169.1 NEW UNIT APPLICATION AGENDA ITEM NO. 169.1.1 Application for setting up of a Trading/Manufacturing unit in KASEZ namely M/s. Bhaskar Fragrannces LLP, SRC-Triangular Plot No. 20, Ward 12-B, Gandhidham, Kutch-370201.

A proposal was submitted by M/s Bhaskar Fragrannces LLP, Gandhidham for setting up a unit in Kandla SEZ for manufacturing and trading activity.

Shri Prakash Kaknani, Authorised Representative of the firm explained their proposal. Shri Prakash explained that their proposal to set up a manufacturing and trading unit in KASEZ was deferred in the last meeting with direction to submit documents supporting financial strength and also to prune the list of items for manufacturing and trading activity. He further stated that now they have submitted the details of financial strength and also pruned their list for manufacturing and trading items. He also stated that they are already in the business of tobacco products and undertaking trading of tobacco products in the name of Mari Tradelink. He further stated that their brand name “Mafaz” is already registered in 25 countries.

The Committee asked the applicant for details of trading activity proposed to be done in KASEZ. The applicant stated that for trading activity they will import goods in bulk and will do intra-zonetrading. The Committee noted that most of the items proposed to be traded were same /similar to the items proposed to be manufactured or their raw material. It was decided not to allow trading activity along with manufacturing activity.

The Approval Committee after due deliberation approved the proposal of manufacturing activity only subject to standard terms and conditions for such units which include no DTA Sale/clearance of any goods and also subject to furnishing an affidavit/undertaking for use of plastic packaging as detailed under Item No. 117.1.2 in terms of the Apex Court’s judgement. Betel nuts (supari) if imported will be consumed in their finished products for 100% exports and no job work/trading & intra-zone sale of betel nut will be allowed i.e. the same will be consumed only by the actual user.

i) Any restrictions on import/export of above items and its raw materials will apply.
ii) Betel nut/areca nut, if imported, will be consumed in their finished products for 100% exports and will not be allowed to be taken out of the Zone for Job-work/sub contracting and the applicant will install machinery for further processing of betel nut/areca nut in their factory premises. Further, the betel nut is allowed to be imported provided Import CIF value is Rs. 251/- per kg or as notified from time to time. iii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

iv) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
v) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/ transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 169.1.2 Application for setting up of a Manufacturing/Warehousing unit in KASEZ namely M/s. Beacon Brother’s, Plot No. 105, Office No.-1, 1st Floor, MVR House, Sector-1, Gandhidham, Kutch-370201.

A proposal was submitted by M/s Beacon Brothers, Gandhidham for setting up a unit in Kandla SEZ for manufacturing and warehousing service activity.

Shri Muhammed Shinan and Shri Rohit Dagar, Partners of the firm explained their proposal. Shri Shinan explained that their proposal was deferred in the last meeting with direction to submit layout plan clearly demarcating manufacturing and warehousing activity and also to submit financial strength of the partners and prune the list of items in warehousing activity. Now they have submitted the details of financial strength, layout plan and also pruned their list for warehousing activity.

The Committee asked the applicant whether they are in the business of manufacturing earlier. Shri Shinan stated that they are doing sugar manufacturing outside through third party and also reprocessing of Lumps and export.

The Approval Committee after due deliberation decided to approve the proposal for manufacturing activity and warehousing service activity of above items excluding Sr. No. 5 (Rock salt) subject to the applicant furnishing KYC of their clients on whose behalf they are going to warehouse goods and also subject to standard terms and conditions: -

i) Any restrictions on import/export of above items and its raw materials will apply.
ii) Further, the betel nut/areca nut and black pepper will not be allowed to be taken out of the Zone for job-work/sub contracting and the applicant will install machinery for further processing of betel nut/areca nut and black pepper in their factory premises. Import of betel nut is allowed provided CIF value is Rs. 251/- or more per kilogram or as notified from time to time. iii) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

iv) None of the items which are restricted or prohibited will be allowed to be warehoused and any restrictions on import/export of any items will apply unless specifically permitted by the UAC. v) vi) vii) Further, with respect to warehoused item at Sr. No. 7 the same is allowed to be warehoused subject to fulfilment of the MIP condition as prescribed under Import/Export policy.
viii) Further, the applicant will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. ix) items proposed above and its raw materials are falling under negative list and are hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 169.1.3 Application for setting up of a Trading/Warehousing unit in KASEZ namely M/s. Bapu’s Shipping Agency Private Limited, Survey No. 26/5, Nr. Gadpadar Village, NH-8, Gandhidham, Kutch-370240.

A proposal was submitted by M/s Bapu’s Shipping Agency Private Limited, Gandhidham for setting up a unit in Kandla SEZ for trading and warehousing service activity.

Shri Bhupendra Jadeja, Director of the company explained their proposal. Shri Jadeja stated that they are a 25 year old company and already having a unit in KASEZ in the name of M/s. Apex Lubricants. He further stated that their proposal was deferred in the last meeting with direction to submit a detailed layout plan showing the storage and safety arrangements in the area requested. Now theyhave submitted the layout plan of their proposed trading/warehousing service activity in KASEZ. He further stated that they are sole CFA of HPCL and for their proposed trading and warehousing service unit at KASEZ, they will supply the goods to ships supplies and ship stores.

The Approval Committee after due deliberation decided to approve the proposal for trading and warehousing service activity of above items of the firm subject to standard terms and conditions: -

i) The approval is subject to the condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.

AGENDA ITEM NO. 169.1.4 Application for setting up of a Manufacturing unit in KASEZ namely M/s. SSF Plastics India Pvt. Ltd., Khasra No. 681-682, Behind Govt. Lakkar Depot, Village Katha, Pargana Dharampur, Baddi, Tehsil Nalagarh, District – Solan, Himachal Pradesh – 173 205.

A proposal was submitted by M/s SSF Plastics India Pvt. Ltd., Solan, Himachal Pradesh for setting up a unit in Kandla SEZ for manufacturing activity.

Shri Vivek Milak, Authorised Representative of the firm explained their proposal. Shri Milak explained that that their proposal was deferred in the last meeting for further examination as the area requirement for setting up the unit was 20,000 sq. mtrs land and 10,000 sq. mtrs. built up shed and the applicant has not submitted gross income details of the promoters. He further stated that now they have submitted ITR of all their 7 Directors for last 2 years and also they have visited the ready-to-use sheds in KASEZ and including Himalaya Complex which had been constructed for warehousing units but is currently vacant as per their understanding.

Shri Milak further stated that they are having 12 manufacturing plants across India with annual turnover of Rs. 400 crores and do exports and also supply their goods across India including to M/s. Unilever India Exports Ltd., KASEZ. But, the logistics cost for supplying the same is very high and to reduce the logistic cost they have decided to set up a unit in KASEZ for catering to the needs of KASEZ units and also for export purpose. He further stated that they will supply finished goods to the tune of 15%- 20% to M/s. Unilever India Exports Ltd., KASEZ and about 80% will be exported.

The Committee asked the applicant about their plan to start the unit in KASEZ as the area requirement is more and also they will require 1550 KVA electricity and 27 KL of water per day. Shri. Milak stated that after grant of approval they will also explore other vacant space including those of

sick units. Regarding electricity connection of 1550 KVA, they have checked that HT connection is available and their water requirement of 27 KL per day is also available.

AGENDA ITEM NO. 169.1.5 Application for setting up of a Manufacturing Service and Warehousing Service unit in KASEZ namely M/s. SWG Nutraceuticals, Plot No. 48, Second Floor, Rama Road Industrial Area, Delhi, West Delhi – 110 015.

A proposal was submitted by M/s SWG Nutraceuticals, West Delhi for setting up a unit in Kandla SEZ for manufacturing service and warehousing service activity.

Shri Rattan Deep Singh, Proprietor of the firm explained their proposal. Shri Singh explained that their proposal was deferred in the 167th UAC meeting with direction to submit the compliance requirement for edible items. Now they have submitted letter dated 16.08.2021 wherein they have stated that regarding the FDA norms and compliance of the countries where they will export the manufactured goods as per the instruction of the foreign clients, their foreign clients has confirmed that they will share the qualitative details (as per the country of import) after the unit is set up along with the ingredients list and product label. First of all they will send sample product as per their client instruction and export the same to overseas, their foreign client will arrange registration and clearance of the same as per goods receiving country. Once the product is approved by the overseas country then they will start production of the said approved products.

The Committee asked the applicant as to whether they are having manufacturing unit. Shri Singh stated that they are already having a manufacturing unit of food supplement in Delhi and as the connectivity in KASEZ is good, they intend to set up the manufacturing service and warehousing unit in KASEZ. He further stated that regarding food supplements they will follow the FSSAI norms and the product name on whose behalf they are going to do manufacturing service will be Dexter Supplements and they have already submitted copy of contract as per Rule 18(6) of SEZ Rules, 2006 of their foreign client i.e. DEXTER JACKSON SIGNATURE SERIES LLC wherein the foreign client has confirmed that all the raw material/packaging material/consumables, components/Capital Goods (Machinery & Components) required for the manufacturing service activity in India will be supplied/arranged free of cost. For processing the food supplements they will receive charges in foreign exchange.

The Approval Committee after due deliberation decided to approve the proposal for manufacturing services under Rule 18(6) of SEZ Rules, 2006 and warehousing service activity of above items subject to standard terms and conditions: -

ii) The above manufacturing services proposal is also subject to strict compliances of Rule 18(6) of SEZ Rules, 2006. iii) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
iv) v) Further, with respect to manufacturing/raw materials/ warehousing of food preparation items the same is allowed subject to compliance of FSSAI norms and all other statutory compliance viz. NOC from Ministry of Health and other concerned agencies before such clearance.

AGENDA ITEM NO. 169.1.6 Application for setting up of a Warehousing and Trading unit in KASEZ namely M/s. SGI Corporation, 1720, Ground Floor & Basement Floor, Laxmi Narayan Street, Paharganj, Delhi – 110 055.

A proposal was submitted by M/s SGI Corporation, Delhi for setting up a unit in Kandla SEZ for Warehousing service and Trading activity.

Shri Saurabh Gulati, Partner of the firm explained their proposal. Shri Gulati explained that their proposal was deferred in the 167th UAC meeting with direction to the unit to submit a revised list of items which they actually intend to warehouse/trade and also submit the compliance requirements for edible items. A proposal was submitted by M/s A. P. Logistics, Gandhidham for setting up a unit in Kandla SEZ for trading and warehousing service activity.

Shri Kaki Sai Kumar, Authorised Representative of the firm explained their proposal. Shri Sai Kumar stated that they are Gandhidham based firm doing business of transport, trading and cargo clearing and now to expand their business they propose to set up a trading and warehousing service unit in KASEZ.

The Committee asked the applicant as to whether they have contacted the parties on whose behalf they will warehouse goods. The representative appeared on behalf of the applicant could not give any proper reply as to

whether they already have clients on whose behalf they will warehouse goods.

Further, the Committee also noted that the applicant has submitted items like bitumen, rock salt, beans pod, etc. for trading/warehousing and also not submitted 8 digit ITC HS code for plastic items. Therefore, the Committee requested the applicant to prune the list and submit a revised list of trading/warehousing items with 8 digit ITC HS code which they actually intend to trade/warehouse.

The Committee after due deliberation decided to defer their proposal with direction to the unit to call the proprietor of the firm in the next meeting and also submit a revised list of trading/warehousing items with 8 digit ITC HS code which they actually intend to trade/warehouse.

AGENDA ITEM NO. 169.1.8 Application for setting up of a Trading and Warehousing unit in KASEZ namely M/s. Nexon Exports Pvt. Ltd., 25L, Floor-13th, Navjeevan Society, Dr.Dadasaheb Bhadkamkar Marg, Mumbai – 400 008.

A proposal was submitted by M/s Nexon Exports Pvt. Ltd., Mumbai for setting up a unit in Kandla SEZ for trading and warehousing service activity.

Shri Manish Tomar, Director of the company explained their proposal. Shri Tomar stated that they are dealing in electronic items since last 1½ years and now they propose to set up a trading and warehousing service unit in KASEZ. He further stated that he was sales manager in one company and now he along with other Director has started their own business. He further stated that for the proposed project they will require built up space of about 700 sq. mtrs.

The Committee asked the applicant as to how they will finance the new venture in KASEZ for trading and warehousing activity as the gross income as per ITR for the AY 2021-22 was only Rs. 9.54 lakhs of both their Directors. Shri Tomar stated as of now the project will be financed from Director’s capital and finance from friends & relatives. Further, if need be they will take loan from the Bank. He further stated that they have submitted C.A. certified net worth of both their Directors.

The Committee noted that the applicant has submitted net worth of both their Directors along with their proposal and it has been noticed from the C.A. certificates that the net worth of Shri Manish Ratan Tomar as on

He further stated that for the proposed project they will require built up space of about 500 sq. mtrs.

The Committee asked the applicant as to how they will finance the new venture in KASEZ for trading activity. Shri Rathore stated as of now the project will be financed from Director’s capital. He further stated that they have submitted C.A. certified net worth of both their Directors.

The said unit vide their letter dated 13.08.2021 has requested for change of name of their units from M/s Hindprakash Tradelink Private Limited to M/s Hindprakash Chemicals Private Limited and submitted copy of Certificate of Incorporation issued by Registrar of Companies, Ahmedabad dated 08.07.2021.

The Committee noted that Department of Commerce vide Instruction No. 89 dated 17.05.2018 has issued guidelines regarding change in shareholding pattern, name change pertaining to SEZ units wherein change of name, change of shareholding pattern, etc. may be undertaken with the prior approval of Approval Committee in respect of units.

The Committee noted that M/s. Krishna Enterprise has requested for permission to warehouse following 1 item to be warehoused in KASEZ on behalf of DTA/Foreign clients:

Shri Mahesh Matiya, Proprietor of the firm explained their proposal. He informed the Committee that earlier he had applied for warehousing of 03 items (including the above referred item) in the 167thUAC meeting and in the said UAC meeting only 02 products were approved and the above mentioned product was not approved. He further informed that he was under belief that they have got the approval of all the 03 items including (Industrial Nitrocellulose) and accordingly they have filed the Bill of Entry for the same as the container of the said goods has been loaded. Now he has requested to allow them warehousing of the said goods for 1 container for which Bill of Entry already filed and he has assured that he will not bring the Industrial Nitrocellulose again for warehousing inside KASEZ.

The Committee after due deliberation decided to grant one-time permission for the already warehoused item viz. Shri Sharad Shetty, Partner of the firm explained their proposal. He informed the Committee that they propose to warehouse products on behalf of their clients. He further stated that their proposal was discussed in the last UAC and the Committee deferred their proposal with direction to submit the KYC of their clients. Now they have submitted KYC of their clients.

The Committee after due deliberation decided to permit the items to be warehoused by the above unit on behalf of DTA/Foreign clients as submitted by the unit subject to the unit fulfilling NFE criteria and also subject to following conditions:-

i) This clause will have overriding effect for any approval granted in LoA now or before. ii) Further, with respect to warehoused items at Sr. No. 1 the same is allowed to be warehoused subject to fulfilment of the MIP condition as prescribed under Import/Export policy.
iii) iv) v) Further, the unit will obtain registration/clearance/any other mandatory requirement prescribed under any Act/Rules from concerned agencies before undertaking of such activities. vi) items proposed above falls under negative list or is hazardous or requires environmental clearance for storage/ transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

The Committee noted that the proposal of M/s Max Impex for setting up a Warehousing Service Unit and Trading unit for certain items was approved in the 160thUAC meeting held on 04.08.2020 and the O/o. of the Development Commissioner, KASEZ issued in-principal LoA vide letter dated

10.08.2020. The said unit has been allotted Shed No. 244, Sector-II, Phase- I,KASEZ and now the unit has requested for issuance of formal LoA.

The Committee perused the list of items approved by the UAC in the 160th meeting held on 04.08.2020 and noted that some of the items mentioned at Sr. No. 5, 6 & 7 (ITC HS 62103090, 621040, 62104010, 62104090, 62105000) under the Trading Activity and items mentioned at Sr. No. 5 (ITC HS 62103090, 621040, 62104010, 62104090, 62105000), 10, 12, 13 & 18 under the Warehousing Service Activity are sensitive in nature.

The Committee after due deliberation decided to delete the above items mentioned at Sr. No. 5, 6 & partially allow items at Sr. No. 7 except ITC HS 62103090, 621040, 62104010, 62104090 & 62105000 under the Trading Activity and delete the items mentioned at Sr. No. 10, 12, 13, 18 & items partially allow items at Sr. No. 5 except ITC HS 62103090, 621040, 62104010, 62104090, 62105000 under the Warehousing Service Activity as the same are sensitive in nature and directed that the formal LoA be issued to M/s. Max Impex with the revised list of items.

TABLE AGENDA- Item No.169.4.3 Request of KASEZ units for taking betel nut and black pepper (except oleoresin extraction) outside KASEZ for job work.

It has been noticed by the KASEZ Administration that many units in the Zone send Betel Nuts and Black Pepper for job-work after drawal of samples outside the Zone/Intra-zone. It is also noticed that the job-work involves mainly grinding operations which does not involve any hi-tech process except for oleoresin extraction from Black pepper which involves a relatively complex process. Therefore, there is no logic in sending Betel Nut and Black Pepper for job-work as grinders are low cost machines and can very well be set up within the Zone. Further, there is a risk that the Betel Nuts and Black Pepper that have been sent for job-work may be diverted and low quality Betel Nuts and Black Pepper may be substituted in place of the high quality Betel Nuts and Black Pepper (which may be diverted to the domestic market).

The drawal of samples of Betel Nut and Black Pepper is not a sufficient safeguard as the sample analysis can only determine that the sample is of Betel Nut and Black Pepper and the quality cannot be predicted as there is wide variation in quality available in the market.

Therefore, the Approval Committee after due deliberation decided that henceforth no units of KASEZ will be allowed the facility of sub- contracting/job-work of Betel Nuts and Black Pepper (except oleoresin extraction) in any manner.

Notwithstanding to the decisions of the Committee, if the DC Office/Approval Committee notices any pending legal proceedings as on date of decision of the Committee or any legal proceedings that may be initiated after the decision of the Committee against the unit/firm/company and/or its Proprietor/Partner/Director, which has a bearing on the decision taken/LoA issued to the firm in any manner, the LoA granted will be liable for action, including cancellation under the FT (D&R) Act and necessary action will be taken against such units in terms of applicable provisions of law.
