Agenda Item No. 04 :   Ratification of decision taken by
Development Commissioner, SEEPZ-SEZ regarding grant
of permission to M/s LTI Mindtree Ltd., Mahape Unit.

यह मु_ा 28.04.2022 को आयो/जत बैठक म यूएसी के सम रखा गया
था। यूएसी ने वापस न िकए गए कंयूटर/आईटी उपकरण? के मु_े पर
िवचार-िवमश िकया और िनIनानुसार िनणय "लया: -
“सिम2त ने पाया िक पुराने Vयु	 आईटी उपकरण? का आयात
V2तबं2धत है। आयात केवल डीजीएफटी ारा जारी आयात
Vा2धकरण/आयात Vा2धकरण/ आयात लाइसस के आधार पर ही
=वीकाय है और आरसीआर म िनधाDरत शतa और एमओईएफ एवं
सीसी से अनुम2त/एनओसी के अनुपालन के अधीन है। इस"लए, ऐसे
मामले Vथम c*या िवदेश dयापार नी2त के िव(भe Vावधान?, पयावरण
(संरण) अ2धिनयम, 1992 के अंतगत खतरनाक और अQय अप(श*
Vबंधन और सीमापार संचलन िनयम 2016 के साथ एसईजेड िनयम
2006 के िनयम 54(2) का उfंघन हg। सिम2त का िवचार था िक ऐसे
मामल? को िवकास आयु	 ारा केस-दर-केस आधार पर V]येक मामले
के तhय और पDर<=थ2तय? को यान म रखते हुए िनपटाया जा सकता
है, चाहे वह वा=तिवक हो या अQयथा। िवकास आयु	 के िनणय को
अनुमोदन सिम2त के सम अनुमोदन के "लए V=तुत करना होगा।”
 
This issue was put up before the UAC in the meeting held
on 28.04.2022.

अनुमोदन सिम2त के सम अनुमोदन के "लए V=तुत करना होगा।”
 
This issue was put up before the UAC in the meeting held
on 28.04.2022. The UAC deliberated on the issue of
unreturned computer/ IT equipment and decided as under:
-
“Committee observed that the import of old used IT
equipment is restricted for import. Import is permissible
only against and import authorization / import of
authorization/import licences issued by DGFT and subject
to compliance of the conditions laid down in RCR and
permission / NOC from MOEF & CC. Hence, such cases
are prima-facie Violation of various provisions of the
foreign Trade Policy, the Hazardous and other wastes
Management and Transboundary Movement Rules 2016
issue under the Environment (Protection) Act, 1992 read
with Rule 54(2) of SEZ Rule 2006. Committee held the
view that such cases may be dealt with by Development
Commissioner n case-to-case basis keeping in view the
fact and circumstances of each case whether the same is
Bonafide or otherwise.

िनणय:- िवचार-िवमश के बाद, सिम2त ने िवकास आयु	 ारा मेसस
एलटीआई माइंडट!ी "लिमटेड, महापे यूिनट को लैपटॉप सिहत सहायक
उपकरण (उनके कमचारी को जारी) के खो जाने क 2त(थ से भुगतान
क 2त(थ तक लागू शुFक के साथ Wयाज के भुगतान क अनुम2त देने के
संबंध म "लए गए िनणय क पुि* क।
 
Decision: - After deliberation, the Committee ratified the
decision taken by the Development Commissioner
regarding the grant of permission to M/s LTI Mindtree
Ltd., Mahape Unit, for payment of the applicable duty
along with interest, calculated from the date of loss of the
laptop with accessories (issued to their employee) until the
date of payment.
