Minutes of the 41st meeting of Approval Committee held on 05/01/2011 at 1530 hrs. at KASEZ, under the Chairpersonship of Shri Upendra Vasishth, Development Commissioner (i/c), KASEZ.

Following were present:

41.1 Review/confirmation of the minutes of last meeting of the Approval Committee:

Minutes of the last meeting of the Approval Committee were confirmed.

41.2. Action Taken Report:-

41.2.1 As approved in the last Approval Committee meeting, Letter of Approval has been issued to the following applicant:-

(i) M/s. Sanjay Ratilal Sorathia

41.3. Following new proposals for setting up units in Kandla Special Economic Zone were taken up for consideration:

41.3.1 M/s. Soi Agro Industries Pvt. Ltd., Ahmedabad:

Committee observed that the proposal was discussed in the Approval Committee meeting held on 26/5/2010 and 9/7/2010 and a query was raised by the Income-Tax Department regarding arrangement of Finance of Rs.440 lakhs. It was noted that the reminders have been issued to the unit by DC as well as by the Income Tax Department to confirm the status of the above query. Addl.

Committee felt that the proposal cannot be deferred indefinitely and in view of ojection of Addl. Commissioner (IT), it was decided to reject their proposal.

41.3.2 M/s. Link Enterprises, Gandhidham:

Committee observed that the proposal was discussed in the Approval Committee meeting held on 6/10/2010 and query raised by the Additional Commisisoner Customs, Kandla that there are quite number of SCNs issued and some are adjudicated iand their track record is not proper. Since Additional Commissioner (Cus) was not present for comments, the proposal was deferred.

41.3.3 M/s. Agasthya Free Trade Warehousing Pvt. Ltd., Gandhidham:

Committee observed that there are about 21 units which have been given warehousing LOA in the Zone and a decision has been taken in 40th Approval Committee meeting to watch the performance of the warehousing units, especially those which have been given LOA recently and all the proposals for warehousing were deferred. Therefore, it was decided to defer the present proposal also. This may taken up alongwith all other applications of warehousing deferred in the 40th Approval Committee meeting.

41.3.4 Real Pack Tech,Gandhidham:

The proposal was deferred. (Action: IA-I Section)

41.4 Ratification of Broad banding permissions for the month of December 2010:

Committee took note of the broad banding permission granted by the Development Commissioner, under the delegated powers to M/s. Creative Free Trade Warehousing Pvt. Ltd. for undertaking trading activity of readymade garments and made-ups and to M/s. Euro Trousers Mfg. Co. for trading activity of textile fabric.

41.5 Certificate to be issued to KASEZ units to avail exemption/refund of Service Tax:

Committee observed that the Approval Committee had already approved various services required in relation to the authorized operations of the KASEZ units for availing exemption/refund of service tax as default list. The present request is for approval of site formation and clearance, excavation and earthmoving and demilitin services, received from M/s. Vijay Tanks and Vessels Ltd, which are stated to be in relation to their authorized operations. Committee approved the above services for KASEZ unit as default services, which will be applicable to all Zone units.
