After brief introduction, each items included in the agenda were taken up for deliberation one by one. After detailed deliberations amongst the members of the Approval Committee as well as interaction with the applicants / representatives of the developers / units, the following decisions were taken:-

2.2. It was informed that the developer has proposed various types of ‘Signage’ at SI. No. 592 to 630' under the authorized operation namely “Construction of all types of building in Processing area as approved by UAC’ (Annexure-Il), whereas a separate authorized operation namely “Roads with Street lighting, Signals and Signage’ is available in the list of default authorized operations issued by DOC vide Instruction No. 50 dated 15.03.2010.

2.3. Mr. D.K. Sharma, Associate Director, Mr. Jyotirmay Mishra, Head- India Litigation & Mr. Shankey Agrawal, Pri. Associate of M/s. HCL Technologies Ltd. appeared before the Approval Committee and explained the requirement of proposed materials. 2.4. After due deliberations, Approval Committee approved the proposed list of materials, subject to submission of revised Chartered Engineer's Certificate and list of materials indicating ‘Signage’ under authorized operation ‘Roads with Street lighting, Signals and Signage’.

3.1. It was informed to the Approval Committee that M/s. HCL Technologies Ltd. (Unit-l) had submitted representation on coverage of ‘Group Health and Medical Insurance’ of its employees, under the authorised operations of its unit located in the IT/ITES SEZ of M/s. HCL Technologies Ltd. at Plot No. 3A, 3B & 2C, Sector-126, Noida (U.P), as well as coverage under the default service namely ‘General Insurance Business Services’. It was informed that “Group Health and Medical Insurance” is not part of default list of services and unit had sought clarification on its coverage under “General Insurance Business Services” which is available at SI. No. 26 of uniform list of services issued by DOC vide Instruction No. 79 dated 19.11.2013. It has been submitted by the unit that none of the ‘Group Health and Medical Insurance’ received by them are in nature of life insurance services. It was further informed that the unit had referred Rule 27(2) of SEZ Rules, 2006, which provides that ‘in case of any doubt as to whether any goods or services are required by a Unit or Developer for authorized operations or not, it shall be decided by the Development Commissioner.” Further, in terms of Proviso to Rule 27(3) of SEZ Rules, 2006, “Provided further that any goods for the personal use of, or consumption by officials, workman, staff, owners or any other person in relation to a Unit or Developer, shall not be eligible for exemption, drawback and concessions or any other benefit in accordance with the provisions of Section 7 or 26.”

3.3. {t was informed that the unit has requested to (i) whether the ‘Group Health and Medical Insurance’ received by the unit, are covered within the default authorised services issued by DOC under the title “General Insurance Business Services” for the purpose of SEZ Act, and (ii) whether they are entitled to SEZ law benefits thereon.

3.4. Mr. D.K. Sharma, Associate Director, Mr. Jyotirmay Mishra, Head- !ndia Litigation & Mr. Shankey Agrawal, Pri. Associate of M/s. HCL Technologies Ltd. appeared before the Approval Committee. The representatives of the unit informed that in general, a group or corporaie health insurance policy is purchased by an employer for employees of company. By insuring the health and medical needs of the employees, the company inter alia ensure productivity in their operations by keeping their employees healthy. This is besides the other legal and morai obligations on their part as employer. Accordingly, they have requested to consider “Group Health and Medical Insurance (which are not in the nature of life insurance services)” as part of authorised operation only.

3.5. The Approval Committee observed that exemption available to the SEZ Units is only on the input services related to authorised operations of the unit. The Group Insurance of employees is related to individuals and not related to authorised operations of the SEZ unit. The actual beneficiary of said service is an individual. The Committee also observed that Income earned by an unit on account of export is exempted from payment of Income Tax, whereas individual employees are not given the benefit of Income Tax exemption.

3.6. After due deliberations, the Approval Committee clarified that the ‘Group Health and Medical Insurance’ of its employees is not related to the authorised operations of the SEZ unit, hence not covered under default authorised services namely “General Insurance Business Services”. 5.4. It was brought to the notice of the Approval Committee that M/s. Seaview Developers Private Ltd., Developer had submitted proposal for allotment of built-up space of 756 Sqft. (70.23 Sqmt) at Ground floor, Amenity Block-II in the processing area of ITNTES SEZ at Plot No. 20 & 21, Sector-135, Noida (U.P.) on lease basis to M/s. Godfrey Phillips India Ltd. to setup & operate a ‘Utility Store’ under the category of ‘Shopping Arcade and / or Retail space’ approved by BoA.

6.1. it was brought to the notice of the Approval Committee that M/s. Seaview Developers Private Ltd., Developer had submitted proposal for allotment of built-up space of 80 Saft. (7.44 Sqmt) at i) Ground floor Lobby, Building No. 2 (40 Saft.) & ii). Ground floor Lobby, Building No.6(40 Sqft) in the processing area of IT/ITES SEZ at Plot No. 20 & 21, Sector-135, Noida (U.P.) on lease to M/s. Euronet Services India Pvt. Ltd. for setup & operate 02 Nos. ‘ATM Machine’ of HDFC Bank Ltd., under the category of ‘Shopping Arcade and / or Retail space’ approved by BoA. 

6.2. It was informed that the developer has also submitted area-wise details of such activities approved by BOA, area-wise details of approvals given by the Approval Committee for allotment of space for such activities & balance area available with the developer for leasing, as given below:-

After due deliberations, Approval Committee approved the proposal for allotment of space to M/s. Euronet Services India Pvt. 7.1. It was brought to the notice of the Approval Committee that M/s. NEC Technologies India Pvt. Ltd. (Unit-If} had applied for expansion of area & revision in projections of the unit located in the ITHTES SEZ of M/s. Seaview Developers Pvt. Ltd. at Plot No. 20 & 21, Sector-135, Noida (Uttar Pradesh). It was informed to the Committee that presently unit has occupied 30584 Saft. area at 4" floor, 27721 Sqft. area at 5" floor, and 24879 Sqft. area at 6" floor Building No. 9. It was informed that ithe unit has requested for addition of 5705 Saft. area at 6" floor, Building No.9 of SEZ.

7.2. It was informed that at present the proposed additional area i.e. 5705 sqft. at 6" floor, Building No.9 is in possession of their another SEZ unit namely M/s. NEC Technologies India Pvt. Ltd. (Unit-l). The said Unit-l has submitted its proposal for exit from SEZ scheme and their area is proposed to be taken over by Unit-ll. It was further informed that the developer has given provisional offer of space dated 19.11.2019 for allotment of 5705 Sqft. at 6" floor, Building No.9 to M/s. NEC Technologies India Pvt. Ltd.(Unit-ll), subject to the condition that M/s. NEC Technologies India Pvt. Ltd. (Unit-l) shall obtain necessary approval for surrender of aforesaid premises.

After due deliberations, the Approval Committee approved the proposed expansion of area and revision in projections, subject to completion of exit formalities by M/s. NEC Technologies India Pvt. Ltd. Artha Business Park LLP had been recently granted LOA dated 22.10.2019 as a Co-developer by DOC for ‘Conversion of warm shell to total ready to move infrastructure to be leased out to various SEZ units for Exports [total 2 floors (Floor No. 11 & 12) of Tower No. 1 of approximately 64820 Sqft. super area in the processing area of [TATES’ in the IT/ITES SEZ of M/s. Artha Infratech Pvt. Ltd. at Plot No. 21, Techzone-lV, Gr. Noida (U.P.). It was informed that the Co-developer has submitted Bond-Cum-LUT to Specified Office and its acceptance is awaited. Specified Officer informed to the Approval Committee that certain discrepancies had been found in the Bond-Cum-LUT, which had been communicated to the Co-developer. 14.5. Shri Vipin Sharma, DGM and Shri Pramod Chhoker, Sr. Manager of M/s. Arshiya 3PL Services Limited appeared before the Approval Committee. However, on one from M/s. Aditya Innovations appeared before the Approval Committee. On being asked by the Approval Committee, he informed that M/s. Aditya Innovations has withdrawn its proposal for warehousing of goods in their FTWZ unit, hence the proposal submitted by the unit vide letter dated 22.10.2019 (listed at Para 14.1 above) may be treated as withdrawn. As regards, the list of items proposed at Para 14.2 above, the representative of the unit informed that their another client M/s. Vital Nutritions, Dubai based firm has approached them to warehouse these items in their FTWZ unit. He further informed that they have done KYC of M/s. Vital Nutritions and found satisfactory. On being asked the process of KYC, by the Approval Committee the representative of the unit informed that they have hired external agencies such as KPMG etc. for KYC of domestic as well as foreign clients.

14.6. The Approval Committee observed that some of the items proposed under Exim Code 1602 & 2922, are ‘Restricted’ for import.

It was brought to the notice of the Approval Committee that M/s. HCL Technologies Ltd. had - informed that they are in the process of obtaining an Error and Omission Policy ((E&O Policy’) Service for their all SEZ Units under the Jurisdiction of DC, NSEZ, Noida. It was informed that based on the following grounds, the company has sought approval for availing exemption on Error and Omission Policy (E&O Policy) under General Insurance Business Services listed at SI. No. 26 of Uniform List of Services for their all SEZ Units under the Jurisdiction of DC, NSEZ, Noida:- 

- e« The said policy is in the nature of “General Insurance” policy. 

- e General insurance is covered within the list of “default authorized services” at Sr. No. 26 i.e. ‘General Insurance Business Service’. 

- e While the term “General issuance” or ‘General Insurance Business Service’ is not defined in SEZ Act or SEZ Rules. However, the term ‘general insurance’ is defined in Insurance Statutes including General Insurance Business (Nationalization) Act, 1972 (‘Act of 1972’) and Insurance Act, 1938. 

- e As per the said Acts, the term General Insurance covers everything other than ‘life insurance”. Thus, E&O Policy is clearly not in the nature of Life Insurance. 

- e Accordingly, E&O Insurance Policy would be covered within General Insurance Business and qualify as a “default authorized services’.
