172.1 NEW UNIT APPLICATION
AGENDA ITEM NO. 172.1.1 Application for setting up of a Manufacturing and Warehousing Service unit in KASEZ namely M/s. Blaze International (Unit - II), Shed No. A- 1/292, Sector-2, KASEZ, Gandhidham.
A proposal was submitted by M/s Blaze International (Unit - II), KASEZ, Gandhidham for setting up a unit in Kandla SEZ for manufacturing and warehousing service activity.
Shri Anand Mehta, Authorised Representative of the firm explained their proposal. Shri Mehta stated that they are in KASEZ since more than 20 years for plastic recycling and agglomerates. Now they propose to set up a new manufacturing unit of various plastic items using only primary forms of plastic and also intend to start the warehousing activity of the primary forms of plastic. He further stated that they will utilise their own premises i.e. Plot No. 25, Sector – I, KASEZ for their proposed new manufacturing and warehousing service activity which is totally separate premises from their existing manufacturing activity of plastic recycling.
The Approval Committee after due deliberation decided to approve the proposal for manufacturing and warehousing service activity subject to standard terms and conditions: -
i)
Any restrictions on import/export of manufacturing items and
its raw materials will apply.
ii)
The approval is subject to the additional condition that the
applicant should seek a prior approval of any additional items
they intend to warehouse and submit KYC details of clients to
the Office of the Development Commissioner before undertaking
the authorised warehousing activity.
iii)
None of the items which are restricted or prohibited will be
allowed to be warehoused and any restrictions on import/export
of any items will apply unless specifically permitted by the UAC.
iv)
In case of any discrepancy/mismatch between the ‘Description
of Goods’ as provided by the Unit & ‘Description of goods as per
DGFT Import Policy’, the later will prevail.
v)
Further, the items will be subjected to the Policy Conditions
specified in DGFT’s ITC HS Code wherever applicable.
vi)
Further, the applicant will submit separate APR for their
manufacturing and warehousing service activities and will
submit architectural design for earmarking of space for
manufacturing and warehousing activities.

vii) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. viii) Further, the applicant will give an undertaking that none of the items proposed and its raw materials are falling under negative list and are hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
AGENDA ITEM NO. 172.1.2 Application for setting up of a Manufacturing and Warehousing Service unit in KASEZ namely M/s. New Plastomers India Ltd (Unit - II), Shed No. A-313, 320 & 321, Marshalling Yard, KASEZ, Gandhidham.
A proposal was submitted by M/s New Plastomers India Ltd. (Unit - II), KASEZ, Gandhidham for setting up a unit in Kandla SEZ for manufacturing and warehousing service activity.
Shri Jitesh Lalwani, Authorised Representative of the firm explained their proposal. Shri Jitesh stated that they are doing business in KASEZ since last 25 years in plastic recycling and agglomerates. Now they propose to set up a new manufacturing unit of various plastic items using only primary forms of plastic and also intend to start warehousing activity of plastics in primary form. He further stated that they intend to do only exports of their proposed manufactured items. He further stated that they will utilise their own premises i.e. Shed No. 313, Marshalling Yard, KASEZ for their proposed new manufacturing and warehousing service activity which is separate premises just opposite from their existing manufacturing activity premises.

172.2 REQUEST FOR BROADBANDING/ITEM ADDITION
AGENDA ITEM NO. 172.2.1
Request for addition of new items in Trading activity in their existing Letter of Approval No. 19/2018-19 dated 06.12.2018 issued to M/s Ankita Overseas, KASEZ.
M/s. Ankita Overseas, KASEZ is an approved unit for trading activity vide LoA No. KASEZ/IA/19/2018-19 dated 06.12.2018, as amended.
The said unit has now requested for addition of new items for trading activity in their existing LoA.
The Approval Committee after due deliberation decided to defer their the proposal for further examination and also directed the DC office to examine as to whether the items proposed by the unit are covered under Cigarette and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade & Commerce, Production, Supply and Distribution Act.) and the issue of packaging of tobacco products in plastic pouch.

AGENDA ITEM NO. 172.2.2 Request for inclusion of some items in their trading activity for supplying the same to Custom Bonded Warehouse/Foreign Going Ship Supply/Foreign Embassy Supply - Request of M/s Aditya Exports, KASEZ.
M/s. Aditya Exports, KASEZ is issued with LoA from F.No. KASEZ/IA/1909/2002-03 dated 03.03.2003 for trading activity of Agro Products, Plastic Products, Chemicals, Dies, Textiles, Utensils and all items except prohibited, canalized & restricted items and also for Warehousing and Manufacturing Activity, as amended.
Now the said unit has requested for inclusion of liquor in their existing trading activity for supplying the same to Custom Bonded Warehouse.
Shri Sanjeev Roy, Manager of the firm explained their proposal. Shri Sanjeev stated that they are receiving enquiry from their clients for supply to Custom Bonded Warehouse and thus they intend to include 3 additional sets of items for trading activity in the existing LoA for supply to custom bonded warehouse/Foreign Going Ship Supply/Foreign Embassy Supply.
The Committee asked the applicant as to why they wish to start the said activity in SEZ instead of supplying the same directly in the custom bonded warehouse. The representative of the unit stated that there is limitation of space in Bonded warehouses in DTA and less quantity is allowed to be stored in the custom bonded warehouse. Further they clarified that they have adequate space in their unit as they have 4 sheds in KASEZ where they can store the liquor and allied products and supply to customs bonded warehouse as per the requirements of their clients.
The Committee was informed that the unit had earlier requested for trading activity of liquor which was discussed in the UAC meeting and the same was rejected as the unit neither had the adequate storage facility for handling of liquor and allied items nor had the proper security arrangements like 24x7 guards, CCTV coverage.
The representative of the unit has stated that they have made adequate storage arrangements for storage of liquor and CCTV camera has been installed and 24x7 security arrangements have been made and requested to grant them approval of 3 sets of proposed items by them in their trading activity.

proposal of additional 3 sets of items in their trading activity subject to standard terms and conditions and subject to verification report of the Committee of two officers who will inspect the facility created by the unit for storage of liquor and allied items with regard to hygiene, temperature control and security arrangements, etc. The approval for item addition will be granted based on the report of the Committee.

any items will apply.
ii)
In case of any discrepancy/mismatch between the above
‘Description of Goods’ as provided by the Unit & ‘Description of
goods as per DGFT Import Policy’, the later will prevail.

Further, in order to ensure genuine trading business in this
commodity, the Committee directed the applicant that the unit
should have confirmed orders of the items within 3 months of
granting of this approval. The Committee further directed that
periodical review regarding functioning of the unit with regard to
the above approved items may be conducted every six months
as they are sensitive in nature.
vii)
Further, the above permission is also subject to condition that
the
same
will
be
supplied
to
customs
bonded
warehouse/Foreign Going Ship/Foreign Embassy and foreign
bound vessels calling at Indian Ports & Exports and also an
Affidavit that no DTA sale of any traded goods even if damaged
or otherwise will be allowed and if the traded goods are found to
be sold in DTA penal action will be initiated against them and
will be liable for cancellation of the above approval of trading
activity.

AGENDA ITEM NO. 172.2.3 Addition of Items under Trading Activity/Warehousing Service Activity – Request of M/s. Mission Pharma Logistics (India) Pvt. Ltd, KASEZ.
M/s. Mission Pharma Logistics (India) Pvt Ltd, KASEZ is an approved unit with LoA No.KASEZ/IA/1857/2001 dated 25.10.2001 as amended, for Trading Activity and Warehousing and Distribution Services of Pharmaceuticals Products namely Medicines & Disposables subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.
The said unit has now requested for addition of 37 items in the Trading Activity and Warehousing Service Activity in their existing LoA: -
Shri Vivek Milak, Authorised Representative of the company explained their proposal. Shri Milak stated that they are exporting pharma products in Kit combinations to UNICEF, USFPA, etc. and the proposed items which they want to include are all related to medical products.
The Approval Committee asked regarding the uses of items at Sr. No. 1, 2, 3 & 8 in the common table relating to trading and warehousing of the Agenda. Shri Milak stated that as regards Sr. No. 1, the same is used for general hygiene. As regards item at Sr. No. 2 he mentioned that the same is used in lubrication during surgery. As regards item at Sr. No. 3 he mentioned that they are in the nature of anti-infection agents. As regards the items at Sr. No. 8 it was informed that the items shall only be exported subject to prescribed conditions.

AGENDA ITEM NO. 172.2.4 Request for addition of Trading activity in their existing Letter of Approval No. KASEZ/IA/026/2006-07 dated 12.12.2006 for manufacturing activity, as amended issued to M/s Royal Petro Specialities Private Limited, KASEZ
M/s Royal Petro Specialities Private Limited, Plot No. MY-3A & 447,
Marshalling Yard and Shed No. 322, Sector No. I, Kandla Special Economic
Zone, Gandhidham, is an approved unit for Manufacturing Activity of
Automotive and Industrial lubricants, brake fluid, petroleum jelly, open gear
compound/creosote oil, pour point depressants, coolants etc. vide LoA No.
F. No. KASEZ/IA/026/2006-07 dated 12.12.2006 as amended from time to
time.
Now the unit has requested for inclusion of trading activity in their existing LoA and submitted the list of 2 items for trading activity.
Shri Vishal Ved, Authorised Representative of the company explained their proposal. Shri Ved stated that they are in the manufacturing business of lubricants and exporting the same to Middles East, Africa, Australia, New Zealand and all over the world. Now, their client have requested for HDPE & EPDM Granules which are used for making packing material and will be imported and exported along with their manufactured goods as per their overseas clients’ requirement and requested for addition of trading activity for exports in the existing LoA. He further stated that they have acquired new shed and trading activity will be undertaken by them in the newly allotted shed.

manufacturing activity and earmark separate space for trading
activity and submit map of demarcated area for trading activity.

Further, the unit will submit separate APRs for both of their
trading and manufacturing activities.

AGENDA ITEM NO. 172.2.5 Request for inclusion of some items in their trading activity for supplying the same to Custom Bonded Warehouse/Foreign Going Ship Supply/Foreign Embassy Supply - Request of M/s Vimal Trading, KASEZ.
M/s Vimal Trading, KASEZ is an approved unit for trading/warehousing service activity vide Letter of Approval F.No. KASEZ/IA/21/2016-17 dated 31.01.2017, as amended.
Now the said unit has requested for inclusion of liquor in their existing trading activity for supplying the same to Custom Bonded Warehouse/Foreign Going Ship Supply/Foreign Embassy Supply.
Shri Vivek Milak, Authorised Representative of the company explained their proposal. Shri Milak stated that they are receiving enquiry from their clients for supply to Custom Bonded Warehouse/Foreign Going Ship Supply/Foreign Embassy Supply and thus they intend to include 3 sets of

liquor items for trading activity in the existing LoA for supply to custom bonded warehouse/Foreign Going Ship Supply/Foreign Embassy Supply.

The Committee noted that the unit had earlier requested for trading activity of liquor which was earlier discussed in the UAC meeting and the same was rejected as the unit was not having adequate storage facility for storage and handling of liquor and allied items, proper security arrangements like 24x7 guard, CCTV coverage was missing.
The representative of the unit has stated that they have made the necessary changes with regards to storage and handling of liquor and CCTV camera has been installed and 24x7 security arrangements have been made and requested to grant them approval of additional 3 sets of items proposed by them in their trading activity.

172.3 MISCELLANEOUS ITEMS
AGENDA ITEM NO. 172.3.1 Intimation of change in Partnership deed of M/s Pandokhar Food LLP, KASEZ.
M/s Pandokhar Food LLP, KASEZ is an approved unit for manufacturing of Guthka, Khaini, Zarda, Pan Masala, Chewing Tobacco etc., in Kandla Special Economic Zone vide Letter of Approval No. FTZ/IA/20/2018-19 dated 26.12.2018, as amended.
Now the said unit has intimated regarding change in partners of the firm wherein Shri Sanjeev Kumar Batra has retired from the firm and Shri Vipin Sharma have been inducted in the firm and has submitted copy of Form-9, LLP Form No. 3, LLP Form No. 4 registered with MCA and copy of notarised copy of Partnership deed. The Committee noted that there is complete transfer of ownership and it was decided to call for the details of any cases/adjudications initiated by any other Departments/Agencies and any dues of other Departments/ Agencies are pending against the firm/retiring partner so as to enable the

Committee to decide on further course of action to be taken on the proposal for change in Partners of the firm.
Therefore, the Approval Committee after due deliberation decided to defer their proposal for change in Partners of the firm.
AGENDA ITEM NO. 172.3.2 Intimation of change in Registered Address & name of the Firm M/s U.S Clothing (India) Pvt. Ltd., KASEZ.
M/s U.S Clothing (India) Pvt. Ltd., KASEZ is an approved unit for manufacturing activity for reprocessing, sorting, grading, cutting, mutilation etc of used garments/ textiles/ clothes/ used clothing, in Kandla Special Economic Zone vide Letter of Approval No. FTZ/IA/1865/2001/2128 dated 31.12.2001 as amended.
Now the said unit has intimated regarding change in address of their registered office.
The Committee noted that the details of Units old name & registered office address and New name & registered office address are as under: -

The Committee noted that Department of Commerce vide Instruction No. 109 dated 18.10.2021 has issued guidelines regarding change of name, change of shareholding pattern, business transfer arrangements, court approved mergers and demergers, change of constitution, change of Directors, etc. may be undertaken by the Unit Approval Committee (UAC).
Therefore, the Approval Committee after due deliberation decided to take on record the proposal of change in Name and change in Registered Office address of the company subject to fulfilment of conditions as stipulated vide Instruction No. 109 dated 18.10.2021.

The Committee also directed to forward the case of change in Name/Constitution to the Income Tax Department for necessary action at their end.
AGENDA ITEM NO. 172.3.3 Permission to warehouse goods on behalf of Overseas/DTA client – Request of M/s. Milak Warehouse, KASEZ Gandhidham.
The Committee noted that M/s. Milak Warehouse has requested for permission to warehouse 04 items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
Shri Vivek Milak, Partner of the firm explained their proposal. He stated that they propose to warehouse goods on behalf of their clients.
The Committee after due deliberation decided to permit the items as per the Agenda to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submitting KYC of their clients and also subject to following conditions: -
i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) iii) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail. iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed are falling under negative list or are hazardous or require environmental clearance for storage/transmission/ handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 172.3.4 Permission to warehouse goods on behalf of DTA/Foreign client – Request of M/s. Aditya Exports, KASEZ.
The Committee noted that M/s. Aditya Exports, KASEZ has requested permission to warehouse 15 items in their unit on behalf of Foreign/DTA clients.
Shri Sanjeev Roy, Manager of the firm explained their proposal. He stated that they propose to warehouse products on behalf of their clients.
The Committee after due deliberation decided to permit the items to be warehoused by the above unit except items at Sr. No. 1, 2, 3 & 4 of the Agenda on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and submitting KYC of their clients subject to following conditions: -
i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. AGENDA ITEM NO. 172.3.5 Permission to warehouse goods on behalf of DTA clients – Request of M/s. Flamingo Logistics, KASEZ.
The Committee noted that M/s. Flamingo Logistics, KASEZ has requested for permission to warehouse 01 item on behalf of DTA/Foreign clients.
Shri Kiran Singh Kochhar, Partner of the firm explained their proposal. He stated that they propose to warehouse one item on behalf of their clients. He further stated that the proposed item is mobile frequency tower which they will import and export out of country on behalf of their DTA clients.
The Committee after due deliberation decided to defer their proposal for further examination and also directed the DC office to check whether the proposed items are under restrictions by the Ministry of Defence, Ministry of Home Affairs and Department of Telecommunication.
AGENDA ITEM NO. 172.3.6 Ratification of SCNs issued to Kandla SEZ units
The Approval Committee ratified the following Show Cause Notices issued by Development Commissioner, KASEZ and authorised the Development Commissioner, KASEZ to adjudicate the show cause notices issued: -

AGENDA ITEM NO. 172.3.7 Ratification of request already approved in file
The Approval Committee ratified the one time permission granted to the following unit by the Development Commissioner, KASEZ.
- M/s. Siddhi Vinayak Enterprises – one time permission granted on 02.11.2021 for Glass Beads (ITC HS 70181020) and Imitation Accessories (ITC HS 71179090) – 1 Container.

M/s. GSM Global Inc., KASEZ is an approved unit for Manufacturing activity and Trading activity vide LoA No. 05/2021-22 dated 23.06.2021, as amended.
Now the said unit has requested for inclusion of Warehousing Service Activity in their existing LoA and submitted list of items along with their ITC HS Code.
Shri Anand Mehta, Authorised Representative of the firm explained their proposal. Shri Mehta stated that they intend to include warehousing service activity also in their existing LoA for manufacturing and trading activity.
addition of warehousing service activity except items at Sr. No. 1, 2 & 7 of the Agenda in their existing LoA subject to the following terms and conditions. Further, no scrap items will be permitted for warehousing service activity:

i)
The approval is subject to the additional condition that the
applicant should seek a prior approval of any additional items
they intend to warehouse and submit KYC details of clients to
the Office of the Development Commissioner before undertaking
the authorised warehousing activity.
ii)
Further, none of the items which are restricted or prohibited will
be allowed to be warehoused and any restrictions on
import/export of any items will apply unless specifically
permitted by the UAC. This clause will have overriding effect for
any approval granted in LoA now or before.
iii)
In case of any discrepancy/mismatch between the above
‘Description of Goods’ as provided by the Unit & ‘Description of
goods as per DGFT Import Policy’, the later will prevail.
iv)
v)
The above permission is also subject to further condition that
the unit shall maintain separate accounts for manufacturing,
trading and warehousing service activity and earmark separate
space for all the activities.
vi)
Further, the applicant will submit separate APRs for their
manufacturing, trading and warehousing service activities.
vii)
Further, the applicant will maintain separate stock register for
trading and warehousing which will be subject to regular
checking by the KASEZ customs authorities.
viii)

items proposed are falling under negative list and are not
hazardous or require environmental clearance for storage/
transmission/handling and if the items are found in negative
list or hazardous in nature, penal action will be initiated against
them.

TABLE AGENDA ITEM NO. 172.4.3 Permission to warehouse goods on behalf of DTA/Foreign Clients - Request of M/s. Varsur Impex Pvt. Ltd., a unit for warehousing activity, KASEZ.
The Committee noted that M/s. Varsur Impex Pvt. Ltd. has requested for permission to warehouse 10 items to be warehoused in KASEZ on behalf of DTA/Foreign clients.
Shri Vishal, Authorised Representative of the firm explained their proposal. He informed that they propose to warehouse products on behalf of their clients.
The Committee after due deliberation decided to permit the items to be warehoused by the above unit except items at Sr. No. 1, 2, 3, 5 & 9 of the Agenda on behalf of DTA/Foreign clients as submitted by the unit and subject to the unit fulfilling NFE criteria and submitting KYC of their clients and also subject to following conditions:
i) allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. This clause will have overriding effect for any approval granted in LoA now or before. ii) iii) In case of any discrepancy/mismatch between the ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail. iv) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. v) items proposed falls under negative list or is hazardous or requires environmental clearance for storage/transmission/

handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
Notwithstanding to the decisions of the Committee, if the DC
Office/Approval Committee notices any instance of default in rent or
pending legal proceedings as on date of decision of the Committee or
any legal proceedings that may be initiated after the decision of the
Committee
against
the
unit/firm/company
and/or
its
Proprietor/Partner/Director, which has a bearing on the decision
taken/LoA issued to the firm in any manner, the LoA granted will be
liable for action, including cancellation under the FT (D&R) Act and
necessary action will be taken against such units in terms of applicable
provisions of law.
