Minutes of the last meeting of Approval Committee were confirmed.

181.1 NEW UNIT APPLICATION AGENDA ITEM NO. 181.1.1 Application for setting up of a Manufacturing and Warehousing Service unit in KASEZ namely M/s. Shri Mahadev Ji Exports, 1st Floor, Plot No. A-104, Block-A, Wazirpur Industrial Area, Near Shri Ram Chowk, North West, Delhi – 110 052.
A proposal has been submitted by M/s Shri Mahadev Ji Exports, Delhi for setting up a new unit in Kandla SEZ for manufacturing and warehousing service activity.
The Committee noted that the applicant proposal was deferred in the last meeting and now again the applicant is not able attend the meeting due to medical emergency and accordingly decided to defer their proposal, as requested by the applicant.
AGENDA ITEM NO. 181.1.2 Application for setting up of a Trading and Warehousing unit in KASEZ namely M/s. Astoriaa Exim Private Limited, 9/2, Flat No. 303, 3rd floor, East Patel Nagar, Central Delhi, Delhi-110008.
A proposal has been submitted by M/s Astoriaa Exim Private Limited, Delhi for setting up a new unit in Kandla SEZ for trading and warehousing service activity.
Shri Jagat Kumar, Authorized Representative of the company appeared on behalf of the applicant and explained their proposal. Shri Kumar informed the Committee that they already are into the business of trading in Iron, Steel, hardware items, readymade garments, etc. He further stated that they have experience of around 20 years in handling and refining of precious metals and jewellery making.
The Committee inquired as to whether they have any MoU with any nominated agency/Banks for import of precious metals for which, Shri Kumar informed the Committee that they are in discussion with banks viz. ICICI Bank, Axis Bank & Yes Bank with regard to import and warehousing of precious metals however they have not submitted any documents related to correspondence made with the said banks with regard to import & warehousing of precious metals along with their application.
The Committee noted that import of precious metals is a highly specialised business and also found that the applicant’s financial position is quite weak as evident from Income Tax returns of the Directors for the past

three years. Further the Committee noted that in spite of submitting a proposal for Warehousing of sensitive items relating to gold and silver neither of the two Directors in the company appeared before the Committee and the applicant was represented through an Authorised representative evidencing the casual and non-serious nature of the applicant. Also the Committee noted that the applicant could not produce any evidence regarding their previous experience relating to precious metal business.
Therefore, the Approval Committee after due deliberations decided to reject their proposal.
AGENDA ITEM NO. 181.1.3 Application for setting up of a Manufacturing & Trading unit in KASEZ namely M/s. G K N Chemical India Pvt. Ltd., FF-103, Ratnakar Arcade, Plot No. 62, Sector-8, Gandhidham, Kachchh, Gujarat-370201.
A proposal has been submitted by M/s G K N Chemical India Pvt. Ltd., Gandhidham for setting up a new unit in Kandla SEZ for manufacturing and trading activity.
Shri Seenivasan N, Director of the company explained their proposal and informed that they already have a proprietary concern in KASEZ and are into manufacturing & trading of chemicals. Now, they wish to diversify the business and wish to establish a new unit to manufacture 17 new products and trading unit for about 20 items.
The Approval Committee after due deliberation decided to approve the proposal for setting up a manufacturing & trading unit for chemicals subject to standard terms and conditions as under: -
i)
Any restrictions on import/export of manufacturing items and
its raw materials will apply.
ii)
None of the items which are restricted or prohibited will be
allowed
to
be
manufactured/imported/traded
and
any
restrictions on import/export of any items will apply unless
specifically permitted by the UAC.
iii)
In case of any discrepancy/mismatch between the ‘Description
of Goods’ as provided by the Unit & ‘Description of goods as per
DGFT Import Policy’, the later will prevail.
iv)
Further, the items will be subjected to the Policy Conditions
specified in DGFT’s ITC HS Code wherever applicable.
v)
The above permission is also subject to further condition that
the unit shall maintain separate accounts for Manufacturing

and trading activity and earmark separate space for both the
activities.
vi)
Further, the unit will submit separate APRs for both of their
Manufacturing and trading activities.
vii)
Further, the applicant will obtain registration/clearance/any
other mandatory requirement prescribed under any Act/Rules
from concerned agencies before undertaking of such activities.
viii)
Further, the applicant will give an undertaking that none of the
items proposed and its raw materials are falling under negative
list and if the items are found in negative list, penal action will
be initiated against them.
AGENDA ITEM NO. 181.1.4 Application for setting up of a Warehousing service activity unit in KASEZ namely M/s. Unnati Tradelinks, B-168, NU-4, Sapna Nagar, Gandhidham – 370 201.
A proposal has been submitted by M/s Unnati Tradelinks, Gandhidham for setting up a new unit in Kandla SEZ for Warehousing service activity.
Shri Jagdish Mansingh Sarsar, Proprietor of the firm explained their proposal. Shri Jagdish stated that he is working as a manager in plastic recycling units since 2005 and simultaneously providing transportation services to various units in KASEZ. Further, Shri Jagdish stated that he has inquiries from 4-5 DTA clients and now he wishes to establish an enterprise of his own to cater to these clients.
The Approval Committee after due deliberation decided to approve the proposal for warehousing service activity and subject to standard terms and conditions: -
i)
The approval is subject to the condition that the applicant
should seek a prior approval of any additional items they intend
to warehouse and submit KYC details of clients to the Office of
the
Development
Commissioner
before
undertaking
the
authorised warehousing activity.
ii)
allowed to be warehoused and any restrictions on import/export
of any items will apply unless specifically permitted by the UAC.
iii)

iv) v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed are falling under negative list and are hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
181.2 REQUEST FOR BROADBANDING/ITEM ADDITION
AGENDA ITEM NO. 181.2.1 Request for broad banding/addition of manufacturing activity in their existing Letter of Approval No. KASEZ/IA/01/2021-22 dated 30.04.2021for Warehousing Service activity, as amended issued to M/s. Varsur Impex Pvt. Ltd., KASEZ.
M/s. Varsur Impex Pvt. Ltd., is an approved unit for warehousing activity in KASEZ. The unit have been granted Letter of Approval No. 01/2021-22 dated 30.04.2021 issued vide F.No. KASEZ/IA/01/2021-22, as amended.
The said unit has, now, requested for broad-banding/addition of manufacturing activity in their existing LoA for Warehousing Service activity.
Shri Nawaz Khan Choudhary, Authorized representative of the company explained their proposal and informed that they have experience in manufacturing of Gutkha, Pan Masala, khaini, etc. and wish to start manufacturing from KASEZ to cater to export orders. Further, Shri Choudhary stated that they will be utilizing part of the existing space for the proposed manufacturing activity.
The Committee noted that the request for inclusion of manufacturing activity into existing LoA pertaining to Warehousing service activity cannot be acceded to and accordingly advised the unit to submit a separate proposal for setting up of a manufacturing unit.

The Approval Committee after due deliberation decided to reject their proposal with a direction to submit a separate proposal for setting up of a manufacturing unit.
AGENDA ITEM NO. 181.2.2 Inclusion of items in Trading/Warehousing activity – Request of M/s. Chandraganta Trading & Warehousing LLP, KASEZ.
M/s. Chandraganta Trading & Warehousing LLP is an approved unit for trading and warehousing activity in KASEZ. The unit has been granted Letter of Approval No. 02/2020-21 dated 30.06.2020, as amended.
The said unit has, now, requested for addition of 15 new items in their LoA for Trading and Warehousing service activity.
Shri Prakash P Kaknani, authorised representative of the firm explained their proposal and informed that they are getting inquiries for new items and they wish to add the same in their trading and warehousing activity. Further, Shri Prakash stated that they have experience in ship supplies and informed that they will be supplying agenda items Sl. No. 1 to 13 to foreign vessels on ports, SEZ Units, Custom Bonded warehouse, etc.
The Committee noted that in the recent past a number of units have been granted permission for trading/warehousing of liquor & allied items and also a case has been booked by the DRI in one of the units recently.
Therefore, the Approval Committee after due deliberation decided to defer the proposal and it was decided to review the performance of the present units who have been granted permission for liquor and allied products and then take a decision on new cases.
AGENDA ITEM NO. 181.2.3 Broad banding of Manufacturing Activity (Addition of two new products in unit’s LoA) – Request of M/s. Dyna Glycols Pvt. Ltd., KASEZ.
M/s. Dyna Glycols Pvt. Ltd., KASEZ, Gandhidham is an approved unit with LoA dated 31.05.2006 issued from F. No. KASEZ/IA/07/2006-07/1131 for manufacturing activity, as amended subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.
The said unit has, now, requested for broadbanding of their manufacturing activity. The unit has expressed their intention for manufacturing of two more products.

Shri Rajeev Singh, Manager of the company explained their proposal. Shri Singh explained that they wish to include two more items in their existing manufacturing activity and further stated that they have export orders in hand for the proposed items. Further, Shri Rajeev informed that they have storage and handling facilities for the proposed finished goods and raw materials. Also, he stated that they have the required permissions/licences for handling of the finished goods/raw materials wherever required.
The Approval Committee after due deliberation decided to approve the proposal for additional items in manufacturing activity subject to standard terms and conditions that the unit will comply with the conditions of the concerned agencies for storage/handling/usage of the said item and its raw materials.

be
manufactured/imported/traded
and
any
restrictions on import/export of any items will apply unless
specifically permitted by the UAC.

both the activities.

Further, the unit will submit separate APRs for each of their
Manufacturing, trading & warehousing activities.

Further, the applicant will obtain registration/clearance/any
other mandatory requirement prescribed under any Act/Rules
from concerned agencies before undertaking of such activities.
viii)

list and if the items are found in negative list, penal action will
be initiated against them.

AGENDA ITEM NO. 181.2.4 Request for broad banding of additional 04 items in their existing manufacturing activity and addition of 02 items under trading activity- Request of M/s GKN Enterprises, KASEZ.
M/s. GKN Enterprises, KASEZ is an approved unit with LoA dated 18.05.2015 issued from F. No. KASEZ/IA/04/2015-16, as amended, for manufacturing and trading activity subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.
The said unit has, now, requested for broadbanding of their manufacturing activity with 04 more products and addition of 02 items under trading activity along with their ITC HS codes. The unit has also submitted the flowchart of their manufacturing activity.
Shri N. Seenivasan, Proprietor of the firm explained their proposal. Shri Seenivasan explained that he is already working in KASEZ for manufacturing and trading activities of chemical items and now he wishes to broadband some items in manufacturing and add some items in trading activity. He further stated that they have already obtained PESO certification, fire licence, etc.
The Approval Committee after due deliberation decided to approve the proposal for addition of manufacturing activity of 04 items and addition of trading activity of 02 items in their existing LoA subject to standard terms and conditions:-
i)
Any restrictions on import/export of manufacturing items and
its raw materials will apply.
ii)
allowed to be traded and any restrictions on import/export of
any items will apply unless specifically permitted by the UAC.
This clause will have overriding effect for any approval granted
in LoA now or before.
iii)
iv)

The above permission is also subject to further condition that
the unit shall maintain separate accounts for Manufacturing
and trading activity and earmark separate space for both the
activities.

Further, the unit will submit separate APRs for both of their
Manufacturing and trading activities.
vii)
Further, the applicant will obtain registration/clearance/any
other mandatory requirement prescribed under any Act/Rules
from concerned agencies before undertaking of such activities.
viii)

list and if the items are found in negative list, penal action will
be initiated against them.
AGENDA ITEM NO. 181.2.5 Addition of new items in their LoA for Trading and Warehousing Service Activity – Request of M/s. Mission Pharma Logistics India Pvt. Ltd, KASEZ.
M/s. Mission Pharma Logistics (India) Pvt. Ltd, KASEZ, Gandhidham is an approved unit with LoA No. KASEZ/IA/1857/2001 dated 25.10.2001 as amended, for Trading Activity and Warehousing and Distribution Services of Pharmaceuticals Products namely Medicines & Disposables subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.
The said unit has now requested for addition of 38 items in the Trading Activity and Warehousing Service Activity.
Shri Vivek Milak, authorized representative of the company explained their proposal and stated that the proposed items will be exported for humanitarian projects of UNICEF and other multilateral agencies.
The Committee noted that the list of proposed items is lengthy and in some cases cover entire chapters of the ITC HS. The Committee further observed that some of the proposed items do not have a relevance with the business of the unit i.e. Pharmaceutical and allied items.
Therefore, the Approval Committee after due deliberation approved the proposal with a direction to the unit to submit specific list of items consisting of only such items which have relevance to their current trading/warehousing business.

AGENDA ITEM NO. 181.2.6 Addition of new items in their LoA for Trading and Warehousing Service Activity – Request of M/s. The Variety Impex, KASEZ.
M/s. The Variety Impex, KASEZ is an approved unit with LoA dated 09.12.2020 issued from F. No. KASEZ/IA/29/2020-21, as amended for manufacturing activity and Trading activity of (i) In shell Walnuts, (ii) In shell Almonds, (iii) Fresh Kiwi Fruit, (iv) Wet Dates, (v) Cloves and (vi) Cinnamon. Further, warehousing service activity was also included in their LoA vide this office letter dated 21.02.2022.
The said unit has, now, requested for addition of new items in their LoA for Trading and Warehousing service activity.
Shri Sunil Kumar, Proprietor of the firm explained their proposal and stated that they are receiving inquiries from foreign suppliers for proposed items and accordingly they wish to add said items in their existing LoA for trading and warehousing activity.
The Approval Committee after due deliberation decided to approve the addition of items in trading and warehousing service activity in their existing LoA subject to standard terms and conditions: -
i)
The approval is subject to the condition that the applicant
should seek a prior approval of any additional items they intend
to warehouse and submit KYC details of clients to the Office of
the
Development
Commissioner
before
undertaking
the
authorised warehousing activity.
ii)
allowed to be traded/warehoused and any restrictions on
import/export of any items will apply unless specifically
permitted by the UAC.
iii)
Further, with respect to item at Sl. no. 1 of the agenda, the
KASEZ Customs will draw the samples at the time of import
of each consignment which will be sent for analysis.
iv)
In case of any discrepancy/mismatch between the above
‘Description of Goods’ as provided by the Unit & ‘Description of
goods as per DGFT Import Policy’, the later will prevail.
v)
vi)
The above permission is also subject to further condition that
the unit shall maintain separate accounts for trading and

warehousing service activity and earmark separate space for
both the activities.
vii)
Further, the applicant will submit separate APRs for their
trading and warehousing service activities.
viii)
Further, the applicant will maintain separate stock register for
trading and warehousing which will be subject to regular
checking by the KASEZ customs authorities.
ix)
Further, the applicant will obtain registration/clearance/any
other mandatory requirement prescribed under any Act/Rules
from concerned agencies before undertaking of such activities.
x)
items proposed above are falling under negative list and are not
hazardous or require environmental clearance for storage/
transmission/handling and if the items are found in negative
list or hazardous in nature, penal action will be initiated against
them.
181.3 MISCELLANEOUS ITEMS
AGENDA ITEM NO. 181.3.1
Intimation for change in Partnership of M/s Dipi Enterprise, KASEZ
M/s Dipi Enterprise, KASEZ is an approved unit for warehousing activity and trading activity vide LoA No. KASEZ/IA/03/2015-16 dated 13.05.2015, as amended.
Now the unit has intimated retirement of one of the partners and accordingly change in shareholding pattern. The unit submitted copy of deed of retirement and “Form-G” issued by Registrar of Firms.
The Committee noted that Department of Commerce vide Instruction No. 109 dated 18.10.2021 has issued guidelines regarding change of name, change of shareholding pattern, business transfer arrangements, court approved mergers and demergers, change of constitution, change of Directors, etc. may be undertaken by the Unit Approval Committee (UAC).
Therefore, the Approval Committee after due deliberation decided to take on record the proposal of change in partnership of the firm subject to fulfilment of conditions as stipulated vide Instruction No. 109 dated 18.10.2021.
The Committee also directed to forward the case of change in Constitution to the Income Tax Department for necessary action at their end.

AGENDA ITEM NO. 181.3.2 Intimation of change in Partnership deed of M/s. R. R. Exports, KASEZ.
M/s R. R. Exports, KASEZ is an approved unit for manufacturing of Pan Masala, Zarda, Chewing Tobacco, Khaini and Pan Masala Containing Tobacco, Zarda (Gutkha), Shessa Tobacco in Kandla Special Economic Zone, Gandhidham vide LoA No. KASEZ/IA/04/2019-20 dated 13.06.2019, as amended.
Now the said unit has submitted copy of Form-G issued by Registrar of Firms, Kachchh District, Gandhidham regarding change in partnership of the firm. Further, the unit has intimated regarding change in partners of the firm wherein one Partner has retired from the firm and one new partner has joined the firm and submitted copy of deed of retirement and partnership deed.
The Committee noted that Department of Commerce vide Instruction No. 109 dated 18.10.2021 has issued guidelines regarding change of name, change of shareholding pattern, business transfer arrangements, court approved mergers and demergers, change of constitution, change of Directors, etc. may be undertaken by the Unit Approval Committee (UAC).
Therefore, the Approval Committee after due deliberation decided to take on record the proposal of change in partnership of the firm subject to fulfilment of conditions as stipulated vide Instruction No. 109 dated 18.10.2021.
The Committee also directed to forward the case of change in Constitution to the Income Tax Department for necessary action at their end.
AGENDA ITEM NO. 181.3.3 Intimation for retirement of one of the Directors and conversion of company from Private Company to Public Company – Request of M/s Inox India Pvt. Ltd., KASEZ.
M/s Inox India Pvt. Ltd., KASEZ is an approved unit for manufacturing activity vide LoA No. KASEZ/IA/023/2005-06 dated 21.10.2005, as amended.
Now the unit has intimated retirement of one of the Directors of the company and submitted certified copy of Form no. DIR-12, new list of directors w.e.f. 23.05.2022 and shareholding pattern. Further, the unit

intimated conversion of company from “Private Company” to “Public Company” and submitted self certified copy of “Fresh Certificate of Incorporation Consequent upon Conversion from Private Company to Public Company” issued by Registrar of Companies, Ahmedabad.
The Committee noted that Department of Commerce vide Instruction No. 109 dated 18.10.2021 has issued guidelines regarding change of name, change of shareholding pattern, business transfer arrangements, court approved mergers and demergers, change of constitution, change of Directors, etc. may be undertaken by the Unit Approval Committee (UAC).
Therefore, the Approval Committee after due deliberation decided to take on record the proposal of retirement of one of the directors and conversion of company from “Private Company” to “Public Company” subject to fulfilment of conditions as stipulated vide Instruction No. 109 dated 18.10.2021.
The Committee also directed to forward the case of change in Constitution to the Income Tax Department for necessary action at their end.
AGENDA ITEM NO. 181.3.4 Permission to warehouse goods on behalf of DTA/Foreign Clients - Request of M/s. Shiv Trading Co., a unit for trading and warehousing activity, KASEZ.
The Committee noted that M/s. Shiv Trading Co., KASEZ has requested for permission to warehouse 04 additional items on behalf of Foreign/DTA clients.
The Committee after due deliberation decided to permit the additional items to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

Further, with respect to item at Sr. No. 3 of the agenda, the
KASEZ Customs will draw the samples at the time of import
of each consignment which will be sent for analysis for
which a standing instruction/Circular dated 05.05.2022 is
already in force.

mandatory requirement prescribed under any Act/Rules from
concerned agencies before undertaking of such activities.

AGENDA ITEM NO. 181.3.5 Permission to warehouse goods on behalf of DTA/Foreign Clients - Request of M/s. Varsur Impex Pvt. Ltd., a unit for warehousing activity, KASEZ.
The Committee noted that M/s. Varsur Impex Pvt. Ltd. has requested for permission to warehouse 13 additional items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
Shri Nawaz Khan Choudhary, authorized representative of the company explained their proposal. He informed that they propose to warehouse products on behalf of their clients.
The Committee after due deliberation decided to permit the items except items at Sr. No. 1, 5, 6, 11 & 12 of the Agenda to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

AGENDA ITEM NO. 181.3.6 Permission to warehouse goods on behalf of DTA/foreign client – Request of M/s. Aditya Exports, KASEZ.
The Committee noted that M/s. Aditya Exports has requested for permission to warehouse 01 additional item to be warehoused in KASEZ on behalf of DTA/Foreign clients.
Shri Sanjeev Roy, manager explained their proposal. He informed that they propose to warehouse product on behalf of their clients.
The Committee noted that the subject item is sensitive in nature and is not being permitted for warehousing, as a matter of policy decision of UAC.
Therefore, the Approval Committee after due deliberation decided to reject their proposal.
AGENDA ITEM NO. 181.3.7 Request for addition of items in Warehousing Activity in their existing LoA No. 16/2015-16 dated 02.02.2016 issued to M/s. Central Warehousing & Trading, KASEZ.
The Committee noted that M/s. Central Warehousing & Trading has requested for permission to warehouse 01 additional item to be warehoused in KASEZ on behalf of DTA/Foreign clients.
The Committee after due deliberation decided to permit the item to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

AGENDA ITEM NO. 181.3.8 Permission to warehouse goods on behalf of Overseas/ DTA client – Request of M/s. OSGL Overseas, KASEZ.
The Committee noted that M/s. OSGL Overseas has requested for permission to warehouse 11 additional items to be warehoused in KASEZ on behalf of DTA/Foreign clients.

The Committee noted that M/s. Shanky Petroleums has requested for permission to warehouse 17 additional items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
The Committee after due deliberation decided to permit the items, except item at Sr. No. 8 of the Agenda, to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

Clients - Request of M/s. Shri Khatushyam Tradelinks, a unit for warehousing service and trading activity, KASEZ.
The Committee noted that M/s. Shri Khatushyam Tradelinks has requested for permission to warehouse 04 additional items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
The Committee after due deliberation decided to permit items except item at Sr. No. 4 of the Agenda, to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients. The unit will indicate the specific items to be imported for warehousing purpose in respect of item at Sr.no.1 of the Agenda. The permission would be subject to following conditions:

AGENDA ITEM NO. 181.3.11
Subject:- Request of M/s. Ashmeer Global, KASEZ for permission to
import of Betel Nut/Areca Nut for authorized operation.
M/s Ashmeer Global, KASEZ is an approved unit for manufacturing of Gutkha, Pan Masala, Flavoured Chewing Tobacco & Scented Khaini etc. in Kandla Special Economic Zone, Gandhidham vide LoA No. 07/2015-16 dated 23.05.2016, as amended.
Now, the unit has requested to grant permission for import of items for their authorized operation. The unit has informed that cost of imported subject goods is quite cheaper than in domestic market. They have requested for said permission so as to achieve price competitiveness. Further, unit submitted details of their Import, Export and DTA Sale for last 04 years.
The Committee noted that the unit’s performance with regard to exports is quite low and accordingly asked the unit to improve their export turnover and then to come up with their proposal.
Accordingly, the Approval Committee after due deliberation decided to reject their proposal with a direction to improve their export turnover and then to come up with their proposal.
AGENDA ITEM NO. 181.3.12 Amendment to condition stipulated in LoA – Request of M/s Bluebird Bizglobe (OPC) Private Limited, KASEZ
M/s Bluebird Bizglobe (OPC) Private limited, KASEZ is an approved unit for trading activity vide LoA No. KASEZ/IA/01/2022-23 dated 04.04.2022. As per records, the unit is yet to commence authorized operations.
Now, the unit has requested to amend condition no. (xxv) of the LoA No. 01/2022-23 dated 04.04.2022 issued to them to include supplies to SEZ Units within the state and outside the state.

The Committee noted that M/s. Flamingo Logistics has requested for permission to warehouse 02 additional items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
Shri Kiran Singh Kochar, partner of the firm explained their proposal. He informed that they propose to warehouse products on behalf of their clients.
The Committee noted that there is safeguard duty is leviable on these items.

TABLE AGENDA ITEM NO. 181.4.1 Intimation of change in Directors – Request of M/s. AADK Petroleum Private Limited, KASEZ, Gandhidham.
M/s. AADK Petroleum Private Limited, KASEZ is an approved unit for trading activity vide LoA No. KASEZ/IA/96/796/Vol. I dated 24.07.2007, as amended. This unit was earlier known as M/s Global Commodities Trading Impex and in 165thUAC its name was changed as M/s. AADK Petroleum Private Limited. The said unit had intimated regarding change in Directors of the company wherein both the existing directors have retired from the company

and two new Directors were inducted in the company w.e.f. 08.05.2021. Further, the unit had submitted copy of Form No. DIR-12 issued for particulars of appointment of directors and the key managerial personnel and the change among them. The Committee noted that Department of Commerce vide Instruction No. 109 dated 18.10.2021 has issued guidelines regarding change of name, change of shareholding pattern, business transfer arrangements, court approved mergers and demergers, change of constitution, change of Directors, etc. may be undertaken by the Unit Approval Committee (UAC).
Therefore, the Approval Committee after due deliberation decided to take on record the proposal of change in directors of the company subject to fulfilment of conditions as stipulated vide Instruction No. 109 dated 18.10.2021.
The Committee also directed to forward the case of change in Constitution to the Income Tax Department for necessary action at their end.
Notwithstanding to the decisions of the Committee, if the DC
Office/Approval Committee notices any instance of default in rent or
pending legal proceedings as on date of decision of the Committee or
any legal proceedings that may be initiated after the decision of the
Committee
against
the
unit/firm/company
and/or
its
Proprietor/Partner/Director, which has a bearing on the decision
taken/LoA issued to the firm in any manner, the LoA granted will be
liable for action, including cancellation under the FT (D&R) Act and
necessary action will be taken against such units in terms of applicable
provisions of law.
