Minutes of the last meeting of Approval Committee was confirmed.

89.1 MISCELLANEOUS:

89.1.1 Show Cause Notice to be issued to M/s Tex Poly India Limited, KASEZ for violation of provisions of FTDR Act, 1992 and SEZ Rules, 2006.

M/s Tex Poly India Limited (carlier known as M/s C.J. Plastics Pvt. Ltd.) a worn and used clothes processing unit located at Shed No. 109-112, Sector-l, K.A.S.E.Z, Gandhidam is an approved unit at KASEZ vide LoA No. KSEZ/IA/1601/95/69-A dated 28.12.2010 as amended from time to time and valid for a period upto 30-11-2018 for Clothing & Wipers made out of worn / used garments. M/s Tex Poly India Limited, on 04-12-2015, presented bales of clothes bearing Sl. No. from 01 to 65, mentioned as Old and Used Mutilated cloth Rags, as assessed vide their Bill of Entry No. 0009560 dated 20/11/2015 for DTA clearance. od

e Minutes of the 89th Approval Committee meeting held on 23-12-2015 at 11:30 hrs. under the Chairmanship of Shri Upendra Vasishth, Development Commissioner, KASEZ.

During 100% Inspection of the 65 bales bearing Sl. No. 01 to 65 presented by M/s. Tex Poly India Limited at the area allotted to them for DTA clearance, some of the goods containing in bales were found uncut and are not as per Customs Circular No. 36/2000 dated 08/05/2000. As the said unit has contravened ,the provision of Section 11 of Foreign Trade (Development and Regulation) Act, 1992, and guidelines prescribed in Customs Circular No. 36/2000 dated 08-05-2000 issued by the CBEC, Ministry of Finance, accordingly a Show Cause Notice is required to be issued for contravention of the provisions of FTDR Act, 1992 and SEZ Rules, 2006 to the said unit. The said case was placed before the Committee for discussion.

The Committee after due discussion authorized Development Commissioner, KASEZ to issue Show Cause Notice to M/s Tex Poly India Limited in the said matter. 89.1.2. Show Cause Notice issued to M/s U.S. Clothing (India) Pvt. Ltd. M/s U.S.Clothing (I) Pvt. Ltd a worn and used clothes processing unit located at Plot No.274-281, Sector —IV, K.A.S.E.Z, Gandhidam, were issued a Show Cause Notice under F.No. KASEZ/U.S.Clothing/SCN-IA-1/201516/12379-82 dated 21-12-2015 for contravening the provision of Section 11 of - Foreign Trade (Development and Regulation) Act, 1992, and _ guidelines prescribed in Customs Circular No.

The action taken by the Development Commissioner, KASEZ, was placed before the Approval Committee for ratification.

. The committee after discussion and deliberation on the issue ratified the point of issuance of Show Cause Notice to M/s U.S. Clothing (India) Pvt. Ltd., KASEZ.

89.2 RATIFICATION OF REQUESTS ALREADY APPRROVED ON FILE

:-

As per decision taken during the 83™4 Unit Approval Committee meeting of KASEZ, held on 30-06-2015 that broad banding request and change of constitution, change of name etc. should be decided on file by the D.C, KASEZ, and may thereafter be put up before the next meeting of the Approval Committee for ratification, Accordingly following three cases were put up before the UAC for ratification, as the same were approved on file, by the D.C, KASEZ.
