Noida Special Economic Zone Minutes of Meetins of Joint monitoring of EOUs held on 11.07.2018 Noida Special Economic Zone. Noida-Dadri Road. Phase-II. Noida-201305. 2nd Meeting (2018 series) of Unit Approval Commiuee (UAC) for Joint Monitoring of EoUs falling under the jurisdiction of customs commissionerates of Delhi-East, Delhi-west, Delhi-South. Gurugram and Panchkula was held on 11.07.2018 under rhe chairmanship of Dr. L.B. Singhal, Development Commissioner. Noida SEZ in the O/o Development Commissioner, Noida Special Economic Zone, Noida-Dadri Road, phase-ll, Noida- 201305.List ofofficers is enclosed at Annexure-l. At the outset, DC(NSEZ) welcomed the participants. In his introductory remarks, DC (NSEZ) emphasized the need for having Joinr monitoring meeting. He stated that these meetings not only help in reviewing the performance of the unit but also provide unique opportunity to EOUs for finding redressal to their common problems through interaction with both NSEZ and Customs authorities. It was. therefore, emphasized that participation at senior Ievel is desirable in such meetings. Further, it was stated NSEZ has been disseminating latest notifications/circulars etc. related to EOUs to all EOUs through bulk mail. Therefore, all EOUs were requested to give their updated e-mail IDs. Thereafter joint monitoring of each unit was taken up. 2.1 (18): Joint monitoring of EOUs falling under jurisdiction of Customs Commissionerate, Delhi-East in terms of Appendix 6E of HBP: l. M/s SS Gas Lab Asia Private Limited: The Committee performance ofthe unit and found the same satisfactory. reviewed the 2.2 (18): Joint monitoring of EOUs falling under jurisdiction of Customs Commissionerate, Delhi-West in terms of Appendix 6E of HBP: 2. NIls Artifacts India: The Committee reviewed the performance of the unit and found the same satisfactory. However. no representative of the unit attended the meeting. The Committee vierved this seriously and directed that all directors / partners of the unit be apprised that no one from the unit appeared for the meeting despite confirming participation and desired that the displeasure of the Committee be conveyed to the directors for not according due importance to such performance review meeting. 3. M/s Ozone International:The Committee reviewed the performance of the unit and noted that the validitv of both LOP and in-principle exit permission granted to the unit has expired. No representative of the unit attended the meeting. The Committee viewed this seriously and directed that all directors / partners olthe unit be apprised of the complete details of the status of the unit and desired the displeasure of the Committee be conveyed to the directors for not according due importance to such performance review meetings. h Page 1 of 7

M/s Albion Consulting Private Limited: The committee reviewed the performance ofthe unit and found the same satisfactory. 8. M/s Anil & company Pvtltd.: It was informed that the unit has been debonded from EOU scheme- 9. M/s Herbul Henna Export House:The committee reviewed the performance of the unit and found the same satisfactory. It was informed that the unii has been granted "ln-principle" exit permission and "No dues certificate" lrom customs autho;ties is still awaited' The Committee requested Customs authorities to expedite issuance of "No dues certificate" ofthe unit and directed the unit to submit ApR for the period 201 7- l 8. 10. M/s P.c.L. Exports: It was informed that although the unit had achieved NFE criteria, it had pending export proceeds Rs. 2.00 crore unrealized. Further. it was informed that the unit had already been granted "ln-principle" exit permission and ..No dues M/s welspringuniversal: The committee reviewed the performance of the unit and found the same satisfactory. The representative of the unit desired that ab initio exemption of taxes on domestic procurements be restored as inordinate delav in payment of refund claims are causing undue hardship for small units like theirs due to liquidity crunch. The committee informed the representative that the Govemment is seized of the matter ol delay in payment of refund claims and is trying best to ensure expeditious clearance of such claims. As far as the issue of .estoraiion of ab initio exemption of taxes is concerned, it was informed that it has already been taken up at length many times at various forums and that there has not been any agreement on the issue so far. M/s wipro Limited: The committee reviewed the performance of the unit and found the same satisfactory. In response to a query regarding pending foreign exchange realisation worth Rs. 2.08 lakh, the representative or the unit infJrmed th"at the said amount has been realised. The committee directed the unit to submit the documentary evidence ofrealization duly certified by the chartered Accountant. M/s EssEss overseas: It was informed that the unit commenced operation in 200g and validity of its licence expired in 2013. Further. it was informedihat the unir has not been operating since 2013. However. no action for cancellation of Lop could be taken as information regarding status ofthe unit. pending duty liability etc. ofthe unit has not yet been received from jurisdictional Central Excise/ Cusioms authorities despite several reminders. The committee requested all officials concemed to pursue these cases in right earnest and take all possible steps to safeguard covemment revenue.The committee requested the customs authorities concemed to carry out physical verification of the unit and submit a report of the present status of rhe unit. Further, Customs authorities were requested to expedite issuance of"No dues Certificate". M/s Seema Overseas: The Committee revievved the performance of the unit and found the same satisfactory. However it was observed that unit has not submitted APR for the period 2017-18. The Committee directed the unit to submit APR for the period 2017-18 within one week. M/s Jennex International: It was intbrmed that the unit commenced operation in 2003 and validity of its licence expired in 2013. Further. it u,as informed that the unit has not been operating since 2013. However. no action lor cancellation of LOP could be taken as inlormation regarding status, pending duty tiability etc. of the unit have not yet been received from jurisdictional Central Excise/ Customs authorities despite several reminders. The Committee requested all officials concemed to pursue these cases in right earnest and take all possible steps to safeguard Govemment revenue.The Committee requested the Customs authorities concerned to carry out physical verification ofthe unit and submit a report regarding the present status of the unit. Further, NSEZ officiats were asked to provide complete export import details of the unit since inception to the Customs authorities. 13. M/s Jennex International (Unit-2) It u,as informed that the unit commenced operation in 2008 and validity of its licence expired in 2013. Further, it was informed that the unit has not been operating since 20 1 3. However, no action for cancellation of LOP could be taken as information regarding status, pending duty liability etc. of the unit has not yet been received from jurisdictional Central Excise/ Customs authorities despite several reminders. However, since the matter regarding duty liability of the unit is subjudice, grant of "no dues certificate" by Customs Authorities is delayed. The Committee requested the Customs Authorities to take all possible steps to ensure expeditious settlement ofthe case. 40. M/s Erol Exports Pvt. The representative ofthe unit submitted that its jurisdictional Customs Authorities are still insisting on seeking approval of jurisdictional authorities in respect ol intimation to be given to jurisdictional customs Autthorities regarding quantum and value of goods proposed to be imported despite DCEP's clarification in this regard. The Committee expressed concem and requested the customs Authorities to take up the matter with chief Commissioner and resolve it at the earliest. 42. M/s Labotech Microscopes India Pvt.
