C. There is No Revision in Projections:

The unit has stated that the approved projections relating to exports, investment, Net Foreign Exchange (NFE) and employment were originally prepared on a conservative, realistic and sustainable basis, keeping in view operational prudence and long-term viability. The unit has further submitted that the proposed additional area is primarily required to meet operational exigencies and to strengthen infrastructure capabilities, particularly in view of prevailing global trade disruptions. The proposal is intended to enhance container-handling capacity, improve storage availability, streamline infrastructure, reduce dwell time and facilitate timely fulfilment of client commitments.

The unit has also stated that the proposed expansion would improve operational efficiency and help it achieve, and potentially exceed, the approved projections. It has further informed that an adequate projection balance is available as per the revised approval granted in November, 2022.

The unit has stated that —

They are approved Unit vide Letter of Approval F. No. SEEPZ/NEWSEZ/JNPT-SEZ/ARL/37/2022-23/21035 dated 09.12.2022 and amended vide letter dated 12.10.2023, for carrying out the authorised activities, i.e., trading of various active pharmaceutical ingredients at Warehouse No. 2, NSBP FTWZ Co-developer, located at JNPT SEZ, Village Sawarkhar, Taluka Uran, District Raigad, Maharashtra.

The unit has stated that due to regulatory requirements mandating the use of newly notified HSN codes,

several customers who are otherwise fully prepared for onboarding are facing delays, and their import consignments are already in the pipeline; however, non-updation of the revised HSN codesin its existing Letter of Approval (LOA) has created a procedural bottleneck.

The unit has further stated that as a consequence, they are currently unable to file Bills of Entry (BoE) on ICEGATE and proceed with the associated customs clearance processes, thereby directly affecting supply chain timelines and compliance adherence. Timely updation of the LOA with the new HSN codes is therefore essential to avoid disruptions, demurrage, and operational escalation.

The unit has further stated that they have sufficient projected balance to meet the investment cost requirements relating to exports, investments, and employment in connection with the proposed expansion of space.
