Sub:- Sensitization of Officers and officials on Compliance with the Rights of Persons with Disabilities Act, 2016 (RPwD Act, 2016)

In compliance with D.O. Letter No. CC-12016/1/2023-CCPD dated 13.01.2025, received from the Ministry of Social Justice & Empowerment, Department of Empowerment of Persons with Disabilities (Divyangjan), all officers and officials of SEEPZ-SEZ, Mumbai are hereby sensitized regarding their responsibilities under the Rights of Persons with Disabilities Act, 2016 (RPwD Act, 2016). The RPwD Act, 2016, enacted to give effect to the United Nations Convention on the Rights of Persons with Disabilitics, which ensures that persons with disabilities are provided equal opportunities, accessibility, and non-discriminatory treatment in education, employment, public services, and all other aspects of life. Compliance with this Act is a legal obligation, and all government establishments must adhere to its provisions. As per the Act, the Chief Commissioner for Persons with Disabilities (CCPD) is the designated authority responsible for monitoring the implementation of its provisions and handling complaints related to violations of the rights of persons with disabilities. Under Section 76, it is mandatory for all government establishments to take necessary action on any recommendations made by the CCPD within three months and inform the Chief Commissioner accordingly, If any recommendation is not accepted, the reasons for such non-acceptance must be conveyed in writing to the CCPD and the aggrieved person. Any failure to furnish information sought by the CCPD constitutes a violation under Section 93 of the Act, which is a punishable offence. Additionally, under Section 75, all concerns raised by persons with disabilities must be addressed promptly, and necessary measures must be taken to prevent any form of discrimination or exclusion.

All officers and officials of SEEPZ-SEZ, Mumbai are directed to ensure compliance with all provisions of the RPwD Act, 2016. It is imperative that any communications received from the CCPD, State Commissioners for Persons with Disabilities, or any other statutory authority are responded to promptly. Officers must review and implement necessary accessibility measures within SEEPZ-SEZ premises. Strict adherence to the three-month response timeline for recommendations under Section 76 is required.

A compliance review will be conducted to assess adherence to the RPwD Act, 2016. Officers responsible for handling disability-related matter must submit compliance reports periodically to ensure transparency and accountability.
