The Committee had deferred the proposal of M/s. AGENDA NOTE FOR CONSIDERATION OF APPROVAL COMMITTEE

a. Proposal : Quarterly Performance Reports of Roma Builders Pvt. Ltd., (Developer) for the period January 2025 to March 2025 and Half yearly performance for the period October 2024 to March 2025. b. Specific Issue on which decision of AC is required: - Quarterly Performance Report for the period January 2025 to March 2025 and Half-yearly performance for the period October 2024 to March 2025. c. Relevant provisions of SEZ Act, 2005 & Rules, 2006/Instruction/ Notification :- In terms of Rule 12(6), of SEZ Rules 2006 - “The Developer shall maintain a proper account of the import or procurement, consumption and utilization of goods and submit quarterly and half-yearly returns to the Development Commissioner in Form E for placing the same before the Approval Committee”. In terms of Rule 22(4), of SEZ Rules 2006 - “The Developer shall submit Quarterly Report on import and procurement of goods from the Domestic Tariff Area, utilization of the same and the stock in hand, in Form E to the Development Commissioner and the Specified Officer and Development Commissioner shall place the same before the Approval Committee. d. Other Information: - Roma Builders Pvt. Ltd. (Developer), has been granted Formal Approval No. F.1/8/2019-SEZ Dated 16.01.2020 for IT/ITES at Hiranandani Estate, Off. Ghodbundar Road, Village Kevesar, Thane 400607. The QPR & HPR were forwarded to Specified Officer for verification. The Specified Officer vide letter dated 21.05.2024 has stated that the QPR from “January 2025 to March 2025” & HPR from “October 2024 to March 2025”submitted by the Developer has been verified based on the records maintained in Customs office and from NSDL system. NO discrepancy has been found in report submitted by the developer vis-à-vis the records maintained at their office. The detailed report in respect of Roma Builders Pvt. Ltd. (Developer) of the Quarterly Performance Report for the period January 2025 to March 2025 and Half yearly performance for the period October 2024 to March 2025 is as under:

Closing Balance 66,28,16,418.00 66,28,16,418.00 Specified Officer further stated that, as per the above details it is found that there is Eight Lakh Two Thousand Seven Hundred Thirteen (8,02,713/-) Duty Forgone in this said period i.e., January 2025 to March 2025 and Eighteen Lakh Two Thousand Three Eighty (18,02,380/-) Duty Forgone in this said period i.e., October 2024 to March 2025. Further, the Developer has submitted the GSTR 2A for the period of January 2025 to March 2025" and HPR for the period of "October 2024 to March 2025". The details of GSTR 2A have been scrutinized vis-à-vis the data maintained with NSDL online system. It has been observed that, for Annexure B (Services), where the invoice date and endorsement date fall within the same period, figures are matching with the data reflected in GSTR 2A whereas, where endorsement date and invoice dates doesn't fall within the same period, figures are not matching with the data reflected in GSTR 2A The Developer has further informed that as the date of filing of GSTR 1 and also date of payment of duty by the supplier falls in the next month of the supply month, there is always a possibility of mismatch. So, it is not possible to reconcile the data in GSTR 2A and that in SEZ online system for a particular QPR and HPR period on a real time basis. Bond value has been checked and the duty foregone has not exceeded the bond value. Copy of Specified Officer’s letters dated 21.05.2025 is enclosed. e. Recommendation: No Discrepancy has been found by the Specified Officer with respect to QPR for the period January 2025 to March 2025 and Half yearly performance for the period October 2024 to March 2025 of Roma Builders Pvt. Ltd., (Developer). Hence, monitoring performance of the Developer for said period is submitted before Approval Committee for consideration.
