meeting through video conferencing. On being asked about proposed increased value of
foreign exchange whereas items for trading have been proposed to procure from DTA, Shri

3.1. It was informed that the Approval Committee in its meeting held on 08.11.2019 had
observed that the unit had rendered services in DTA amounting to Rs.5041.15 lakhs during
the period 2010-11 to 2018-19.

informed to the Approval Committee that all the DTA sales were made against payment in
INR.
3.2. The Approval Committee informed that as per Section 2(z)(iii) of SEZ Act, 2005,
"Services means such tradable services which earn foreign exchange" and SEZ unit is
required to comply with the condition given in Section 2(z) of SEZ Act, 2005 for sale of
services. Hence, the services rendered in Domestic Tariff Area by the unit are not as per the
provisions of SEZ Act as the unit has rendered these in Domestic Tariff Area amounting to
Rs.5041.15 lakhs against payment in INR instead of foreign exchange. It was informed that
the Approval Committee had granted two months' time to the unit to come with its decision
regarding sale of services in DTA.
3.3. Ms. Shilpa Chawathe, Vice President of DBOI Global Services Pvt. Ltd. joined the
meeting through video conferencing. She requested for settlement of the case in terms of
Section 11(4) of the Foreign Trade (Development & Regulation) Act, 1992 without using the
word 'Penalty'.

3.3. The Approval Committee informed the representative of the unit that Section 11(2) of
the Foreign Trade (Development & Regulation) Act, 1992 provides that, 'Where any person
makes or abets or attempts to make any export or import in contravention of any provision
of this Act or any rules or orders made thereunder or the foreign trade policy, he shall be
liable to a penalty of not less than ten thousand rupees and not more than five times the
value of the goods or services or technology in respect of which any contravention is made
or attempted to be made, whichever is more'.
Further, Section 11(4) of the said Act
provides that, 'Where any person, on a notice to him by the Adjudicating Authority, admits
any contravention, the Adjudicating Authority may, in such class or classes or cases and in
such manner as may be prescribed, determine, by way of settlement, an amount to be paid
by that person'.
3.4.
After due deliberations, the Approval Committee clarified that the Development
Commissioner of concerned SEZ is the Adjudicating Authority in such matters. Accordingly,
the committee felt that action for effecting DTA sale of services in INR in violation of Section
2(z) of the SEZ Act, 2005 should be taken by the competent authority only.

It was brought to the notice of the Approval committee that Aurodesign Private
Limited had submitted an application for setting up a unit over an area of 4079.60 Sqmt.
land at Plot No. PA-010-24 in the Multi-Products SEZ of Mahindra World City (Jaipur) Ltd.

Distt- Jaipur (Rajasthan) for manufacturing of 'Women's or Girl Suits, Ensembles, Jackets,
Blazers, Dresses, Skirts, Divided Skirts, Trousers, Bib and Brace overalls, Breeches and
Shorts other than Swimwear, Women's or Girl Blouse, Shirts and Shirt-Blouses', with
projected exports of RS.29610.08 lakhs and the cumulative NFE of RS.29320.08 lakhs over
a period of five years. It was also informed that the applicant has proposed investment of
RS.240 lakhs towards imported capital goods and RS.60 lakhs towards Indigenous capital
goods.

conferencing and explained the proposal. He informed that he is running Auro Impex under
his proprietorship since last 20 years which is trading house of apparels and his another
unit, Vogue Exports has been running successfully since last 20 years under his
proprietorship with two manufacturing facilities. He further informed that other Director, Mr.
Abhiskek Modi is currently residing in Dubai and he has experience of over 20 years in the
apparels and textile industry. On being asked by the Approval Committee about the
sources of proposed promoter's contribution of approx. RS.5crores, he informed that out of
this Rs.2.5 crores shall be funded through equity shares and Rs.2.5 crores through
unsecured loans.

submitted an application for setting up a unit over an area of 18374.62 Sqmt. land at Plot
No. PA-012-008 in the Multi-Products SEZ of Mahindra World City (Jaipur) Ltd. located at
Village Kalwara, Jhai, Bhamboriya, Bagru Khurd & Newta, Tehsil-Sanganer, Distt- Jaipur
(Rajasthan) for manufacturing of 'Quartz Slabs ITC (HS)-25062090, Marble Slabs ITC (HS)-
25151220, Granite Slabs ITC (HS)-25161200', with projected exports of RS.51127.80lakhs
and the cumulative NFE of RS.48839.38 lakhs over a period of five years. It was also
informed that the applicant has proposed investment of RS.2288.42 lakhs towards imported
capital goods and RS.496.38 lakhs towards Indigenous capital goods.

It was informed that proposed raw material i.e. 'Marble slabs' & 'Rough Block of
Granite' are 'Restricted' as per Exim Code 2515 & 2516 of ITC(HS) 2017 Schedule 1
(Import Policy) issued by DGFT. In this regard, Point No. (iii) of Instruction No. 47 dated
04.03.2010 issued by DOC and now incorporated as proviso to Rule 27(1) of SEZ Rules,
2006 prescribes that, "In respect of supply of Restricted items by a DTA unit to SEZ
Developer / Unit, the DTA unit can supply such items to a SEZ Developer or unit for setting
up infrastructure facility or for setting up of a unit and it may also supply raw material to SEZ
unit for undertaking a manufacturing operation except refrigeration, cutting, polishing and
blending subject to the prior approval of BOA".

5.3.
It was informed that the applicant vide its email dated 16.06.2020 had stated that
since import of 'Marble Slab' & 'Rough Block of Granite' are 'Restricted', they do not want
LOA in respect of these items and they may be issued LOA only for 'Quartz Slab and
Quartz Powder'. As regards procurement of 'Rough Block of Granite' & 'Marble Slab' from

DTA, the applicant has requested to refer the matter to BoA. The following deficiencies have
been informed to the applicant:

The applicant has requested to issue LOA only for 'Quartz Slab and Quartz

Shri Rakesh Gupta, Partner of Nice Quartz & Stones joined the meeting through
video conferencing and explained the proposal. He requested to consider the project for
manufacturing of 'Quartz
Slab and Quartz Powder' and to
refer the
proposal for
procurement of 'Rough Block of Granite' & 'Marble Slab' to Board of Approval being
'Restricted' items. The Approval Committee clarified that the project may not be considered
partially. If they want to issue LOA only for 'Quartz Slab and Quartz Powder', revised
projections are required to be given accordingly. Thereafter, Shri Rakesh Gupta informed
that they wish to go with their complete proposal i.e.

details of source of funding with documentary evidence thereof. The Approval Committee
decided that after receipt of written reply in the matter the same shall be examined and
forwarded to the Board of Approval for consideration, in terms of Instruction No. 47 dated
04.03.2010 issued by DOC and now incorporated as proviso to Rule 27(1) of SEZ Rules,
2006, in respect of procurement of 'Marble slabs' & 'Rough Block of Granite' as raw

It was brought to the notice of the Approval committee that Rainbow Texfab Private
Limited had submitted an application for setting up a unit over an area of 8163 Sq.mt. land
at Plot No. PA-012-010 in the Multi-Products SEZ of Mahindra World City (Jaipur) Ltd.
located at Village Kalwara, Jhai, Bhamboriya, Bagru Khurd & Newta, Tehsil-Sanganer,
Distt- Jaipur (Rajasthan) for manufacturing
of 'Ladies Pullover, Ladies Jacket, Ladies Dress,
Ladies Skirt, Ladies Trouser & Ladies Blouse', with projected exports of Rs.4578.83 lakhs
and the cumulative NFE of Rs.4578.83 lakhs over a period of five years. It was also
informed that the applicant has proposed investment of RS.100 lakhs towards imported
capital goods. Total Cost of the project has been shown Rs.741.51 lakhs which shall be met
from own fund of Rs.481 lakhs, CC Limit of RS.76.50 lakhs & Term Loan of Rs. 183.75
lakhs. It was informed that the applicant has shown requirement of indigenous raw material
of Rs. 2761.79 lakhs.

provisional offer of space for allotment of 8163 Sqmt. land at Plot No. PA-012-010 issued by
SEZ developer.
6.2.
Further, it was informed that Rainbow Texfab Private Limited had already been
issued LOA No. 10/11/2015-SEZl6078
dated 24.06.2015 for setting up a Unit over an area
of 8162.94 Sqmt. at Plot No. PA-012-010 in the Handicraft SEZ (now merged into Multi-
Product SEZ). The unit had obtained two extensions in the validity of LOA upto 23.06.2018.
Thereafter, unit had not applied for LOA extension. The unit had not executed Bond-Cum-
Legal Undertaking also. They have now submitted fresh proposal of setting up of unit on the
same Plot No. PA-012-010. Simultaneously, Rainbow Texfab Private Limited has submitted
formal application for cancellation of LOA No. 10/11/2015-SEZl6078
dated 24.06.2015
along with copy of 'NOC' dated 26.06.2020 of SEZ developer for cancellation of aforesaid
LOA. Since, the unit had not commenced the operation within the extended validity period of
LOA, hence, LOA No. 10/11/2015-SEZl6078
dated 24.06.2015 may be treated as lapsed
with effect from the date on which its validity expired, in terms of Rule 19(5) of SEZ Rules,
2006.
6.3.
It was further informed that the SEZ Developer vide its letter dated 11.07.2020 has
stated that the LOA dated 24.06.2015 of Rainbow Texfab Pvt. Ltd.

allotment of proposed piece of land to Rainbow Texfab Pvt. Ltd.
6.4. Shri Vikram Singh Sekhawat, Director of MIs. Rainbow Texfab Pvt. Ltd. joined the
meeting through video conferencing and explained the proposal. He informed that they are
already
exporting
garments
from
their
DTA
unit
at
RIICO Industrial
Area, Mansarovar, Jaipur. The proposed SEZ unit will be a fresh investment & fresh
business. On being asked by the Approval Committee regarding non-implementation of
LOA dated 24.06.2015 earlier issued to them, Shri Shekhawat informed that they have
obtained LOA dated 24.06.2015 for setting up of unit for Handicraft items which they were
not able to implement due to low demand in global market. He further informed that now
the Mahindra SEZ has been declared as Multi-Product SEZ, hence they have decided to
setup unit for manufacturing of readymade garments. Shri Shekhawat further informed that
construction of plant would take approx. 1 to 1% year, and they will be able to start
production by May, 2020.

submission of details of proposed source of funding along with documentary evidence
thereof.

World City (Jaipur) Ltd. had submitted proposal for approval of list of materials amounting to
RS.944.92 lakhs to carry on following authorized operations in its Multi-Product SEZ at
Village Kalwara, Jhai, Bhamboriya, Bagru Khurd & Newta, Tehsil-Sanganer, Distt- Jaipur

It was informed that as per Certificate of Chartered Engineer submitted by the
developer, the proposed materials shall be used for construction of Roads, Sewerage
network, Storm Water network, water supply, electrical infrastructure and soft and hard
landscape work in SEZ. Original CE certificate is awaited.

the developer to submit details of infrastructure where the proposed materials will be used.
It was also pointed out that the procurement of restricted items would have to be approved
by the BOA in terms of Rule 27(1) of SEZ Rules, 2006.
