Minutes of 1 Meeting (2018 Series) of Unit Approval Committee for EOU Scheme held under the Chairmanship of Dr. L.B. Singhal, Development Commissioner, NSEZ, Noida on 27.02.2018 at 11.30 AM at NSEZ, Noida,

1" meeting (2018 Series) of Unit Approval Committee for EOU scheme (UAC) was held on 27.02.2018 under the Chairmanship of Dr. L.B. Singhal, Development Commissioner, Noida SEZ.

The following members of the Unit Approval Committee were present in the meeting:

1. Shri $.S. Shukla, Joint Development Commissioner, NSEZ, Noida.

• Z. Shri K.C. Tiwari, Assistant Commissioner, Customs (Preventive), Jodhpur Headquarter, Jaipur.

G. Shri Gobinda Banerjee, FTDO, CLA, New Delhi.

Besides during the meeting of UAC, Smt. Mala Rangarajan, DDC, Shri Ram Baboo, ADC were also present to assist the UAC.

2. The Chairman welcomed all participants of the UAC and thereafter agenda was taken up for discussion.

1.0(2018) Confirmation of minutes of 5 meeting (2018 series) of the UAC held on 15.11.2017.

It was informed that the proposal received from M/s Shree Rishabhdev Marble & Minerals Pvt. Ltd, was for conversion of existing DTA unit into 100%EOU at Village-Garwawat, NH-8, Rishabhdeo, Udaipur-313802 for manufacture and export of Marble Slabs / Tiles. Granite Slabs / Tiles, Natural Stones Slabs / Tiles, Dressed Marble / Granite / Natural Stone Blocks. Shri Naresh Bolya, Director of the firm appeared before the Approval Committee to explain the proposal in detail. He submitted that the company was taken over by him and his partner Shri Ajay Mogra in 2016 after completing all the formalities. The Committee directed Shri Naresh Bolya to furnish related documents of take over including approval of Ministry of Company Affairs. Further, he submitted that they are engaged in the business of export of Marble/ Sand Stone/Granite Slabs and

Further, he submitted that the processing of imported marble is advantageous under EOU scheme as Customs duties are exempt under the scheme. He also informed that his unit is located near the source of raw material, which would help their company to perform better.

It was informed that name of the unit figures in the list (circulated by Reserve Bank of India, Jaipur) of units whose export bills are pending beyond prescribed period for realization. As per the details given in the list, the unit has outstanding export proceeds for realization to the tune of Rs.216.49 lakh against 34 Nos. of shipping bills. In this connection, it was informed that export proceeds in respect of most of the shipping bills shown as outstanding, have already been realized and that the bank has not updated the status.

The Committee noted that the site inspection report from jurisdictional customs authorities jodhpur headquarters at Jaipur and antecedent verification report from Visakhapatnam SEZ, FALTA SEZ, SEEPZ and MEPZ SEZ have also been received and nothing adverse has been reported.

The Committee after due deliberations approved the proposal of the unit subject to the condition that the unit shall submit a certificate from their AD Bank, regarding realization of pending remittance of shipping bills shown as outstanding, and in case its outstanding then extension from AD Bank/ RBI as the case may be, before issue of LOP; and also no DTA sale of Marble in any form — which are restricted in terms of para 6.08 of Foreign Trade Policy 2015-20 shall be allowed.

1.01(2018) Proposal for conversion of existing DTA unit into 100%EOU M/s Mehta Stone . Export House

It was informed that the proposal received from M/s Mehta Stone Export House, was for conversion of existing DTA unit into 100%EOU at SP 1-6, Sotanala Industrial Area, Behror, Shahjahanpur, Rajasthan-301701 for manufacture and export of Articles of Carbon Fibre, Sandstone, Slatestone, limestone, Calcareous Stone, Quartzite, Marble, Granite Slabs, Granite Tiles, Wooden Panel, Honeycomb Panel (Plastic), Cement Fibre Board, MDF, Slatestone, Polishing Stone, Panel Mosica and 3D Peel and Stick Stone.

Shri Parag Mehta, Director of the firm appeared before the Approval Committee to explain the proposal. He submitted that he started his export business of export of marble, sand stone, limestone and slate in 1999 and converted into EOU in 2005. He operated as an EOU from Fae a waned LA

2005-2012, during which he made export of Rs.144.48 crore and earned NFE of Rs.142.10 crore. However, he could not sustain export business due to recession and withdrawal of incentives.

The Committee noted that the products the unit now proposes to manufacture are different from the products for which the unit was given license earlier. The Committee asked the representative to explain each and every product that is proposed to be manufactured and whether the products are related to each other. The representative explained that all the products are used in construction business. He further explained with sample, the manufacturing process involved in each product and its use. The Committee directed the unit to furnish a write up on each and every product included in the proposal.

Shri Mehta also explained the reason for coming to EOU scheme again and stated that in EOU scheme, formalities of Customs in export-import ~ especially for exports ofconsignments are easier Hifn'the DTA unit.

The committee noted that as per the verification report furnished by jurisdictional Customs, a penalty of Rs.1.00 lakh (Rupees One Lakh only) has been imposed by jurisdictional Tax authorities. Unit’s representative informed that they are in the process of filing appeal against the Order-in-Original. It was further informed that outstanding obligations under EPCG/ Advance License have already been cleared in most cases and that they propose to clear the rest also by paying duties.

The Committee after due deliberations approved the proposal of the unit subject to the condition that no DTA sale of Marble in any form which are restricted in terms of para 6.08 of Foreign Trade Policy 2015-20 shall be allowed.
