Minutes of the 200 Unit Approval Committee Meeting of Kandla SEZ held on 28.03.2024 at 11:00 hrs under the Chairmanship of Shri Dinesh Singh, Development Commissioner, Kandla Special Economic Zone.

200.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 200.1.1 Application for setting up of a Manufacturing unit in KASEZ namely M/s. Kutch Bio Products Pvt. Ltd., Plot No. 121, Sector No. 9 C, Gandhidham. A proposal has been submitted by M/s. Kutch Bio Products Pvt. Ltd., Gandhidham — Kutch for setting up a unit in Kandla SEZ for manufacturing activity. their Shri Mahamadali Gulamali Khoja, Director of the company explained proposal. Shri Khoja stated that they are having two plants one in Padana, Kutch and one in Bhimasar, Kutch opp. Cargill factory for manufacture of petroleum specialty solvents & carbon gel, edible oil, distilled fatty acid, bio-diesel, etc. and now they want to set up a manufacturing unit in KASEZ for manufacture of edible oil, fatty acid oil, palm oil, distilled fatty acid, bio-diesel, etc. He further stated that they will export their finished products to Europe and Australia and bio-diesel will be for export only. The products manufactured by them are used in the cosmetics and paints industries. The Committee asked the Director about the turnover of their existing company and how they will manufacture finished goods mentioned at Sr. No. 13 —- Soap Stock as the same is prohibited for import. In reply, Shri Khoja stated that in their Padana Plant their export turnover is about Rs. 80 crores and in their Bhimasar Plant their export turnover is about Rs. 100 crores. Regarding the finished goods Soap stock, the same will be manufactured from raw material edible oil and other raw materials.

He further stated that they are also having a Solvent plant in Kandla Port. The Approval Committee after due deliberation decided to approve the proposal for setting up a manufacturing unit. This approval is also subject to standard terms and conditions as under: i) Any restrictions on import/export of manufacturing items and ii) its raw materials will apply. None of the items which are restricted or prohibited will be allowed to be manufactured and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. ii) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per iv) DGFT Import Policy’, the later will prevail. Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.

200.2 REQUEST FOR BROADBANDING/ITEM ADDITION

AGENDA ITEM NO. 200.2.1 Request of M/s Aum Solvchem, KASEZ for addition of two items in their warehousing service activity and Trading activity in their existing LoA.

dated M/s Aum Solvchem is an approved unit with LoA No. 14/2019-20 19.12.2019, as amended for trading activity and warehousing activity subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.

Now the unit has requested for approval of two items in their warehousing service activity and trading activity.

Shri Harpal Devda, Commercial Manager of the firm explained their proposal. Shri Devda stated that they are receiving enquiry for export of more products for trading and warehousing activity and requested for addition of two items for trading & warehousing activity in their existing LoA.

The Approval Committee after due deliberation decided to approve the proposal for addition of two items in trading activity and warehousing service activity (subject to unit submitting KYC of their clients alongwith ITR of last 3 years on whose behalf they will warehouse goods) in their existing LoA and also subject to the following standard terms and conditions and also subject to physical verification regarding the compliance with regard to physical demarcation of trading and warehousing activities with separate entry & exit gates for each activity:

AGENDA ITEM NO. 200.2.2 Broad banding of Manufacturing Activity (Addition of new products in unit’s LoA) —- Request of M/s. Blaze International- Unit-II., KASEZ. No. M/s. Blaze International Unit-II., KASEZ is an approved unit with LoA 23/2021-22 dated 07.02.2022 issued from F. No. KASEZ/IA/23/202122/1131 for manufacturing activity (plastic items) and Warehousing service activity, as amended subject to certain terms and conditions enumerated in the aforesaid Letter of Approval. Now the said unit has requested for broad banding of their manufacturing activity in their existing LoA.

Shri Sunil Milak, Authorised Representative of the firm explained their proposal. Shri Milak stated they are in KASEZ for manufacturing of recycling of plastic scrap and another unit as Unit-II for manufacturing and warehousing activity which is being recently started. He further stated that he is also having corrugated box and yarn manufacturing units outside KASEZ. Now they propose to include two new items in their manufacturing activity. He further stated that the items proposed are modular containers for data server and battery power which is the trend in the United States nowadays.

The Committee asked the representative of the firm about the manufacturing activity already approved in their LoA and as to whether they have started their manufacturing activity or otherwise and as to whether they have made physical demarcation of both their manufacturing and warehousing activity. In reply, Shri Milak stated that they have already installed machinery valued about Rs. 25 lakhs and within 2-3 months they will start their manufacturing activity approved in their LoA. Further with regard to separate demarcation of manufacturing and warehousing activity, he stated that they have been allotted an area of 1,650 sq. mtrs. out of which they will utilize 1,000 sq. mtrs. area for their manufacturing activity and in the remaining 650 sq. mtrs.

AGENDA ITEM NO. 200.2.3 Addition of Manufacturing Activity of tobacco products - Request of M/s. Jeen Mata Products Private Limited, KASEZ.

AGENDA ITEM NO. 200.2.4 Addition of new item in their LoA for Trading Activity - Request of M/s. Star World, KASEZ.

M/s. Star World, KASEZ is an approved unit for Trading and Warehousing service activity in Kandla Special Economic Zone vide Letter of Approval No. KASEZ/IA/17/2022-23 dated 28.11.2022, as amended. They have commenced their authorised operation in KASEZ w.e.f. 24.07.2023 and accordingly their LoA is valid up to 23.07.2028.

AGENDA ITEM NO. 200.2.6 Request of M/s Transworld Furtichem Pvt. Ltd. (Unit-I), KASEZ for addition of by-product - Gypsum in their existing Letter of Approval No. KASEZ/IA/024/2004-05 dated 26.10.2004. M/s Transworld Furtichem Pvt. Ltd. (Unit-I), Plot No. 353 & 367, Sector-IV, Kandla Special Economic Zone, Gandhidham is an approved unit for Manufacturing of N.P.K. Fertilizers vide Letter of Approval No. KASEZ/IA/024/2004-05 dated 26.10.2004, as amended. in Now the said unit has requested for addition of by-product - Gypsum their manufacturing activity in their existing LoA. Shri Shri Hiren Vora, Manager of the company explained their proposal. Vora informed that they are a manufacturing unit in KASEZ for NPK Fertilizers and Single Super Phosphate (SSP). Recently to enhance the quality nutrient of the product SSP they have done some modification wherein one by-product Gypsum is being generated which will be sold in the DTA.

The Committee asked the representative of the firm about of the end use of their by-product gypsum and the plant capacity to manufacture SSP and generation of its by-product Gypsum. In reply, Shri Vora stated that to enhance the SSP quality nutrient modification in the SSP process was done which will increase the SSP quality nutrient from 16% to 19% which has good export market and in their plant 200 MT SSP is produced per day & about 13-15 ton of by-product Gypsum is generated per day. He further Stated that their by-product Gypsum is being used in the fertilizer and 8 cement industry. aN

AGENDA ITEM NO. 200.2.7

Broad banding of Manufacturing Activity (Addition of new products in unit’s LoA) and addition of Trading Activity of tobacco products - Request of M/s. Trimurti Fragrances & Flavours Pvt. Ltd., KASEZ. unit M/s. Trimurti Fragrances & Flavours Pvt. Ltd., KASEZ is an approved for manufacturing activity of Guthka, Khaini, Zarda, Pan Masala, Chewing Tobacco, Filter Khaini and Preparation containing chewing tobacco vide Letter of Approval F.No. KASEZ/1A/22/2019-20 dated 27.02.2020, as amended. Now the said unit has requested for addition of new items in manufacturing activity and also addition of trading activity in their existing LoA. their Shri Arpit Kyal, Authorised Representative of the company explained of proposal. Shri Kyal informed that they are in KASEZ for manufacturing Pan masala, Gutkha, etc. and now they wish to include more items in their manufacturing activity and also addition of trading activity in their existing LoA. / 4

The Committee asked the representative of the firm about the area allotted to them and how they will demarcate the area for manufacturing & trading activity and investment and employment generation for the proposed additional activities. In reply, Shri Kyal stated that they have been allotted area of 10,000 sq. ft. consisting of ground floor and first floor and they will utilize both the floors for manufacturing and trading activity separately. Regarding, trading activity he stated that they will source the traded items in bulk which will be re-packed and re-labelled as per requirement of their customers for exports. Further, for the proposed additional activities of manufacturing and trading, they are going to invest about Rs. 85 lakhs in plant & machinery and will generate additional employment of about 25 persons.

Shri Baid informed that they are in KASEZ for trading activity of electronics, fabrics, tobacco products, etc. and now they want to include manufacturing activity in their existing LoA. He further stated that for the proposed manufacturing activity they will invest Rs. 56.00 lakhs in plant & machinery and will employ about 25 persons.

Further, the Committee was informed that for non-achievement of positive NFE for the last 5 years block period, the unit has been issued Show Cause Notice which was adjudicated by the Adjudicating Authority imposing penalty of Rs. 14,01,540/- and against the said Order imposing penalty, the unit has filed appeal before the Appellate Authority which is pending.

Shri Mahender Kapoor, Consultant and Shri N. K. Chaudhary, Authorised Representative of the company explained their proposal. He further stated that KASEZ is spread in around 1000 acre of land (including phase 1 & phase 2) and another 100 acres being developed in Phase 2 and there is not a single weigh-bridge in Phase 2 area i.e. New Zone and hence they have requested for permission for weigh-bridge in Sector 3 and Sector -4 of Phase-1 as well as in Phase-2 under Rule 11(5) of SEZ Rules.

Kandla Special Economic Zone Industries Association has sought clarification on Rule 18(5) of the SEZ Rules, 2006. KASEZIA has submitted that few of their members are holding LOAs under Rule 18(5) and Rule 76 of the SEZ Rules, 2006 for providing warehousing services and recently the warehousing units have completely stopped manufacturing activity in their warehouse and now intend to provide only storage facility in their warehouse.

The Committee deliberated on the issue and decided to constitute a Committee consisting of DDC, DC (Customs) and other officers to examine the issue with respect to the decisions taken by various UACs, instructions issued by DoC and SEZ Act & Rules provisions and submit its report to the DC office and the DC office will decide the matter on file.

In reply, Shri Kothari stated that by mistake they have not changed the ITC HS in the present proposal and requested to permit them to submit the exact ITC HS code for the raw materials. The Committee further noted that the unit has submitted raw material list of items namely 01. Quartz (25132030) 02. Feldspar (25132090) and 03. Crushed Stone Grit (28182090) against which absolutely wrong HSN code has been submitted by the unit, therefore, the approval committee is left with no option and after due deliberations decided to reject the proposal.

The unit started its authorized activity w.e.f. 05.01.2005 and validity of their LoA is extended for last five years upto 04.01.2025.

Now the said unit has requested for debonding/exit of their unit from KASEZ as due to un-viability of business they have decided to exit from SEZ scheme. The Committee was informed that as per APR submitted by the unit for the F.Y. 2023-24 (upto 28.02.2024), the unit is having Nil (neutral) NFE for the last five-year block period ending 28.02.2024. Further, second proviso to Rule 74 of the SEZ Rules, 2006 stipulates that if the unit has not achieved positive NFE, the exit shall be subject to penalty that may be imposed under the Foreign Trade (Development and Regulation) Act, 1992.

The Committee was informed that the UAC in its 195 meeting held on 19.10.2023 had unanimously decided to withdraw all the approvals granted to the units in KASEZ for warehousing of Arecanut/Betelnut and Pepper which are only involved in providing warehousing services on the behalf of their clients as instances have come to the notice of the Development Commissioner’s office that many of the warehousing units of KASEZ are indulged in mis-declaration/mis-use of warehousing of goods viz. Arecanut/Betelnut and Pepper on behalf of their clients. Due to the sensitivity of the goods permission for warehousing of the subjected goods were not approved by the UAC since June, 2021. Aggrieved with the decision taken in 195% UAC meeting held on 19.10.2023, three of the KASEZ units i.e. M/s MGA & Associates (Unit-II), M/s Shreeji Overseas and M/s Varsur Impex Pvt. Ltd.

The Committee also directed the DC office that the units who have been granted approval in the UAC may be given 3 weeks time to submit the requisite documents/undertaking otherwise the approval granted by the UAC will be liable for cancellation.

The Committee further directed the DC office to not put up proposals of the units that have pending rental dues in future in a routine manner.

Notwithstanding to the decisions of the Committee, if the DC Office/Approval Committee notices any instance of default in rent or pending legal proceedings as on date of decision of the Committee or any Ky if
