199.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 199.1.1 Application for setting up of a Service Activity unit in KASEZ namely M/s. Bhavya Engineering Works & Multiservices, Nr. Survay Bhavan Gate, Bhanushali Nagar, Bhuj-Kutch 370001.

A proposal has been submitted by M/s. Bhavya Engineering Works & Multiservices, Bhuj - Kutchfor setting up a unit in Kandla SEZ for service activity.

Shri Hitesh Soni, Partner of the firm explained their proposal. Shri Soni stated that they wish to set up a service unit in KASEZ for water supply, dry solid waste garbage and also welding & fabrication work. He further stated that they are already having water supply plant in Bhuj from where they will supply water to KASEZ units and regarding garbage they will collect dry solid waste garbage from units in KASEZ for disposal to the GPCB approved site outside KASEZ.

The Committee asked the Partner as to whether they have any experience in this field and have marketing tie up with any of the KASEZ units for disposal of their dry solid waste garbage as the units in KASEZ might be having tie up with other parties for disposal of their dry solid waste. In reply, Shri Soni stated that they have experience of 15 years in this line of business and doing the said business in Kandla and now they want to start the service unit in KASEZ units to provide services to units in KASEZ but till date they have not contacted even a single unit in the KASEZ for the sought services as mentioned in their proposal.

The Committee also asked the Partner that if they are already having water supply plant outside then from there, they can directly supply the water to the units in KASEZ without setting up a unit in the KASEZ, then why to set up unit in KASEZ. In this regard, Shri Soni could not provide any satisfactorily reply.

The Committee further noted that the applicant has earlier requested for setting up a unit for manufacturing activity and warehousing activity of 147 items which was taken up for consideration in the 194th UAC meeting held on 27.09.2023 wherein the Committee had rejected their proposal as there was no clarity in the proposal and again the applicant has submitted application for service activity which shows the inconsistency of the applicant in submitting two different proposals within a time span of about 4-5 months. Further, the present proposal is also not concrete in field of market survey, feasibility of the project in KASEZ, etc. and also as to how the FOB value of exports, FE outgo and NFE has been arrived in their project proposal is not clear and forthcoming. satisfactory reply which depicts that the proposal has been prepared in a casual manner.

Therefore, in the absence of any such clarity regarding market survey, feasibility of the project in KASEZ, projected foreign exchange balance sheet, etc., and the project proposal is submitted without any due diligence. Therefore, the Approval Committee after due deliberation unanimously decided to reject the proposal.

AGENDA ITEM NO. 199.1.2

Application for setting up of a Service Activity unit in KASEZ namely M/s. Harish A Pandya, Brahman Samaj Building, Plot No. 106, Sector No. 8, Behind Oslo Cinema, Gandhidham-Kutch 370001.

A proposal has been submitted by M/s. Harish A _ Pandya, Gandhidham - Kutchfor setting up a unit in Kandla SEZ for service activity. Shri Harish Pandya, Proprietor of the firm explained their proposal. Shri Pandya stated that he is into binding wire business in Kukma near Bhuj wherein they manufacture 18 gauge binding wire and their daily production is about 2 MT wherein they supply the finished products in local market.

Now, he has planned to set up a service unit in Kandla SEZ for dry solid waste — non-hazardous waste treatment and disposal service wherein they will collect dry solid waste from KASEZ unit and they will dispose off the same to the GPCB approved site outside KASEZ.

The Committee asked the Proprietor as to whether they have done any market survey in KASEZ or are having any tie-up with any of the KASEZ units for disposal of their dry solid waste as the units in KASEZ might be having tie up with other parties for disposal of their dry solid waste. In reply, Shri Pandya stated that they have not made any physical survey of KASEZ units with regard to dry solid waste disposal of units in KASEZ.

The committee asked then if you have not carried out any kind of survey in the Zone nor contacted or got any purchase order, then how the export figure, NFE figure as submitted in the proposal arrived. In reply, Shri Pandya replied that they will collect the scraps from the ships at Mundra and Kandla port, then Committee asked if the scraps to be collected from the ports then why to set up unit in the Zone. Unit representative said they are hoping that they will also get some chance to work in the Zone and will get the scrap from the units working in the Zone but till date they have not done any kind of survey in the zone. Therefore, the Approval Committee after due deliberation decided to defer their proposal with direction to the applicant to submit detailed project

199.2 REQUEST FOR BROADBANDING/ITEM ADDITION

AGENDA ITEM NO. 199.2.1 Request for addition of manufacturing activity in their existing Letter of Approval No. KASEZ/IA/005/2015-16 dated 02.06.2015for Warehousing Service and Trading activity, as amended issued to M/s. Stash Barn Enterprises, KASEZ.

M/s Stash Barn Enterprises, KASEZ is an approved unit for Warehousing Service Activity and Trading Activity in Kandla Special Economic Zone vide Letter of Approval No. KASEZ/IA/005/2015-16 dated 02.06.2015, as amended.

The proposal of the unit for addition of manufacturing activity in their existing LoA was deferred in the 198th UAC meeting held on 25.01.2024 with direction to the unit to submit detailed technical proposal along with details of raw materials required for manufactured products and also layout plan showing demarcation of proposed manufacturing activity. Now the said unit has submitted project report giving detailed description/ specification of raw materials required for manufacturing goods and also submitted Layout Plan of manufacturing & storage of raw materials and other activities. Shri Yash Gangwani, Partner along with Shri Vivek Milak, Authorised Representative of the firm explained their proposal. Shri Gangwani informed that he is already in the business of trading and manufacturing of blending of oils and lubricants and having 15 years experience in this field and now they want to set up a manufacturing unit at KASEZ for distillation and blending of oil/lubricants and they will utilize their allotted Plot No.

The Committee asked the Partner of the firm as to whether they have obtained PESO licence and whether the products proposed for manufacturing activity are IS compliant wherever applicable. In reply, Shri Gangwani stated that they have already applied for PESO licence and they will comply with the IS norms wherever applicable with regard to their manufactured products. He further stated that they have already placed order for plant manufacturing unit for distillationand have also received Letter of Intent from UAE based client for product supply and distribution rights. He also stated that the products manufactured will be exported to the tune of 50%-60%. AS 4

  • ii) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

  • ix) Further, the unit will give an undertaking that none of the items proposed and its raw materials are falling under negative list and if the items are found in negative list, penal action will be initiated against them.

AGENDA ITEM NO. 199.2.2 Broad banding of Manufacturing Activity (Addition of new products in unit’s LoA) -Request of M/s. Esskay Niryat Corporation, KASEZ.

M/s. Esskay Niryat Corporation, is an approved unit for manufacturing activity of Pan Masala, Guthka, Sugandhi, Split Betelnut in KASEZ. The unit have been granted Letter of Approval No. 02/2015-16 dated 28.04.2015 issued vide F.No. KASEZ/1IA/02/2015-16, as amended. Now the said unit has requested for addition of one product under manufacturing activity in their existing LoA. Shri Satish Khushalani, Authorised Representative along with Shri Om Prakash Tiwari, Authorised Representative of the firm explained their proposal. Shri Khushalani stated they are in KASEZ for manufacturing of 5 YN

Pan Masala, Gutkha, etc. and now they propose to add one item in their manufacturing activity. He further stated that the item proposed is an ancillary product wherein they will receive the product in granules forms which will be processed for de-moisturise with drying unit then the dried granules will be put in pulveriser for grinding and to vibrator machine for fine grading and then same will be added with other raw materials as per the requirements of their customers which will be then exported.

The Committee asked the representative of the firm about the turnover of their unit, their plant utilization and the change over time in production as the proposed item is an ancillary products & its use. In reply, Shri Khushalani stated that their turnover in 2022-23 was about Rs. 40 crores and during the current financial year it is about Rs. 38 crores. With regard to plant utilization he stated that prior to lockdown their plant utilization was 50% to 75% of its capacity and the change over time for proposed manufacturing activity will be about 36 hours. The final product proposed will be used in food, cosmetics and medicines, etc. They have export order of USD 9800 in hand and they are in negotiation for further export orders to the tune of USD 50000 for the proposed item of manufacture.

The Committee further asked the representative of the firm that the item of manufacture & one of its raw materialsare the same and also they have stated that they can export the final product with the use of the said raw material without adding any other raw materials. In reply, Shri Khushalani stated finished product and raw material fall under the same ITC HS, the raw material will be in granule form and after processing the finished product will be in powder form. Further, they can export the said finished goods will only one raw material and also by adding other raw materials as the same depends upon their buyers requirements.

He further stated that with regard to one proposed item industrial perfume/essential oil the raw materials will be mixed &put under heat process then wait for cool down the liquid at normal temperature and again Heating & mixing (mixing flavours & spices if required) & after cooling down the final product is received which is ready for export. The said finished product can be used as flavouring substance and in food essence, ayurvedic & allopathic medicines, beauty products, etc.

With regard to other item proposed for manufacturing catechu the raw material will be in lump form which will be put in de-moisturising process then crushing to get the product in granules form which will then be put in de-moisturising process and after grinding finished product in fine powder will be produced for export. The Committee asked the representative of the firm as to whether they have export orders and made market intelligence for the proposed manufactured items. In reply, Shri Khushalani stated that at present they do not have any export orders and market survey is being undertaken. M/s. Harsh Global, is an approved unit for manufacturing activity of Gutkha, Khaini, Zarda, Pan Masala, Chewing Tobacco and preparation containing chewing tobacco in KASEZ vide Letter of Approval No. 16/201920 dated 23.12.2019 issued vide F.No.KASEZ/IA/16/2019-20, as amended.

Now the said unit has requested for addition of two products under manufacturing activity in their existing LoA. Shri Ranu Jain, Partner of the firm explained their proposal. Shri Jain informedthat they are in KASEZ for manufacturing of tobacco & filter products and now they have got inquiry for white tobacco with nicotine & nicotine pouches for export purpose. The Committee asked the partner of the firm about the turnover of their unit, additional investment & present employment & proposed employment. In reply, Shri Jain stated that their turnover is about Rs. 3-4 crores and the investment proposed for the new products will be about Rs. 70 to 80 lakhs and presently they employ about 20-30 people and the proposed employment with additional manufactured products will be about 20 people. The Approval Committee after due deliberation decided to approve the proposal for addition of two items in manufacturing activity in their existing LoA (subject to submission of correct ITC HS Code with regard to raw materials at Sr. No. 3, 10 & 11 of their proposal) and subject to standard terms and conditions:-

AGENDA ITEM NO. 199.2.5 Broad banding of Manufacturing Activity (Addition of new product in unit’s LoA) —- Request of M/s. Kahuna Industries Private Limited (UnitII), KASEZ.

M/s. Kahuna Industries Private Limited (Unit-II), is an approved unit for manufacturing activity in KASEZ vide Letter of Approval No. 24/2017-18 dated 01.09.2017 issued vide F.No. KASEZ/IA/24/2017-18, as amended.

Now the said unit has requested for broad-banding/addition of items in manufacturing activity in their existing LoA.

Shri Prakash Sathwara, Authorised Representative of the company explained their proposal. Shri Sathwara informed that they have submitted proposal for manufacturing of additional items in their LoA and stated that now their management has decided to broad-banded their LoA for different size of washers only. The Committee asked the representative of the firm as to whether they have confirmed orders for the proposed manufactured goods and whether they have paid the penalty imposed by this office for non-achievement of positive NFE vide Order-in-Original No. KASEZ/07/2023-24 dated 01.01.2024 imposing penalty of Rs. 79.35 lakhs or they have gone to appeal against the adjudication order.

In reply, Shri Sathwara stated that they are not having any confirmed orders in hand, however, they are in negotiations with USA & South Africa clients for export of their proposed manufactured items. Regarding payment of penalty imposed vide O-I-O dated 01.01.2024, he stated that he will confirm from the management whether they have paid the penalty or gone into appeal.

The Committee noted that the unit has submitted entire chapters of items in ITC HS for approval in respect of manufacturing items proposed and its raw materials & there is no elaboration of manufacturing items and directed the unit to submit specific list of items proposed for manufacturing and its raw materials.

Therefore, the Approval Committee after due deliberation decided to defer their proposal with direction to the unit to submit specific list of items for manufacturing activity and its raw materials for,further consideration. 9 \

AGENDA ITEM NO. 199.2.6 Addition of Items under Trading Activity - Request of M/s KKP Petchem Pvt. Ltd., KASEZ.

Now the said unit has requested for addition of one item in the Trading Activity in their existing LoA.

Shri Ramesh Shivaji Mohite, Authorised Representative of the company explained their proposal. Shri Ramesh informed that they wish to include one item in their trading activity.

The Approval Committee after due deliberation decided to approve the proposal for addition of 01 item in trading activity in their existing LoA and also subject to the following standard terms and conditions:

M/s Eco Plastics [formerly known as M/s. Anita Exports (Plastic Division)], KASEZ is an approved unit for manufacturing activity of recycling of plastic waste/scrap vide LoA No. KFTZ/IA/1628/96/1198 dated 15.05.1996, as amended. Now the unit have stated that at the time of renewal of their LoA, they were given permission for using space of their sister concern M/s. Easy Warehousing, Plot No. 246, Sector-IV, KASEZ for their authorized operations and they were advised to obtain space through e-auction. They further stated that though they have participated in e-auction multiple times, they were not able to secure any space that matched their space requirement and therefore due to space constraints they are facing acute hurdles in running their day-to-day operations which is causing them hardship in processing their time bound export orders.

Shri Harmeet Singh Kohli, Proprietor of the firm explained their proposal. Shri Kohli informed that he is Proprietor in M/s. Eco Plastics engaged in manufacturing of recycled plastics and also proprietor in M/s. Easy Warehousing engaged in warehousing activity& also PAN number of both the firms is also same. At the time of renewal of their LoA of manufacturing of recycling plastics in 2021, they were permitted to utilize the space of their sister concern unit M/s. Hence, he has requested to permit them to allow them to carry out their authorised operations of M/s. Easy Warehousing will start their authorised warehousing activity from WH-1 only and no other activity except manufacturing activity will be undertaken from WH-2. In the meantime, unit will try to get the space for their manufacturing activity.

Scrutiny of Letter of Approvals granted to Kandla SEZ units

The Committee was briefed on the issue of Letter of Approvals for different authorised activities such as manufacturing, trading and warehousing in single LoA granted to the KASEZ units and some of the units have been issued different LoAs for different activity and it was noticed that many of the KASEZ units are not adhering to the condition that the unit shall maintain separate accounts for manufacturing, trading and warehousing service activity and earmark separate space for all the activities with provisions of CCTV & other equipments and also not submitting separate APRs for their manufacturing, trading and warehousing service. Therefore, to streamline and take a uniform approach for all the KASEZ unitsthe same is placed before the Approval Committee for further deliberations.

The Approval Committee after due deliberations decided to defer the proposal and directed the DC office to examine the single LoA granted for manufacturing, trading and warehousing after taking into consideration the activities undertaken by such units including NFE monitoring, APR data for last 5 years for different activity and place the matter in the next UAC for further deliberations.

The Committee also directed the DC office that the units who have been granted approval in the UAC may be given 3 weeks time to submit the requisite documents/undertaking otherwise the approval granted by the UAC will be liable for cancellation. Notwithstanding to the decisions of the Committee, if the DC Office/Approval Committee notices any instance of default in rent or pending legal proceedings as on date of decision of the Committee or any legal proceedings that may be initiated after the decision of the Committee against the unit/firm/company and/or its Proprietor/Partner/Director, which has a bearing on the decision taken/LoA issued to the firm in any manner, the LoA granted will be liable for cancellation including action
