174.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 174.1.1 Application for setting up of a Trading and Warehousing unit in KASEZ namely M/s. Apstergo International Pvt. Ltd., Office No. S 12, 2nd Floor, Harikrupa Complex, Plot No. 306, Ward 12B, Gandhidham – 370 201.

A proposal was submitted by M/s Apstergo International Pvt. Ltd., Gandhidham for setting up a unit in Kandla SEZ for trading and warehousing service activity.

Shri Kunal Kumar, Managing Director of the company explained their proposal. Shri Kunal explained that their proposal was deferred in the last meeting with direction to submit the income tax returns of the company alongwith documents regarding their source of funds for financing the proposed project and also details of their clients on whose behalf they propose to warehouse items. Now they have submitted the details of source of funds/net worth of Directors and IT returns of both the Directors and also submitted details of prospective clients for warehousing activity.

Shri Kunal further stated that they are having past experience in the field and are already in the business of warehousing in Mundra and recently they have ventured into timber business in the name of M/s. Apstergo Timber Co. He further stated that they will acquire land for the proposed project and will their own construction and funds required for the project will be from their own funds and if required they will take loan from the Bank.

The Committee asked the applicant to prune the list of items proposed with regard to warehousing activity and submit a revised list of items for warehousing which they actually propose to warehouse at the initial stage and also submit the details of DIN of both the Directors.

The Approval Committee after due deliberation decided to approve the proposal for trading activity and warehousing service activity (subject to applicant submitting revised list of items for warehousing) subject to standard terms and conditions: -

i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
ii) None of the items which are restricted or prohibited will be allowed to be traded/warehoused and any restrictions on

import/export of any items will apply unless specifically permitted by the UAC.
iii) The items falling under Chapter 72 & 73 will be subject to compulsory registration under Steel Import Monitoring System (SIMS). iv) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
v) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
vi) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vii) Further, the applicant will give an undertaking that none of the items proposed are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.1.2 Application for setting up of a Trading unit in KASEZ namely M/s. Loudmouth Multimedia Private Limited, 406, Cosmos Plaza, JP Road, Andheri West, Near DN Nagar Metro Station, Mumbai-400053.

A proposal was submitted by M/s Loudmouth Multimedia Private Limited, Mumbai for setting up a unit in Kandla SEZ for trading activity.

Shri Imran Khan, Director and Shri Abhishek, Authorised Representative of the company explained their proposal. Shri Abhishek stated that they are dealing in electronics items since last 8 months in Mumbai and now they propose to set up a trading unit in KASEZ as there is lot of advantages in Gujarat as there are ample infrastructure facilities, major Ports at Kandla and Mundra and also Airport connectivity. He further stated that for their proposed project of trading activity, the funds required will be from their own source and the items proposed for trading will be imported from Taiwan, Singapore, Japan, Hongkong, etc.

The Committee asked the applicant to prune the list of items proposed for trading activity and submit a revised list of only 4 items which they actually propose for trading activity at the initial stage and also submit the net worth certificate and DIN of both the Directors.

The Approval Committee after due deliberation decided to approve the proposal of trading activity (subject to applicant submitting revised list of items for trading) subject to standard terms and conditions:-

i) allowed to be traded and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.
ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iii) iv) Further, with respect to traded items requiring compulsory registration, the same will be allowed subject to compulsory registration under Chip Imports Monitoring System (CHIMS). v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/ transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.1.3 Application for setting up of a Trading and Warehousing unit in KASEZ namely M/s. Walia & Walia, Ward No. 9, House No. 1, Tehsil – UNA, Santokgarh, UNA, Himachal Pradesh – 174 301.

A proposal was submitted by M/s Walia & Walia, UNA, Himachal Pradesh for setting up a unit in Kandla SEZ for trading and warehousing service activity.

Shri Jasminder Singh Walia, Authorised Representative of the firm explained their proposal. Shri Jasminder stated that Kandla SEZ is the best place to set up unit as they can import from different parts of Asian countries and North America. He further stated that they will export to Chinese market, Bangladesh market. He also stated that they have their own company in North America where they will export their traded items.

The Committee asked the applicant as to how they will source the funds for their proposed project in KASEZ. Shri Jasminder stated that they will be bringing funds from their Canadian company and also savings funds from their Indian company. Further, the Committee also asked the applicant

to prune the list of items proposed for trading and warehousing activity and submit a revised list of around 6-8 items which they actually propose for trading and warehousing activity at the initial stage.

The Approval Committee after due deliberation decided to approve the proposal for trading activity and warehousing service activity (subject to applicant submitting revised list of items for trading and warehousing) subject to standard terms and conditions: -

i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
ii) allowed to be traded/warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.

174.2 REQUEST FOR BROADBANDING/ITEM ADDITION

AGENDA ITEM NO. 174.2.1 Request for addition of items in Trading activity in their existing Letter of Approval No. 29/2019-20 dated 09.12.2020 issued to M/s The Variety Impex and addition of Warehousing Activity in their existing LoA.

M/s. The Variety Impex, KASEZ is an approved unit with LoA No. KASEZ/IA/29/2020-21 dated 01.09.2017 for manufacturing activity and Trading activity of (i) In shell Walnuts, (ii) In shell Almonds, (iii) Fresh Kiwi Fruit, (iv) Wet Dates, (v) Cloves and (vi) Cinnamon.

The said unit has now requested for addition of new items for trading activity in their existing LoA and also addition of Warehousing Service Activity in their existing LoA.

Shri Sunil Kumar, Proprietor of the firm explained their proposal. Shri Sunil stated that they are having a cold storage unit in KASEZ for spices & dry fruits and now they propose to add some new items for trading activity and also include warehousing activity in their existing LoA.

The Committee asked the Proprietor as to whether they are following the FSSAI norms and Plant Quarantine procedure for the spices and dry fruits items. Shri Sunil stated that they are following the FSSAI norms and Plant Quarantine procedure for the food items. Further, the Committee noted that the unit has requested for 99 items for trading and warehousing and hence asked the unit to prune the list of items proposed for trading and warehousing activity which they actually propose for trading and warehousing activity.

The Approval Committee after due deliberation decided to approve the addition of items in trading activity in their existing LoA and addition of warehousing service activity in their existing LoA (subject to unit submitting revised list of items for trading and warehousing) subject to standard terms and conditions: -

i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
ii) allowed to be traded/warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.
iii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iv) v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed above are falling under negative list and are not hazardous or require environmental clearance for

storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.2.2 Addition of new items in their LoA for Trading and Warehousing Service Activity – Request of M/s. United Safeway India Pvt. Ltd., KASEZ.

M/s. United Safeway India Pvt. Ltd., KASEZ is an approved unit for Trading and Warehousing service activity vide LoA No. KASEZ/IA/35/2020- 21 dated 02.02.2021, as amended.

The said unit has now requested for addition of new items in their LoA for Trading and Warehousing service activity.

Shri Balaji Naidu, Director of the company explained their proposal. Shri Naidu stated that they are having trading and warehousing unit in KASEZ and recently they have commenced their authorised operation. He further stated that they want to add some items for trading and warehousing activity in their existing LoA.

The Committee asked the Director as to whether they are having proper storage facility for bitumen as the same is highly inflammable. Shri Naidu stated that they are having open space where they will store Bitumen and follow necessary precautions. However they do not have any fire safeguards for the same. He further stated that Bitumen will be procured from DTA and then it will be exported and sold in DTA.

Therefore, the Approval Committee after due deliberation decided to approve the proposal for trading activity and warehousing service activity except item at Sr. No. 2 & 9 of the Agenda in their existing LoA subject to the following terms and conditions:

i) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
ii) allowed to be traded/warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before.

iii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iv) v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.2.3 Addition of Items under Trading Activity – Request of M/s Jajoo Rashmi Refractories Pvt. Ltd, KASEZ.

M/s Jajoo Rashmi Refractories Pvt. Ltd., KASEZ is an approved unit for Trading Activity vide LoA No. KASEZ/IA/10/2018-19 dated 31.08.2018 as amended.

The said unit has now requested for addition of one item in their Trading Activity.

Shri Ravindra, Authorised Representative of the company explained their proposal. Shri Ravindra stated that they want to include one item in their trading activity. He further stated that the traded item will be exported.

The Committee noted that the item proposed for trading is prohibited for import and is allowed for import only on actual user basis in the manufacturing process and the unit is a trading unit and not an actual user.

Therefore, the Committee after due deliberation decided to reject their proposal.

174.3 MISCELLANEOUS ITEMS

AGENDA ITEM NO. 174.3.1 One time permission for export of used/second hand shoes accumulated out of segregation of used & worn clothing – Request of M/s. Babu International, KASEZ.

M/s. Babu International, KASEZ is an approved unit for manufacturing of Shoddy Synthetic Yarn, Shoddy Woollen Yarn, Blankets, Synthetic Pulled Fibre, Blazer Cloth and furnishing Fabrics includes an intermediate product vide LoA No. KASEZ/IA/1922/2003-04 dated 16-06- 2003, as amended from time to time.

Now the said unit has requested to grant them one-time permission for Export of 250 MT of used/second hand Shoes accumulated during the process of segregation of Worn Clothing during the last many years.

Shri Salman Sarif, Authorised Representative of the company explained their proposal. Shri Salman explained that they have received worn/second hand shoes mixed with old and used clothing which is a regular occurrence with the import consignments of worn clothing units in the SEZ. These second hand shoes have accumulated since long during the process of segregation of worn clothing. He further stated that they propose to re-export the shoes to their suppliers in USA and Canada whom they have requested to take back the same instead of disposing off the same in DTA. They have requested to allow them export of worn/used Shoes.

The Committee noted that the unit has been granted one-time permission for export of 75 MT of used/second hand shoes in the 161st UAC meeting held on 20.08.2020.

The Approval Committee after due deliberation decided to defer their proposal with direction to the unit to first come up with evidence of re- export with reference their past permission granted by UAC for export of 75 MT of used shoes and as to whether the same were actually exported or not. Further, the Committee directed the unit to submit details of the ratio of used/worn shoes accumulated as compared to the total import of worn/used clothing during the last 3 years.

AGENDA ITEM NO. 174.3.2 Permission to warehouse goods on behalf of DTA/foreign clients – Request of M/s. Cargo Care Agency, KASEZ.

The Committee noted that M/s. Cargo Care Agency has requested permission to warehouse 05 items in their unit on behalf of Foreign/DTA clients.

Shri Goda Prabhakar, Partner of the firm explained their proposal. He stated that they propose to warehouse products on behalf of their clients. He

further stated that they propose to warehouse liquor only for export on behalf of their foreign client which is a European based company.

The Committee noted that around 5 units in KASEZ are already engaged in Trading/Warehousing of liquor. The Committee directed the DC office to study the performance of the already existing units which have been permitted Trading/Warehousing of liquor before any such fresh proposals regarding liquor can be considered.

Therefore, the Committee after due deliberation decided to permit the item at Sr. No. 05 only of the Agenda to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions: -

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA issued now or before. ii) iii) iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed are falling under negative list or are hazardous or require environmental clearance for storage/ transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.3 Permission to warehouse goods on behalf of Foreign client – Request of M/s. Flamingo Logistics, KASEZ.

The Committee noted that M/s. Flamingo Logistics has requested for permission to warehouse 03 items on behalf of Foreign clients.

Shri Kiran Singh Kochhar, Partner of the firm explained their proposal. He stated that they propose to warehouse three items on behalf of their clients.

The Committee after due deliberation decided to permit the items to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit (subject to unit furnishing 8 digit ITC HS Code of the items) and subject to the unit fulfilling NFE criteria and also subject to following conditions:

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) iii) iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed falls under negative list or is hazardous or requires environmental clearance for storage/transmission/ handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.4 Permission to warehouse goods on behalf of Overseas/DTA client – Request of M/s LMP Overseas, KASEZ

The Committee noted that M/s. LMP Overseas has requested for permission to warehouse 01 item to be warehoused in KASEZ on behalf of DTA/Foreign clients.

Shri Anand Mehta, Authorised Representative of the firm explained their proposal. He stated that they propose to warehouse one item on behalf of their clients. He further stated that they will import said item and after re- packing the same will be re-exported.

The Committee after due deliberation decided to permit the item to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit and subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) Further, the item permitted for warehousing will be 100% re- exported and no DTA sale of the same will be allowed. iii) iv) v) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed falls under negative list or is hazardous or requires environmental clearance for storage/transmission/ handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.5 Addition of items in Trading Activity in their existing LoA– Request of M/s. Milak Warehouse, KASEZ.

M/s Milak Warehouse, KASEZ is an approved unit vide LoA No. 1836/2001-02 dated 10.08.2001 for Trading, Manufacturing and Warehousing service activity, as amended.

The unit has now requested for addition of new items in trading activity in their existing LoA.

Shri Vivek Milak, Partner of the firm explained their proposal. Shri Milak stated that they are doing manufacturing, trading and warehousing unit of cosmetics products in KASEZ. Now they want to add more items in their trading activity of chemicals and packing material related to cosmetics in their existing LoA.

The Approval Committee after due deliberation decided to approve the proposal for addition of items in trading activity in their existing LoA subject to the following terms and conditions:

i) allowed to be traded and any restrictions on import/export of any items will apply unless specifically permitted by the UAC.

This clause will have overriding effect for any approval granted in LoA now or before. ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iii) Further, the item at Sr. No. 6 of the Agenda is permitted subject to the condition that import of pre-blended polyol containing Group VI substances, including HCFC141b will not be permitted as per Ozone Depleting Substances (Regulation and Control) Amendment Rules, 2014.
iv) v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.6 Permission to warehouse goods on behalf of Overseas/ DTA client – Request of M/s. Naman Marketing, KASEZ.

The Committee noted that M/s. Naman Marketing has requested for permission to warehouse 01 item on behalf of DTA/Foreign clients.

Shri Goda Prabhakar, Authorised Representative of the firm explained their proposal. He stated that they propose to warehouse 01 item viz. off the road pneumatic tyres on behalf of their clients.

The Committee noted that some of the items proposed to be warehoused are falling under negative list.

The Committee after due deliberation decided to permit the item to be warehoused by the unit on behalf of DTA/Foreign clients as submitted by the unit with a direction to the unit to submit specific list of items which are not restricted/prohibited and also the specific list of vehicles where it will be used & also the details of suppliers on whose behalf they will warehouse the pneumatic tyres. This permission is also subject to the unit fulfilling NFE criteria and also subject to following conditions:

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) iii) iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed falls under negative list or is hazardous or requires environmental clearance for storage/transmission/ handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.7 Permission to warehouse goods on behalf of Overseas/ DTA client – Request of M/s. OSGL Overseas, KASEZ.

The Committee noted that M/s. OSGL Overseas has requested for permission to warehouse 04 items to be warehoused in KASEZ on behalf of DTA/Foreign clients.

Shri Swarup Shetty, Partner of the firm explained their proposal. He informed that they propose to warehouse products on behalf of their clients.

The Committee after due deliberation decided to permit the items to be warehoused by the above unit except items at Sr. No. 1 & 4 of the Agenda on behalf of DTA/Foreign clients as submitted by the unit and submission of KYC of their clients and subject to the unit fulfilling NFE criteria and also subject to following conditions:

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii)

iii) iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed falls under negative list or is hazardous or requires environmental clearance for storage/transmission/ handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.8 Permission to warehouse goods on behalf of Overseas/DTA client – Request of M/s. Presto Industries (Exports), KASEZ

The Committee noted that M/s. Presto Industries (Exports) has requested for permission to warehouse 06 items on behalf of DTA/Foreign clients.

Shri Kuruvilla Thomas, General Manager of the firm explained their proposal. He stated that they propose to warehouse products on behalf of their clients.

The Committee after due deliberation decided to permit the items to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submission of KYC of their clients and also subject to following conditions:

i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) iii) iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed are falling under negative list or are hazardous or require environmental clearance for storage/

transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 174.3.9 Permission to warehouse goods on behalf of DTA Importer/Foreign Clients - Request of M/s. Siddhi Vinayak Enterprises, a unit for manufacturing, trading and warehousing activity, KASEZ.

The Committee noted that M/s. Siddhi Vinayak Enterprises has requested for permission for three items to be warehoused in KASEZ on behalf of DTA/Foreign clients.

Shri Ashish, Authorised Representative of the firm explained their proposal. He informed that they propose to warehouse steel items on behalf of their clients.

The Committee asked the representative as to whether they have any experience in this field. The representative of the unit stated that they are not having any experience in this field and will warehousing these items first time only.

The Committee noted that steel items proposed by the unit are sensitive items and after due deliberation decided to reject their proposal.

AGENDA ITEM NO. 174.3.10 Permission to warehouse goods on behalf of DTA/Foreign client – Request of M/s. Unicorn Multimode Logistics, KASEZ.

The Committee noted that M/s. Unicorn Multimode Logistics has requested for permission to warehouse 05 items to be warehoused in KASEZ on behalf of DTA/Foreign clients.

Shri Goda Prabhakar, Proprietor of the firm explained their proposal. He stated that they propose to warehouse some items viz. off the road pneumatic tyres, non-motorised/non-battery vehicles, frames of rixa, etc. on behalf of their clients.

The Committee noted that some of the items proposed to be warehoused are falling under negative list.

The Committee after due deliberation decided to defer their proposal with direction to the unit to submit specific list of items which are not restricted/prohibited and also the specific list of vehicles/tyres where it will

be used & also the details of suppliers on whose behalf they will warehouse the pneumatic tyres/vehicles/parts.

AGENDA ITEM NO. 174.3.11 Modification in the list of items Approved to M/s Marine Time Private Limited.

The Committee noted that the proposal of M/s Marine Time Private Limited for setting up a Trading and Warehousing Service Unit for certain items was approved in the 166th UAC meeting held on 13.05.2021 and the O/o. of the Development Commissioner, KASEZ issued in-principal LoA vide letter dated 24.05.2021. The said unit has been allotted Shed No. 235, Special Type, Sector – III, Phase-I, KASEZ and the unit has now requested for issuance of formal LoA.

The Committee perused the list of items approved by the UAC in the 166th UAC meeting held on 13.05.2021 and noted that some of the items under the Trading Activity and Warehousing Service Activity are sensitive in nature.

The Committee after due deliberation decided to defer the proposal and directed the applicant to appear before the UAC in the next meeting so as to enable the UAC to decide on the modification in the list of items approved.

TABLE AGENDA ITEM NO. 174.4.1 Application for setting up of a unit in KASEZ namely M/s. SOLUSTATION, Suite 009, Bansal Estate, Plot No. 25-27, Sector – 10B, Gandhidham – Kutch – 370 201.

A proposal was submitted by M/s SOLUSTATION, Gandhidham for setting up a unit in Kandla SEZ for warehousing service activity.

Shri Devendra Bansal, Proprietor of the firm explained their proposal. Shri Bansal stated that he is partner in M/s. Commodities Trading, KASEZ but due to family dispute in that firm now he wants to start its own firm in KASEZ and hence he has submitted the new proposal for setting up a warehousing unit in KASEZ. He further stated that for the proposed project he will invest Rs. 19 lakhs which will be financed through his own funds.

The Approval Committee after due deliberation decided to approve the proposal for warehousing service activity except items at Sr. No. 4, 14 & 15 of the Agenda. This approval is subject to the applicant furnishing KYC of their clients on whose behalf they are going to warehouse goods and also subject to standard terms and conditions: -

i) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
ii) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. iii) iv) v) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed and its raw materials are falling under negative list and are hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

Notwithstanding to the decisions of the Committee, if the DC Office/Approval Committee notices any instance of default in rent or
pending legal proceedings as on date of decision of the Committee or any legal proceedings that may be initiated after the decision of the Committee against the unit/firm/company and/or its Proprietor/Partner/Director, which has a bearing on the decision taken/LoA issued to the firm in any manner, the LoA granted will be liable for action, including cancellation under the FT (D&R) Act and necessary action will be taken against such units in terms of applicable provisions of law.
