180.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 180.1.1

Application for setting up of a Manufacturing unit in KASEZ namely M/s. Logical Exim LLP, Office No. 102, 1st Floor, B Wing, Crystal Plaza, Opp. Infinity Mall, Off Link Road, Andheri West, Mumbai - 400053. A proposal was submitted by M/s Logical Exim LLP, Mumbai for setting up a unit in Kandla SEZ for manufacturing activity. Shri Kiran Singh Kochar, Authorised Representative of the firm explained their proposal and informed that their proposal was deferred in the last UAC. In compliance with the directions issued in last UAC, they have, now, submitted CA certified Net worth certificates of both the Partners of the firm and in-principle sanction letter for sanction of loan of Rs. 5.00 crores. The Approval Committee observed that the list of raw materials submitted by the applicant is lengthy and not in line with that of other working units of SEZ, which are into manufacturing the similar goods. In response, Shri Kochar explained that their target market includes U.S., U.K. and Europe etc. and also stated that despite being more number of raw materials some of them will be used in small quantities based on production requirements. Further, Shri Kochar stated that all the raw materials will be procured indigenously and no import is envisaged.

Further, the Committee observed that some of the raw materials need further clarification with regard to their use in manufacturing of proposed finished goods and accordingly advised the applicant to prune the list of raw materials.

The Approval Committee, after due deliberations, approved the proposal, subject to the Applicant submitting the pruned list of raw materials and also subject to standard terms and conditions for such units which, inter-alia, include “no DTA Sale/clearance of any goods and no import of Betel nuts (supari)” and also subject to furnishing an affidavit/undertaking for use of plastic packaging as detailed under Item No. 117.1.2 in terms of the Apex Court’s judgement.

  • i) Any restrictions on import/export of above items and its raw materials will apply.

  • ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

  • iil) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable. : \a

iv) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 180.1.2

Application for setting up of a unit in KASEZ namely M/s. Euronic Impex LLP, Office No. 15, 2.4 Floor, Mohid Heights, RTO Lane, Four Bunglow, Lokhandwala, Andheri West, Mumbai - 400053.

A proposal was submitted by M/s Euronic Impex LLP, Mumbai for setting up a unit in Kandla SEZ for manufacturing activity.

Shri Kiran Singh Kochar, Authorised Representative of the firm explained their proposal and informed that their proposal was deferred in the last UAC. In compliance with the directions issued in last UAC, they have, now, submitted CA certified Net worth certificates of both the Partners of the firm and in-principle sanction letter for sanction of loan of Rs. 5.00 crores.

The Approval Committee observed that the list of raw materials submitted by the applicant is lengthy and not in line with that of other working units of SEZ, which are into manufacturing the similar goods. In response, Shri Kochar explained that their target market includes U.S., U.K. and Europe etc. and also stated that despite being more number of raw materials some of them will be used in small quantities based on production requirements. Further, Shri Kochar stated that all the raw materials will be procured indigenously and no import is envisaged.

AGENDA ITEM NO. 180.1.3

Application for setting up of a Warehousing unit in KASEZ namely M/s. Global Hub Exim, Shop No.-217, Silver Arc, Plot No.-57, Sector-08, Gandhidham, Kachchh-370201.

A proposal was submitted by M/s Global Hub Exim, Gandhidham for setting up a new unit in Kandla SEZ for Warehousing service activity. their Shri Vaibhav Baid, Authorised Representative of the firm explained proposal and informed that their proposal was deferred in the last UAC till the DRI issues with regard to their sister concern are resolved. Further, Shri Baid stated that the proposed unit is promoted by a separate partnership firm which is not related to their sister concern unit. Further, Shri Baid informed that the show cause notice issued to their sister concern unit is kept in call book/abeyance by the Office of the Commissioner of Customs, Kandla and produced evidence to this effect.

The Committee observed that the list of items proposed are vague/covering entire chapters and accordingly advised the applicant to submit pruned/specific list of items.

The Approval Committee after due deliberation decided to approve the proposal for warehousing service activity (subject to applicant submitting specific list of warehousing items) and also subject to standard terms and conditions: -

  • i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

  • ii) None of the items which are restricted or prohibited will be allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.

AGENDA ITEM NO. 180.1.4

Application for setting up of a Trading and Warehousing unit in KASEZ namely M/s. Galaxy Traders, 4994/10, Ground floor, School Wali Gali, Rui Mandi, Sadar Bazar, Delhi - 110006.

A proposal was submitted by M/s Galaxy Traders, Delhi for setting up a new unit in Kandla SEZ for Trading and Warehousing service activity.

Shri Gagan Aneja, Proprietor of the firm explained their proposal. Shri Aneja stated that they propose to set up a trading and warehousing unit in KASEZ. Further, Shri Aneja stated that they are already in business of Trading and now to expand the business and to cater larger market area and for lower operational/logistic cost they want to avail the benefits of SEZ scheme.

The Approval Committee after due deliberation decided to approve the proposal for trading activity and warehousing service activity and subject to standard terms and conditions: -

  • i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

  • ii) None of the items which are restricted or prohibited will be allowed to be traded/warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.

  • iii) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

  • vii) Further, the applicant will give an undertaking that none of the items proposed are falling under negative list and are hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 180.1.5

Application for setting up of a Manufacturing and Warehousing Service unit in KASEZ namely M/s. Shri Mahadev Ji Exports, 1st Floor, Plot No. A-104, Block-A, Wazirpur Industrial Area, Near Shri Ram Chowk, North West, Delhi - 110 052.

A proposal was submitted by M/s Shri Mahadev Ji Exports, Delhi for setting up a new unit in Kandla SEZ for manufacturing and warehousing service activity. Nobody appeared before the Committee to explain the proposal. Therefore, the Committee decided to defer their proposal.

180.2 REQUEST FOR BROADBANDING/ITEM ADDITION

AGENDA ITEM NO. 180.2.1

Request of M/s Aum Solvchem, KASEZ for addition of items in their warehousing service activity and Trading activity in their existing LoA.

M/s Aum Solvchem is an approved unit with LoA No. 14/2019-20 dated 19.12.2019 for trading activity subject to certain terms and conditions enumerated in the aforesaid Letter of Approval. Their LoA was further broad-banded vide this office letter dated 09.11.2020 for addition of warehousing activity for 29 items. The said unit has, now, requested for permission for addition of items in their trading as well as warehousing service activity in their existing LoA.

Shri Harpal Devda, Authorised Representative and Commercial Manager of the unit explained their proposal. Shri Devda stated that they wish to add some items for trading and warehousing activity in their existing LoA. 6 ..

The Approval Committee observed that the proposed goods are hazardous and toxic in nature and accordingly, enquired about the storage and handling facilities available with the unit. In response, Shri Devda stated that they have enough space and storage facility to safely store and handle the proposed goods and further informed that the goods i.e. Methanol will be stored in drums and they have got M.A.2 (Prohibition licence Ethanol & Methanol Registration) licence for a quantity of 1500 MT.

The Approval Committee after due deliberation decided to approve the proposal of additional items for trading activity and warehousing service activity in their existing LoA. The approval shall also be subject to inspection of the facility with regard to storage and handling of the proposed goods and also subject to the following terms and conditions:

  • i) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

  • ii) None of the items which are restricted or prohibited will be allowed to be traded/warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before.

  • iil) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

  • iv) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.

  • v) Further, the applicant will submit separate APR for their trading and warehousing service activities and will submit architectural design for earmarking of space for Trading and warehousing activities.

  • Vi) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities.

  • vii) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/ transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them. : | “\ ;

AGENDA ITEM NO. 180.2.2 Request for addition of Trading activity in their existing Letter of Approval No. KASEZ/1IA/036/2006-07 dated 22.03.2007 for manufacturing activity, as amended issued to M/s Timbmet Door Solutions Private Limited, KASEZ

unit M/s Timbmet Door Solutions Private Limited, KASEZ, is an approved for Manufacturing Activity of Doors made of particle Board, MDF Board, Veneers and Doorsets made of particle Board, MDF Boards, Veneers vide LoA No. F. No. KASEZ/IA/036/2006-07 dated 22.03.2007 as amended. The said unit has now requested for permission for addition of trading activity in their existing LoA.

their Shri Anand Mehta, Authorised Representative of the firm explained proposal. Shri Mehta stated that they wish to add some items for trading activity in their existing LoA.

The Approval Committee observed that the proposed goods for trading are similar to the goods being manufactured by the Unit and enquired about the reasons for venturing into trading activity of same items. In response, Shri Mehta stated that post Covid-19 pandemic, the export orders have declined and to offset the losses and use the available resources optimally, they wish to enter into trading activity. Regarding trading of Veneers wherein the unit has submitted ITC HS code of the entire chapter, Shri Mehta stated that the entire chapter of ITC HS codes has been submitted by them as the ITC HS varies with slight difference in size and essentially the entire chapter covers the same item.

The Approval Committee after due deliberation decided to approve the proposal of addition of trading activity in their existing LoA and subject to the following terms and conditions:

  • i) None of the items which are restricted or prohibited will be allowed to be traded and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before.

  • ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of

AGENDA ITEM NO. 180.2.3 Request of M/s. Ubix Inc, KASEZ for broad-banding for process addition in manufacturing activity in their existing LoA of manufacturing activity.

M/s Ubix Inc, KASEZ is an approved unit, for Re-manufacturing activity of repairing, Reconditioning of empty Printer Cartridge and used/damaged mobile phones in Kandla Special Economic Zone, Gandhidham, vide LoA No. KASEZ/IA/31/2009-10/ dated 10.03.2010, as amended. in The said unit has now requested for permission for addition of process their manufacturing activity in their existing LoA. Shri Peyush Miglani, partner of the firm explained their proposal and informed that they wish to opt for process addition in their manufacturing activity in their existing LoA. Further, they stated that with regard to LoA issued to them, they are aware of the fact that the LoA issued to them is under second proviso to Rule 18(4)(d) of the SEZ Rules, 2006 wherein no DTA sale is allowed of the refurbished/reconditioned items as well as the scrap, remnants and waste generated during the process and their manufacturing activity is subject to the condition of one-to-one correlation between imports and exports. Further, he added that their target market is exports only and they are not envisaging DTA sales. The Approval Committee after due deliberation decided to approve the proposal of process addition in manufacturing activity of proposed items subject to standard terms and conditions and also subject to the condition that exports shall have one-to-one correlation with imports and all the reconditioned or repaired or re-engineered products and scrap or remnants or waste shall be exported and none of these goods shall be allowed to be sold in the Domestic Tariff Area or destroyed as provided in the second proviso to Rule 18(4)(d) of SEZ Rules, 2006. Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.

Varsur Impex Pvt. Ltd., KASEZ. M/s. Varsur Impex Pvt. Ltd., is an approved unit for warehousing activity in KASEZ. The unit have been granted Letter of Approval No. 01/2021-22 dated 30.04.2021 issued vide F.No. KASEZ/IA/01/2021-22 as amended. The said unit has now requested for permission for addition of manufacturing activity in their existing LoA. Nobody appeared before the Committee to explain the proposal. Therefore, the Committee decided to defer their proposal. AGENDA ITEM NO. 180.2.5 Request of M/s Transworld Furtichem Pvt. Ltd. (Unit-I), KASEZ for broad banding for additional manufacturing activity of Single Super Phosphate (SSP) in their existing Letter of Approval No. KASEZ/1A/024/2004-05 dated 26.10.2004. unit M/s Transworld Furtichem Pvt. Ltd. (Unit-I), KASEZ is an approved for Manufacturing of N.P.K. Fertilizers vide Letter of Approval No. KASEZ/IA/024/2004-05 dated 26.10.2004 amended/ extended from time to time. The said unit has now requested for inclusion of additional item in their manufacturing activity in their existing LoA.

stated Shri Lal Advani, Manager of the firm explained their proposal and that their proposal was deferred in the last UAC. Further, Shri Advani stated that the ongoing investigation by the CGST authorities is initiated against their DTA supplier and there is no tax liability attached to them, as the taxation point in GST is ‘Supply’ and stated that the tax disputes are natural to normal commercial activities and requested to consider their proposal/application positively. Further, Shri Advani informed that their exports in the last year was Rs. 190 crores and the exports will increase substantially and is expected to double if the broad-banding permission is granted to them as there is huge demand for the broadbanded item i.e. Single Super Phosphate (SSP).

The Approval Committee after due deliberation decided to approve the proposal of inclusion of additional item in manufacturing activity subject to standard terms and conditions.

AGENDA ITEM NO. 180.2.6

Addition of new items in their LoA for Trading and Warehousing Service Activity - Request of M/s. Premier Global Products, KASEZ. and M/s. Premier Global Products, KASEZ is an approved unit for Trading Warehousing service activity in Kandla Special Economic Zone vide Letter of Approval No. KASEZ/IA/06/2021-22 dated 50.06.2021, as amended.

The said unit has now requested for addition of new items in their LoA for Trading and Warehousing service activity.

The Committee noted that M/s. Flamingo Logistics, KASEZ has requested for permission to warehouse 02 additional items on behalf of Foreign/DTA clients. Shri Kiran Singh Kochar, Authorised Representative of the firm explained their proposal. Shri Kochar stated that they wish to add some items for warehousing activity in their existing LoA. item The Committee after due deliberation decided to permit the additional to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit except item at Sr. No. 2 of the Agenda subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

The Committee noted that M/s. Varsur Impex Pvt. Ltd., KASEZ has requested for permission to warehouse 10 additional items on behalf of Foreign / DTA clients.

Nobody appeared before the Committee to explain the proposal. Therefore, the Committee decided to defer their proposal.

AGENDA ITEM NO. 180.3.6

Permission for DTA sale of Mercantile goods - Request of M/s Sujan Oil & Gas Infra Logistics, KASEZ. Letter M/s. Sujan Oil & Gas Infra Logistics, KASEZ is an approved unit vide of Approval No. KASEZ/IA/023/2009-10 dated 22.10.2009, as amended, for warehousing activity of Oil Exploration activity related equipments. and Shri Ranbir Singh Vashistha, COO of the firm explained their proposal stated that their proposal was deferred in the Last UAC with a direction to submit specific list of items for which they require DTA sale facility. Further, Shri Vashistha stated that they have now submitted a list of items for which they require DTA sale facility. The Committee observed that the most of the items in said list are sensitive/toxic/hazardous/canalised and are subjected to licensing requirements by various statutory authorities. Accordingly, the Committee directed the Unit to prune the list to around 10 items which are nonsensitive.

DTA The Approval Committee after due deliberation decided to permit the sale of around 10 items only subject to unit submitting pruned list of items which are non-sensitive. AGENDA ITEM NO. 180.3.7 Cancellation of In-principle Letter of Approval granted to M/s. SGI Corporation, Delhi for warehousing service activity and trading activity.

ee The Committee noted that the request of M/s. SGI Corporation for issuance of formal LoA was processed on file wherein it has been noticed that one of the partners of M/s. SGI Corporation, Shri. Saurabh Gulati is also a Director in M/s. Kanishk Overseas Pvt. Ltd., KASEZ wherein in respect of M/s Kanishk Overseas Pvt. Ltd. penalty is still outstanding in a case of mis-declaration of the quantity of goods in the export container and removal of the impugned goods clandestinely into DTA. Therefore, it was decided by the Development Commissioner, KASEZ not to issue Formal LoA to M/s. SGI Corporation till the outstanding penalty against M /s. Kanishk Overseas is paid and the same was communicated to M/s. SGI Corporation.

In reply, M/s. SGI Corporation, Delhi submitted a request that, in case, where it is not possible to issue formal LoA they have requested to refund the lease rent already paid by them. The matter of refund of lease rent is already taken up by the DC office. dated In view of the above, the Committee noted that the in-principle LoA 14.09.2021 is liable to be rescinded. Therefore, the Approval Committee after due deliberations decided to cancel the in-principle LoA, ab initio.

TABLE AGENDA ITEM NO. 180.4.1

Request of M/s. Star World, Jamnagar for inclusion of one item in Trading activity and one item in Warehousing activity in their existing in-principle LoA for Trading and Warehousing Service activity.

M/s. Star World, Jamnagar is granted in-principle LoA dated 13.05.2022 for trading activity and warehousing service activity as approved in the 178th UAC meeting held on 29.04.2022. The said unit has now requested for inclusion of one item in Trading activity and one item in Warehousing activity in their existing LoA.

The Approval Committee after due deliberation decided to approve the addition of item in their warehousing service activity and reject the proposal for addition of item in trading activity and subject to standard terms and conditions: -

  • i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

  • ii) None of the items which are restricted or prohibited will be allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.
