The following members of the Approval Committee were present during the meeting:-

Besides, during the meeting i) Shri Rajesh Kumar, DDC & ii) Shri Prakash Chand Upadhyay, ADC were also present to assist the Approval Committee. > At the outset, the Chairman welcomed the participants. After brief introduction, the Chairman enquired about the performance of SEZ. The representatives of the developer informed that the total notified area of SEZ is 24.69 hectare and total area has been demarcated as processing area. They further mentioned that construction of 02 Towers comprising of 6.82 lakhs Saft. have been completed and 3° Tower of 1% Phase is under construction.

It was further informed by the ° representatives of the developer that presently employment for 3300 persons has been generated with export of Rs.175 Crore during the financial year 2018-19. The representative of the developer further informed that the expected export projection is Rs.200 Crore during financial year 2019-20 and total employment generation will be approx. 5500 persons by end of FY 2019-20. The Approval Committee observed that exports in the SEZ is not satisfactory as compare to the area notified for SEZ and duty free goods / services granted to the developer by the Approval Committee, since inception. DC directed the representative of the developer to apprise the same to their higher management for taking effective steps for the growth of exports & employment generation from SEZ.

Thereafter, each items included in the agenda were taken up for deliberation one by one. After detailed deliberations amongst the members of the Approval Committee as well as interaction with the applicants / representatives of the developers/ units, the following decisions were taken:-

Elevator, 1020 KG’ has been included under the default authorized operation namely “Construction of all type of buildings in processing area as approved by the Unit Approval Committee”.

3.1. It was brought to the notice of the Approval Committee that M/s. HCL IT City Lucknow Pvt. Ltd, Developer has submitted proposal for installation of one ATM Machine of HDFC Bank over an area approx. 80 Saft. at Ground floor, Cafeteria in the processing area of SEZ, for exclusive use by HCL employees.

3.2. The Committee examined the proposal and observed that proviso to Rule 11(5) of SEZ Rules, 2006 provides as under:-

‘The Developer may, with the prior approval of the Approval Committee, grant on lease land or built up space, for creating facilities such as canteen, public telephone booths, first aid centres, créche and such other facilities as may be required for the exclusive use of the Unit’.

3.3. Approval Committee further observed that ‘Space for Bank/ATMs’ is listed as a default authorized operation in Instruction No.50 dated 15.03.2010 issued by DOC...

3.4. Shri D.K. Sharma, GM-Commercial, Shri Sanjeev Shukla, AGM, Shri Neeraj Kumar, Manager-Finance & Shri Uttam Kumar Debnath, Asstt. Manager appeared before the Approval Committee on behalf of the developer and explained the proposal. 3.5. After due deliberations, the Approval Committee approved the proposal, subject to condition that no tax / duty benefit, shall be available to M/s. HDFC Bank Ltd. to setup, operate & maintain such facility in the processing area of the SEZ and this facility shall be used exclusively by the employees of SEZ & units located therein.

4.1. It was brought to the notice of the Approval Committee that M/s. HCL Technologies Ltd. had submitted a proposal for setting up its 8" unit over an area of 4748.87 Sqmt. at fourth floor, IT Block-01 in the IT/ITTES SEZ of M/s. HCL IT City Lucknow Pvt. Ltd., at Village- Kanjehara & Mastemau, Chack Gajaria Farms, Sultanpur Road, Lucknow, (U.P) to undertake service activities i.e. ‘IT/TES namely Computer Software Services, Including Information Enabled Services Such As Back-Office Operations, Call Centres, Content Development Or Animation, Data Processing, ty Page 3 of 5

Engineering and Design, Graphic Information System Services, Human Resources Services, Insurance Claim Processing, Legal Data Bases, Medical Transcription, Payroll, Remote Maintenance, Revenue Accounting, Support Centres and Web-Site Services, Off-Shore Banking Services, Professional Services, distribution services (excluding retail services) and financial services’ with projected exports of Rs. 35598.81 lakhs and the cumulative NFE of Rs. 34883.19 lakhs over a period of five years. It was also informed that the investment of Rs. 650.56 lakhs towards imported capital goods; Rs.2329.31 Lakhs towards Indigenous capital goods and other cost of project shall be met from Reserve & Surplus of the company. Further, it was informed that the applicant has furnished copy of MOU dated 15.07.2019 signed with SEZ Developer for allotment of proposed space.

4.2. Shri D.K. Sharma, GM-Commercial, Shri Sanjeev Shukla, AGM, Shri Neeraj Kumar, Manager-Finance & Shri Uttam Kumar Debnath, Asstt. It was informed that vide Instruction No.79 dated 19.11.2013 and subsequent letter dated 19.06.2014 & dated 09.07.2014, Deptt. of Commerce had issued a uniform list of 66 nos. of default services which may ordinarily be permitted by all UACs unless anything to the contrary is noticed. It was further informed that vide Instruction No. 94 dt.08.05.2019, DOC had included “Management and Business Consultant Services” in the default services, subject to the condition that exemption for “Management and Business Consultant Services” would be limited to the value of services availed or consumed by the SEZ entity only and that the unit shall produce evidence to that effect to the satisfaction of the authorities concerned that the said service was consumed in related to their authorized operations only.

After due deliberations, keeping in view the justification given by the unit, the Approval Committee approved the uniform list of 67 nos. default services for exclusive use by the unit for their authorized operations within the SEZ only, subject to compliance of Instruction No.79 dated 19.11.2013 & Instruction No. 94 dt.08.05.2019 issued by DOC. The Approval Committee also approved the following additional services in respect of said unit:-

• (i) Business Auxiliary Services — Exclusively for works related to authorized operations carried out within the SEZ.

• (ii) Event management service — Specifically for the event related with recruitment of employees and promotional events related to authorized operations carried out within the SEZ and these events would be organized within the SEZ only.
