196.1 REQUEST FOR BROADBANDING/ITEM ADDITION

AGENDA ITEM NO. 196.1.1

Request for addition of warehousing service activity in their existing Letter of Approval No. KASEZ/1IA/010/2015-16 dated 08.09.2015 for Manufacturing and Trading Activity, as amended issued to M/s. Shrine Chemicals Pvt. Ltd., KASEZ

M/s Shrine Chemicals Pvt. Ltd., Plot No. 504, New Area, Phase -— II, Kandla Special Economic Zone, is an approved unit for Manufacturing (Blending) Activity of Chemicals and Trading Activity of 45 items vide LoA No. F. No. KASEZ/IA/010/2015-16 dated 08.09.2015, as amended from time to time.

Now the said unit has requested for addition of warehousing service activity in their existing LoA and submitted the list of items for warehousing service activity.

Ms. Babita Seli, Director of the company explained their proposal. Ms. Seli informed that they have an existing unit in KASEZ for blending and trading of chemicals and mainly for export purpose. Now, they wish to include warehousing service activity in their existing LoA on behalf of their foreign clients and the warehoused goods will mainly be for exports and about 95% warehoused goods will be exported.

The Committee asked the Director about the turnover of their unit in KASEZ last year, revenue generated from their manufacturing & trading activity and area available in KASEZ. In reply, Ms. Seli stated that their last year turnover was about Rs. 15-16 crores and revenue generated is mainly from trading activity and they have space of 3200 sq. mtrs./plot wherein they have ready infrastructure. Out of the present area, they will utilize about 8000-9000 sq. ft. area for their proposed warehousing activity. She further stated that they have PESO licence and other licences & necessary infrastructure and funding to enhance their business and increase value addition by inclusion of warehousing service activity.

The Approval Committee after due deliberation decided to approve the proposal for addition of warehousing service activity (subject to unit submitting KYC of their clients alongwith ITR of last 3 years on whose behalf they will warehouse goods) in their existing LoA and also subject to the following standard terms and conditions and also subject to verification regarding the compliance with regard to demarcation, etc.: i) None of the items which are restricted or prohibited will be allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.

AGENDA ITEM NO. 196.1.2

Request for addition of items under trading activity in their existing Letter of Approval - M/s. Marvel Fragrances Company, KASEZ. M/s. Marvel Fragrances Company, KASEZ is an approved unit for manufacturing activity in Kandla Special Economic Zone with LOA No. KASEZ/IA/015/2007-08 dated 02.08.2007, as amended from time to time. Now the said unit has requested for addition of trading activity in their existing LoA and submitted the list of items for trading activity. Shri Sunil Ahuja, Partner of the firm through virtual mode and Shri Ramesh Chauhan, Manager of the firm explained their proposal. Shri Ahuja informed that they have requested for broad-banding of their LoA as their business has grown up by 200% and they have also set up an EOU unit in Anjar District, which is on the Mundra Highway and is in initial stage to commence their activity as an EOU. Now, they want to include trading activity in their existing manufacturing activity. The purpose of including trading activity in their existing LoA is that in case of emergency at their | X\

The Committee asked the Partner that there was no clarity in the proposal submitted by the unit vide their letter dated 20.11.2023 and what has been said by the Partner during the interaction in the meeting and directed the Partner to make a proposal accordingly for inclusion of Trading activity as elaborated by him in the meeting as the proposal submitted by them is ambiguous. In reply, Shri Ahuja stated that there was mistake in planning of raw materials in their EOU unit which will take some more time to arrive and they have surplus raw materials available in their KASEZ unit which they want to transfer to their EOU unit on urgent basis so that production activity of EOU unit is not hampered.

Therefore, the Approval Committee. after due deliberation decided to defer their proposal with direction to the unit to submit revised proposal for addition of trading activity of what exactly they want along with shipment and orders in their EOU unit which will be taken up for consideration in the next UAC. Further, in the meantime, if they have any urgent transfer of their materials from KASEZ unit to EOU unit, then they can submit the same to DC office for its consideration till their proposal of trading activity is considered by the Committee.

Addition of Items under Trading Activity - Request of M/s Oswal Tradex, KASEZ.

M/s. Oswal Tradex, KASEZ is an approved unit with LoA dated 29.11.2010 issued from F. No. KASEZ/IA/030/2010-11 for manufacturing and free trade and warehousing service activity, as amended.

Now the said unit has requested for addition of one item in the Trading Activity.

Shri Pritesh Parekh, Partner of the firm explained their proposal. Shri Parekh informed that they are in KASEZ for manufacturing and now have requested for addition of one item for trading activity in their existing LoA. He further stated that they have export market in China and Europe for trading of castor oil and their sister concern unit in KASEZ is already in the same business. He also stated that to start with the trading activity of castor oil, they will take on rent some tanks in KASEZ and then do it on their own. He further stated that the export cargo will be filled in Flexi Tanks of 25,000 Kgs. each and then exported.

The Approval Committee after due deliberation decided to approve the proposal for addition of trading activity in their existing LoA and also subject to the following standard terms and conditions:

Addition of Item under Manufacturing Activity in their existing LoA - Request of M/s. Milak Warehouse, KASEZ.

M/s Milak Warehouse, KASEZ is an approved unit with LoA No. 1836/2001-02 dated 10.08.2001, for Trading, Manufacturing and Warehousing service activity etc, subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.

activity. He further informed that they propose to have manufacturing extension of packing line in their existing unit and they are already in corrugation activity in KASEZ and also outside KASEZ. He further stated that currently the existing space available will suffice and if need be they will also take additional space. He also informed that in their other unit in KASEZ they are having 3 lines for 3 ply auto plant for corrugated boxes, etc. and now they want to add manufacturing of packaging items in this existing unit.

The Committee asked the Partner of the firm about the space required for manufacturing activity proposed and also they have to obtain compulsory registration under PIMS & manpower generation & revenue generation from this manufacturing activity proposed. In reply, Shri Milak stated that they have 1,00,000 sq. ft. area in their unit out of which 20,000 sq. ft. area will suffice for the proposed manufacturing activity and they have already earmarked one warehouse area only for manufacturing and they will give employment to about 80 persons. With regard to revenue generation, he stated that presently revenue generated is Rs. 25 crores and with the addition of proposed manufacturing activity the revenue generation will be additional by Rs. 10 crores. The Approval Committee after due deliberation decided to approve the proposal for addition of items in manufacturing activity (subject to unit submitting specific list of items at Sr. No. 1 in raw materials list of their proposal which will be kept for record purpose by DC office) in their existing LoA subject to standard terms and conditions and also subject to verification regarding the compliance with regard to demarcation, etc.:-

Addition of items in Trading and Warehousing Activity in their existing LoA — Request of M/s. Milak Warehouse, KASEZ.

M/s Milak Warehouse, KASEZ is an approved unit with LoA No. 1836/2001-02 dated 10.08.2001, as amended for Trading, Manufacturing and Warehousing service activity etc, subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.

Now the said unit has requested for addition of items in trading & warehousing activity in their existing LoA.

Shri Vivek Milak, Partner of the firm explained their proposal. Shri Milak informed that they want to add some items in their trading and warehousing service activity.

In reply, Shri Milak stated that they already have cold storage facility as they were dealing in agro products. He also stated that they also have USFDA approval for storage of items which is the first unit in KASEZ having such approval.

Broad banding of Manufacturing Activity (Addition of 05 new products in unit’s LoA) and addition of Trading Activity of chemical and solvents, plastic items and installation & operation of Weighbridge in their existing LoA of manufacturing activity and warehousing service activity - Request of M/s Shreeji Exports, KASEZ.

M/s. Shreeji Exports, KASEZ is an approved unit for manufacturing of Plastic goods/articles by blending of virgin material by injection/blow moulding, fabrication and extrusion process and warehousing service activity in KASEZ vide LoA No. KFTZ/IA/1563/95/5561 dated 20.07.1995, as amended.

He further stated that they have one Terminal in Deendayal Port Trust, Kandla of 1.25 lakh capacity for storage of chemicals. Now, they propose to set up a manufacturing activity for thinner, self adhesive tapes and corrugated boxes, also trading activity of chemicals & solvents and plastic items and also weighbridge facility in their existing LoA. He further stated that for drumming facility of chemicals, they will procure materials from their DPT terminal on bond-to-bond transfer and if need be the same will be imported also, will do drumming in KASEZ unit and then the same will be exported. He further said that regarding tapes and corrugated boxes, there is huge demand by units in KASEZ. He further Stated that they have area of about 16,270 sq. mtrs. out of which 10,000 sq. mtrs. area is being utilized for warehousing and in the balance area of 6,270 Sq. mtrs. they propose to set up manufacturing and trading activity. He further stated that they also propose to install a weighbridge for their own inhouse requirement and to provide services to other units within KASEZ. The project cost for the proposed manufacturing, trading and weighbridge will be Rs. 375 lakhs.

Intimation of change in Partnership deed of M/s. Shri Khatushyam Tradelinks, KASEZ.

M/s. Shri Khatushyam Tradelinks, is an approved unit for warehousing service and trading activity in KASEZ. The unit have been granted Letter of Approval No. KASEZ/IA/31/2020-21 dated 28.12.2020, as amended. Now the said unit has intimated regarding change in partners of the firm wherein one Partner has retired from the firm and one new Partner has joined the firm and submitted copy of partnership deed (Deed of Admissioncum-Retirement) dated 18.10.2023 & also copy of partnership deed dated 18.10.2023 wherein new partner has been admitted and also submitted copy of Form-G issued from Registrar of Firms, Gandhidham regarding change in partnership deed.

He further informed that presently they are doing warehousing of polymers in their warehousing LoA and they have 3 sheds —- Shed No. 304, 305 & Plot No. 408 where they constructed shed wherein in Shed No. 305 they will do drumming of chemicals as the business in polymers have been less and in other sheds they are already doing manufacturing of plastic items wherein they have got separate LoA for plastic scrap recycling. He further stated that they procure chemicals from local market which will arrive in their premises through tankers and then they will do drumming activity and pack them in 200 Itrs. He informed that their proposal for warehousing of salts was discussed in the last UAC wherein their proposal was deferred and the UAC has directed them to submit complete project proposal for the items which they have now submitted and requested to permit them warehousing of salt which will be sourced from India and exported to Dubai. The Committee noted that salt being sensitive item is not being permitted by the UAC since June’2021 and also there are instances noticed in the recent past of powdery substances and therefore the proposal required detailed examination.

Request for DTA clearance of goods permitted in the existing LoA - Request of M/s. Sujan Oil & Gas Infra Logistics, KASEZ.

M/s. Sujan Oil & Gas Infra Logistics, KASEZ is an approved unit vide Letter of Approval No. KASEZ/IA/023/2009-10 dated 22.10.2009, as amended, for warehousing activity of Oil Exploration activity related equipments, petroleum products & chemicals, M.P. Diol, 41 items of Chapter 15 and trading activity of Technical/Industrial Grade Urea and all Fertilizers of Chapter 31. Now the said unit has requested for permission for DTA clearance of goods permitted in their existing LoA. Shri Vivin Mathew, Deputy Manager of the firm explained their proposal. Shri Mathew informed that they are in KASEZ for warehousing service activity since 2009 and commenced their activity from 2013. Now their clients on whose behalf they are doing warehousing for export purpose wants to do DTA sale of subject goods approved in their LoA. The Committee asked the representative of the unit why they want to do DTA sale now as they have been granted LoA in 2009 and in subsequent amendments in LoA one of the conditions imposed was no DTA sale. In reply, Shri Mathew stated that the clients on whose behalf they are doing warehousing now also requires DTA sale and hence they have requested for DTA clearance of goods permitted in their existing LoA. He further stated that the units in KASEZ which are having permissions for petroleum products & chemicals are allowed DTA clearance of goods.

The unit vide their letter dated 30.11.2023 informed the DC office that due to unavoidable circumstances the Director is unable to attend the UAC and requested to take up the matter in next UAC. Therefore, the Approval Committee after due deliberation decided to defer the proposal. 21. \

Further, the Committee deliberated on the issue of proposals received in the UAC meeting for consideration and the Committee directed the DC Office that a Circular to the effect that from 01.01.2024 all the KASEZ unit holders and prospective entrepreneurs may be requested to submit their proposals which are to be taken up for consideration in the UAC meetings of KASEZ through SEZ online mode only and no manual proposals will be accepted and only proposals received in online mode will be accepted & taken up for consideration in the Unit Approval Committee meetings of KASEZ.

Notwithstanding to the decisions of the Committee, if the DC Office/Approval Committee notices any instance of default in rent or pending legal proceedings as on date of decision of the Committee or any legal proceedings that may be initiated after the decision of the Committee against the unit/firm/company and/or its Proprietor/ Partner/Director, which has a bearing on the decision taken/LoA issued to the firm in any manner, the LoA granted will be liable for cancellation including action under the FT (D&R) Act and necessary action will be taken against such units in terms of applicable provisions of law.
