय-सिय पर जनधााररत िैजश्वक रैंककंग की सिग्र श्रेणी िें िीर्ास्ट्थ पांच सौ संस्ट्थाओं के भीतर स्ट्थान प्राप्त दकया हो, अथिा
(ख) उसने आिेदन के सिय पर िैजश्वक रैंककंग की जिर्यिार श्रेणी िें िीर्ा पांच सौ संस्ट्थाओं के भीतर स्ट्थान प्राप्त दकया हो अथिा आयोग द्वारा सिय-सिय पर यथा जनणीत दकसी जििेर् क्षेत्र िें उत्कृष्ट जििेर्ज्ञता प्राप्त की हो।
(2) भारत िें पररसर स्ट्थाजपत करने हेतु सहयोग करने के जलए इच्छुक दो या दो से अजधक जिदेिी उच् चतर जिक्षण संस्ट्थानों के िािले िें, प्रत्येक जिदेिी उच् चतर जिक्षण संस्ट्थान को पात्रता िानदंडों को पूरा करना होगा। 4.

ररसर स्ट्थाजपत करने हेतु सहयोग करने के जलए इच्छुक दो या दो से अजधक जिदेिी उच् चतर जिक्षण संस्ट्थानों के िािले िें, प्रत्येक जिदेिी उच् चतर जिक्षण संस्ट्थान को पात्रता िानदंडों को पूरा करना होगा। 4. अनुिोदन की प्रदक्रया- (1) यदद जिदेिी उच् चतर जिक्षण संस्ट्थान एक से अजधक पररसर स्ट्थाजपत करने का इच्छुक है, तो िह इन जिजनयिों िें जनधााररत प्रदक्रया के अंतगात आयोग को हर पररसर के जलए अलग आिेदन करेगा। (2) पात्रता िानदंडों को पूरा करने के उपरांत, जिदेिी उच् चतर जिक्षण संस्ट्थान आयोग द्वारा सिय-सिय पर यथा जनणीत अप्रजतदेय प्रोसेससंग िुल्क के साथ आयोग को ऑनलाइन आिेदन करेगा। (3) जिदेिी उच् चतर जिक्षण संस्ट्थान आिेदन के साथ जनम्नजलजखत दस्ट्तािेिों को जिश्वजिद्यालय अनुदान आयोग के पोटाल पर अपलोड करेगा, नाितः-
(क) भारत िें पररसर स्ट्थाजपत करने के जलए िासी जनकाय या बोडा, जिस भी नाि से उसे बुलाया िाता हो, से अनुिजत;

[भागIII—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ख) प्रस्ट्ताजित स्ट्थान, अिसंरचनात्िक सुजिधाओं, िुल्क संरचना, िैक्षजणक कायाक्रिों, पाठ्यक्रिों, पाठ्यचयाा, संकाय की उपलब्धता र भारत िें पररसरों की स्ट्थापना र संचालनों के जलए जित्तीय संसाधनों की उपलब्धता का जििरण, तथा कोई भी अन्य जििरण, जिसे िांगा िाए; (ग) इस संबंध िें आिय का एक उपक्रि पत्र देना होगा दक- (i) उसके द्वारा अपने भारतीय पररसर िें प्रदान की िाने िाली जिक्षा की गुणित्ता उसके िूल देि के िुख्य पररसर िें प्रदान की िा रही जिक्षा के सिान है;

) इस संबंध िें आिय का एक उपक्रि पत्र देना होगा दक- (i) उसके द्वारा अपने भारतीय पररसर िें प्रदान की िाने िाली जिक्षा की गुणित्ता उसके िूल देि के िुख्य पररसर िें प्रदान की िा रही जिक्षा के सिान है; र (ii) भारतीय पररसर िें जिद्यार्थायों को प्रदान की गई उपाजधयों की िान्यता र दिाा िही होगा, िानो की उन्हें उसके गृह क्षेत्राजधकार िें संचाजलत दकया गया हो, अथाात उन्हें जिदेिी उच् चतर जिक्षण संस्ट्थान के िूल देि िें िान्यता प्राप्त होगी र िे िूल देि िें जस्ट्थत िुख्य पररसर िें जिदेिी उच् चतर जिक्षण संस्ट्थान द्वारा प्रदत्त तदनुरूपी उपाजधयों के सितुल्य होंगी। (घ) दकसी िान्यतप्राप्त जनकाय से निीनति प्रत्यायन या गुणित्ता आश्वासन ररपोटा; र
(ङ) आिेदन पोटाल िें जनर्दाष्ट कोई अन्य दस्ट्तािेि। (4) आयोग भारत िें जिदेिी उच् चतर जिक्षण संस्ट्थानों के पररसरों की स्ट्थापना र संचालन से संबंजधत िािलों की िांच करने के जलए एक स्ट्थायी सजिजत का गठन करेगा। (5) स्ट्थायी सजिजत िैजक्षक संस्ट्थानों की जिश्वसनीयता, प्रदान दकए िाने िाले कायाक्रिों, भारत िें िैजक्षक अिसरों को ििबूती प्रदान करने की उनकी क्षिता, र प्रस्ट्ताजित िैक्षजणक बुजनयादी ढांचे सजहत योग्यता के आधार पर प्रत्येक आिेदन का जनधाारण करेगी र उस संबंध िें जसफाररिें देगी। (6) यदद आिेदक दकसी जििेर् क्षेत्र िें उत्कृष्ट जििेर्ज्ञता प्राप्त कोई जिदेिी उच् चतर जिक्षण संस्ट्थान है, तो स्ट्थायी सजिजत उसकी िजक्त, उत्कृष्ट योगदान, अनुसंधान क्षिताओं, संस्ट्थागत इजतहास, संस्ट्थागत प्रजतष्ठा एिं प्रभाि, र क्षेत्रों के भीतर अन्य के िध्य व्यािसाजयक िान्यता पर जिचार करेगी। (7) स्ट्थायी सजिजत की जसफाररिें सभी प्रकार से पूणा आिेदन प्राप्त होने की तारीख से साठ ददनों की अिजध के भीतर आयोग के सिक्ष प्रस्ट्तुत की िाएंगी|

तर अन्य के िध्य व्यािसाजयक िान्यता पर जिचार करेगी। (7) स्ट्थायी सजिजत की जसफाररिें सभी प्रकार से पूणा आिेदन प्राप्त होने की तारीख से साठ ददनों की अिजध के भीतर आयोग के सिक्ष प्रस्ट्तुत की िाएंगी|
(8) स्ट्थायी सजिजत की जसफाररिों के आधार पर, आयोग प्रारंभ िें, साठ ददनों की अिजध के भीतर सैद्ांजतक अनुिोदन प्रदान कर सकता है र अनुिोदन की तारीख से दो िर्ों के भीतर भारत िें पररसर स्ट्थाजपत करने के जलए जिदेिी उच् चतर जिक्षण संस्ट्थान को एक आिय पत्र िारी कर सकता है। (9) आयोग के पास िािला-दर-िािला आधार पर उसे जिस्ट्ताररत, यदद आिश्यक हो, करने का अजधकार आरजक्षत है। (10) आिेदक जिदेिी उच् चतर जिक्षण संस्ट्थान आयोग को अपने िैक्षजणक संचालन िुरु करने के जलए तत्परता से अिगत कराएगा र स्ट्थायी सजिजत पररसर की तत्परता की िांच करेगी र अपनी जसफाररिें देगी। (11) आयोग स्ट्थायी सजिजत की जसफाररिों पर जिचार करेगी र भारत िें दकसी पररसर का संचालन ितों के साथ या जबना ितों के साथ िुरु करने के जलए 60 ददनों की अिजध के भीतर जिदेिी उच् चतर जिक्षण संस्ट्थान को िंिूरी प्रदान
करेगी ।

ी जसफाररिों पर जिचार करेगी र भारत िें दकसी पररसर का संचालन ितों के साथ या जबना ितों के साथ िुरु करने के जलए 60 ददनों की अिजध के भीतर जिदेिी उच् चतर जिक्षण संस्ट्थान को िंिूरी प्रदान
करेगी ।
5. प्रिेि एिं िुल्क संरचनाः (1) जिदेिी उच् चतर जिक्षण संस्ट्थानों का पररसर घरेलू र अंतरााष्ट्रीय छात्रों को प्रिेि देने के जलए अपनी प्रिेि प्रदक्रया र िानदंड जिकजसत कर सकता है। (2)जिदेिी उच् चतर जिक्षण संस्ट्थान िुल्क संरचना तय करेगा, िो पारदिी र उजचत होगी । (3)जिदेिी उच् चतर जिक्षण संस्ट्थान प्रिेि िुरु होने से कि से कि साठ ददन पहले जिजभन्न कायाक्रिों की िुल्क संरचना, प्रजतदेय नीजत, दकसी कायाक्रि िें सीटों की संख्या, पात्रता योग्यताएं, र प्रिेि प्रदक्रया सजहत अपनी िेबसाइट पर पाठ्य- जििरजणका उपलब्ध कराएगा। (4) िूल्यांकन प्रदक्रया के आधार पर, जिदेिी उच् चतर जिक्षण संस्ट्थान अक्षयजनजध पूिा छात्रों द्वारा ददए गये दान, ट्यूिन रािस्ट्ि र अन्य स्रोतों िैसी जनजधयों से पूणा या आंजिक योग्यता आधाररत या आिश्यकता आधाररत छात्रिृजत्त प्रदान कर सकेगा।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (5)जिदेिी उच् चतर जिक्षण संस्ट्थान उन छात्रों को ट्यूिन फीस िें छूट दे सकता है, िो भारतीय नागररक हैं। 6. संकाय र किाचाररयों की जनयुजक्त र अन्य संबंजधत प्रािधान: – (1) जिदेिी उच् चतर जिक्षण संस्ट्थान को भारत र जिदेिों िें अपने भती िानदंडों के अनुसार संकाय र किाचाररयों की भती करने की स्ट्िायत्तता होगी।
(2) जिदेिी उच् चतर जिक्षण संस्ट्थान संकाय र किाचाररयों की जनयुजक्त के जलए योग्यता, िेतन संरचना, र सेिा की अन्य ितों का जनणाय कर सकता है। तथाजप, जिदेिी उच् चतर जिक्षण संस्ट्थान यह सुजनजित करेगा दक जनयुक्त दकए गए संकाय की योग्यता उसके िूल देि के िुख्य पररसर िें जनयुक्त संकाय के सिकक्ष होगी।

ख्यान, िो कायाक्रि की आिश्यकताओं के दस प्रजतित से अजधक न हों, की अनुिजत दी िा सकती है। (4) जिदेिी उच् चतर जिक्षण संस्ट्थान कोई भी नया कायाक्रि िुरु करने से पहले जिश्वजिद्यालय अनुदान आयोग पोटाल के िाध्यि से आयोग का पूिा अनुिोदन प्राप्त करेगा। (5) इन जिजनयिों के अंतगात भारत िें जिदेिी उच् चतर जिक्षण संस्ट्थान के पररसर िें दी िाने िाली उपाजधयाँ उसके िूल देि िें जिदेिी उच् चतर जिक्षण संस्ट्थान के नाि र िोहर के तहत प्रदान की िाएंगी। (6) भारतीय पररसर िें छात्रों को प्रदान की गयी उपाजधयों की िान्यता र दिाा िही होगा, िैसे दक उन्हें जिदेिी उच् चतर जिक्षण संस्ट्थान के अपने गृह अजधकार क्षेत्र िें संचाजलत दकया गया हो, अथाात, उन्हें जिदेिी उच् चतर जिक्षण संस्ट्थान के िूल देि िें िान्यता दी िाएगी र िूल देि िें जस्ट्थत िुख्य पररसर िें जिदेिी उच् चतर जिक्षण संस्ट्थान द्वारा प्रदान की गई तदनुरूपी उपाजधयों के बराबर होगी। (7) इन जिजनयिों के अंतगात प्रदान की गई उपाजधयाँ भारतीय उच् चतर जिक्षण संस्ट्थान द्वारा उच् चतर जिक्षा र रोिगार सजहत सभी प्रयोिनों के जलए जनम्नजलजखत जनदेिों के साथ प्रदान की गई दकसी भी संगत जडग्री के बराबर होंगी, अथाात्: - (क) दकसी भी प्राजधकरण से सितुल्यता प्राप्त करने की कोई र आिश्यकता नहीं होगी;

रोिगार सजहत सभी प्रयोिनों के जलए जनम्नजलजखत जनदेिों के साथ प्रदान की गई दकसी भी संगत जडग्री के बराबर होंगी, अथाात्: - (क) दकसी भी प्राजधकरण से सितुल्यता प्राप्त करने की कोई र आिश्यकता नहीं होगी; र (ख) जडग्री के िे सभी लाभ, अजधकार र जििेर्ाजधकार होंगे िो आितौर पर भारतीय उच् च जिक्षा संस्ट्थान द्वारा प्रदान की िाने िाली जडग्री के िािले िें प्राप्त होते हैं। (8) जिदेिी उच् चतर जिक्षण संस्ट्थान भारत िें अपने पररसर की स्ट्थापना र संचालन के जलए आिश्यक जित्तीय र अन्य संसाधनों की उपयुक्तता प्रस्ट्तुत करेगा। (9) जिदेिी उच् चतर जिक्षण संस्ट्थान के पास भारत िें अपने पररसर िें िैक्षजणक र अनुसंधान कायाक्रिों को संचाजलत करने के जलए आिश्यक भौजतक, िैक्षजणक र अनुसंधान बुजनयादी ढांचा र सुजिधाएं होना िरूरी है । (10) जिदेिी उच् चतर जिक्षण संस्ट्थान अध्ययन के ऐसे दकसी भी कायाक्रि को प्रदान नहीं करेगा िो भारत िें उच् चतर जिक्षा के िानकों के जिपरीत हो। (11) जिदेिी उच् चतर जिक्षण संस्ट्थान का संचालन भारत की संप्रभुता र अखंडता, राष्ट्र की सुरक्षा, जिदेिी राष्ट्रों के साथ िैत्रीपूणा संबंधों, सािािजनक व्यिस्ट्था, कानून व्यिस्ट्था, जिष्टाचार या नैजतकता के जिपरीत नहीं होगा।

9. छात्रों के जहतों की रक्षा- (1) जिदेिी उच् चतर जिक्षण संस्ट्थान आयोग के पूिा अनुिोदन के जबना दकसी भी पाठ्यक्रि या कायाक्रि एिं पररसर को बंद नहीं करेगा। (2) कोई पाठ्यक्रि या कायाक्रि िें व्यिधान या पररसर को आगे नहीं चलाने या उसे बंद करने के िािले िें, िूल इकाई प्रभाजित छात्रों को पाठ्यक्रि या कायाक्रि के पुन: आिंटन सजहत जिकल्प उपलब्ध करने के जलए जिम्िेदार होगी। (3) जिदेिी उच् चतर जिक्षण संस्ट्थान िें छात्रों की जिकायतों को दूर करने के जलए एक तंत्र होगा। यदद जिदेिी उच् चतर जिक्षण संस्ट्थान जिकायतों का जनिारण करने िें जिफल रहता है, तो छात्र अपनी जिकायतों के जनिारण के जलए आयोग से अपील कर सकते हैं। (10) जनरीक्षण का अजधकार- आयोग को पररसर का दौरा करने र बुजनयादी ढांचे, िैक्षजणक कायाक्रिों एिं सिग्र गुणित्ता र उपयुक्तता का पता लगाने के जलए उसके संचालन की िांच करने की िजक्त होगी। (11) भारत िें जिदेिी उच् चतर जिक्षण संस्ट्थान के पररसरों की स्ट्थापना एिं संचालन पर जनर्ेध - (1) कोई भी जिदेिी उच् चतर जिक्षण संस्ट्थान आयोग के पूिा अनुिोदन के जबना भारत िें कोई भी पररसर स्ट्थाजपत र संचाजलत नहीं कर सकता। (2) कोई भी जिदेिी उच् चतर जिक्षण संस्ट्थान भारत िें दकसी भी कायाक्रि को आयोग के पूिा अनुिोदन के जबना प्रदान नहीं करेगा। (3) आयोग जनम्नजलजखत िें से दकसी भी जस्ट्थजत िें दकसी भी सिय पर कारण दिा करने के बाद जिदेिी उच् चतर जिक्षण संस्ट्थानों को िारी दकए गए अनुिोदन को रद्द या जनलंजबत या िापस ले लेगा या ऐसी अन्य कारािाई करेगा िो िह उजचत सिझे, अथाात:

The University Grants Commission notified the guidelines on Internationalization of Higher Education in the year 2021, which included provisions like setting up an office for International Affairs and Alumni Connect Cell in the universities; Whereas, to foster academic collaboration between Indian higher educational institutions and foreign higher educational institutions, the University Grants Commission (Academic Collaboration between Indian and Foreign Higher Educational Institutions to offer Twinning, Joint Degree and Dual Degree Programmes) Regulations, 2022 were notified on 2ndMay, 2022; Whereas, a regulatory framework allowing the entry of higher-ranked foreign universities, for the internationalization of Indian higher education as envisaged in National Education Policy, 2020 will provide an international dimension to higher education, enable Indian students to obtain foreign qualifications at affordable cost, and make India an attractive global study destination. And whereas there is a need to facilitate the entry of foreign higher educational institutions into India. Now, therefore, in exercise of the powers conferred by clause (j) of section 12 read with clauses (f) and (g) of sub-section (1) of section 26 of the University Grants Commission Act, 1956 (3 of 1956), the University Grants Commission hereby makes the following regulations, namely:- 1.

Eligibility.- (1) The Foreign Higher Educational Institution intending to establish campuses in India shall fulfil any of the following criteria at the time of application, that- (a) it should have secured a position within the top five hundred in the overall category of global rankings at the time of application, as decided by the Commission from time to time; or (b) it should have secured a position within the top five hundred in the subject-wise category of global rankings at the time of application or should possess outstanding expertise in a particular area, as decided by the Commission from time to time. (2) In the case of two or more than two Foreign Higher Educational Institutions intending to collaborate to establish campuses in India, each Foreign Higher Educational Institution should meet the eligibility criteria. 4. Procedure for approval.-(1) In case the Foreign Higher Educational Institution intends to set up more than one campus, it shall make a separate application to the Commission under the procedure laid down in these regulations. (2) Upon fulfilment of the eligibility criteria, the Foreign Higher Educational Institution shall apply online to the Commission along with the non-refundable processing fee, as decided by the Commission from time to time.

(3) The Foreign Higher Educational Institution shall upload the following documents along with the application on the University Grants Commission portal, namely:- (a) permission by the Governing Body or Board, by whatever name called, for establishing campuses in India; (b) information on the proposed location, infrastructural facilities, fee structure, academic programmes, courses, curricula, availability of faculty and financial resources for setting up and operations of campuses in India, and any other details that may be sought; (c) an undertaking to the effect that- i. the quality of education imparted by it in its Indian campus is similar to that of the main campus in the country of origin; and ii. the qualifications awarded to the students in the Indian campus shall enjoy the same recognition and status as if they were conducted in its home jurisdiction, that is, they shall be recognized in the country of origin of the Foreign Higher Educational Institution and shall be equivalent to the corresponding qualifications awarded by the Foreign Higher Educational Institution in the main campus located in the country of origin. (d) the latest Accreditation or Quality Assurance report from a recognized Body; and (e) any other document as specified in the application portal.

(4) The Commission shall constitute a Standing Committee to examine matters related to the setting up and operation of campuses of Foreign Higher Educational Institutions in India. (5) The Standing Committee shall assess each application on merit, including the credibility of the educational institutions, the programmes to be offered, their potential to strengthen educational opportunities in India, and the proposed academic infrastructure, and make recommendations thereof. (6) In case the applicant is a Foreign Higher Educational Institution possessing outstanding expertise in a particular area, the Standing Committee shall consider its strengths, outstanding contribution, research

(7) The recommendations of the Standing Committee shall be placed before the Commission within a period of sixty days from the date of receipt of the application, complete in all respects. (8) Based on the recommendations of the Standing Committee, the Commission may within a period of sixty days, initially grant in-principle approval and issue a Letter of Intent to the Foreign Higher Educational Institution to set up campuses in India within two years from the date of approval.

Admission and fee structure.-(1) The campus of Foreign Higher Educational Institution may evolve its admission process and criteria to admit domestic and international students. (2) The Foreign Higher Educational Institution shall decide the fee structure, which shall be transparent and reasonable. (3) The Foreign Higher Educational Institution shall make available the prospectus on its website at least sixty days before the commencement of admissions, including fee structure, refund policy, number of seats in a programme, eligibility qualifications, and admission process.

Appointment of faculty and staff and other related provisions.-(1) The Foreign Higher Educational Institution shall have the autonomy to recruit faculty and staff from India and abroad as per its recruitment norms. (2) The Foreign Higher Educational Institution may decide the qualifications, salary structure, and other conditions of service for appointing faculty and staff. However, the Foreign Higher Educational Institution shall ensure that the qualifications of the faculty appointed shall be at par with the main campus in the country of origin. (3) The Foreign Higher Educational Institution shall ensure that the international faculty appointed to teach at the Indian campus shall stay in India for at least a semester. 7. General conditions.-(1) The Foreign Higher Educational Institution shall not admit students and collect fees unless duly approved under these regulations to set up its campus in India.

(7) The qualifications awarded under these regulations shall be equivalent to any corresponding degree awarded by the Indian Higher Educational Institution for all purposes, including higher education and employment, with the following stipulations, namely:- (a) there shall be no further requirement of seeking equivalence from any authority; and (b) the degree shall have all benefits, rights, and privileges as obtained in the case of a degree awarded by an Indian Higher Educational Institution ordinarily. (8) The Foreign Higher Educational Institution shall present their adequacy of financial and other resources required for establishing and operating its campus in India. (9) The Foreign Higher Educational Institution shall have the physical, academic and research infrastructure and facilities required to conduct its academic and research programmes in its campus in India. (10) The Foreign Higher Educational Institution shall not offer any such programme of study which is contrary to the standards of higher education in India. (11) The operation of Foreign Higher Educational Institution shall not be contrary to the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency, or morality.

(14) In case a Foreign Higher Educational Institution desires to receive or utilize donations from any foreign sources, it has to obtain prior permission of the Central Government and shall comply with the provisions of Foreign Contribution (Regulation) Act, 2010 (42 of 2010). (15) The Foreign Higher Educational Institution shall abide by any other conditions specified by the Commission and the Government of India from time to time. (16) The Foreign Higher Educational Institution shall not act as a representative office of the parent entity to undertake promotional activities for their programmes in their home jurisdiction or any other jurisdiction outside India. (17) The Foreign Higher Educational Institution may enter into a joint venture with Indian higher educational institutions or Indian company.

admitted and passed out, and qualifications awarded. (2) The annual report shall be made available on the website of the Foreign Higher Educational Institution or its campus. (3) The Foreign Higher Educational Institution shall submit an audit report annually to the Commission certifying that the operations of the Foreign Higher Educational Institution in India are in compliance with the Foreign Exchange Management Act, 1999 (42 of 1999) or the Foreign Contribution (Regulation) Act, 2010 (42 of 2010) and the rules and regulations made there under or any other applicable Act or laws or rules or regulations or guidelines and relevant State laws or rules or regulations or policies in this regard. 9.

(2) In the case of a course or programme disruption or discontinuation or closure of the campus, the parent entity shall be responsible for providing an alternative to the affected students,including reallocation to the course or programme.

In case, the Foreign Higher Educational Institution fails to redress the grievances, the students may appeal to the commission for redressal of their grievances. 10. Power to visit.-The Commission shall have the power to visit the campus and examine its operations to ascertain the infrastructure, academic programmes and overall quality and suitability. 11. Prohibition on setting up and operation of campuses of Foreign Higher Educational Institutions in India.-(1) No Foreign Higher Educational Institution shall set up and operate any campus in India without the prior approval of the Commission. (2) No Foreign Higher Educational Institution shall offer any programme in India without the prior approval of the Commission.

Jurisdiction of Courts.- In case of any dispute with respect to these regulations, courts in India shall have exclusive jurisdiction. 13. Interpretation.-(1) If any question arises regarding the provisions of these regulations the Commission shall decide that question. (2) The Commission shall have the power to clarify any doubt, difficulty, or anomaly about implementing these regulations.
