PUBLIC NOTICE NO. 41/2017-18

Subject: List of “Out of Scope” items as received from FSSAI- reg.

Attention of the Importers, Exporters, General Trade and all other stakeholders is invited to the issue as above.

2. Representations from importers, Custom Brokers have been received regarding number of bills of entry being referred to FSSAI, which are already being certified as “out of scope” by FSSAI. As per the present practice, in such cases, importers/ Customs Brokers are required to approach FSSAI office to obtain “out of scope“ endorsement /certificates for such items, which results in considerable delay beside costs.

3. To sort out the issue, list of such “out of scope” items has been obtained from FSSAI officers and is now being circulated to trade through this Public Notice. It is also decided that in such cases, where goods imported are “out of scope” items, then, it would not be mandatory to obtain “out of scope“ endorsement / certificate from FSSAI, even if such bills of entry are routed to FSSAI / or status of bill of entry shows “FSSAI pending”. It is decided that in such cases, out of Charge (OOC) officer shall not insist for FSSAI “out of scope” endorsement and shall give OOC, subject to other regulatory compliance. 4. In this regard, the list of HS CODE of Non Food Items for which “out of scope” certification received from FSSAI [Authorized Officer] is enclosed as Annexure-I.

If the goods as described in the list enclosed (description and CTH) are imported but status of bill of entry shows “FSSAI pending”, there is no need to obtain “out of scope“ endorsement/ certificate from FSSAI. OOC in such cases may be given subject to other regulatory compliance.
