162.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 162.1.1 Application for setting up of a unit in KASEZ namely M/s. Pan Bahar Products Pvt. Ltd., 20, Shivaji Marg, Najafgarh Road, Industrial Area, West Delhi, New Delhi- 110 015.

A proposal was submitted by M/s Pan Bahar Products Pvt. Ltd., Delhi for setting up a unit in Kandla SEZ for manufacturing activity. Shri Raj Kumar Vijay, Partner of the firm explained their proposal. Shri Vijay explained that he has 20-25 years experience in the field of guthka and was associated with Pan Bahar and was looking after the production. Now they have taken franchisee of Pan Bahar and hence they want to set up a unit for manufacturing of Pan Masala and Gutkha in KASEZ and further stated that they will invest Rs. 112 lakhs in the proposed project out of which Rs. 50 lakhs will be self financed and remaining will be bank financed. He further stated that he is having property (flat) in the joint name of his father valued at Rs. 2 crores against which they will take loan for their proposed project.

The Committee noted that the applicant has requested for manufacturing activity of following items: -

The Approval Committee after due deliberation approved the proposal subject to furnishing declaration of property (flat) valued Rs. 2 crores and also subject to standard terms and conditions for such units which include no DTA Sale/clearance of any goods and no import of Betel nuts (supari) and also subject to furnishing an affidavit/undertaking for use of plastic packaging as detailed under Item No. 117.1.2 in terms of the Apex Court’s judgement.

ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iii) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
iv) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or _ require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 162.1.2

Application for setting up of a unit in KASEZ namely M/s. Nimex Trading Corporation, 17/2, Topiwala Mansion, 93-97, Mohamedali Road, Mumbai - 400 003, Maharashtra.

A proposal was submitted by M/s. Nimex Trading Corporation, Mumbai for setting up a unit in Kandla SEZ for manufacturing activity and trading activity.

Shri Parvez Abdulkader Khatri, Proprietor of the firm explained their proposal. Shri Khatri explained that they intend to set up a unit in KASEZ for manufacture, pack and re-export from the Zone. He further stated that they are already having an EOU at Petlad, Gujarat for Pan masala for exports. He further stated that they are exporting around Rs. 140 crores of pan masala, unmanufactured tobacco and other general merchandise items such as textile items, spices, etc. He also stated that they will not import betel nut and will procure the same locally.

The Committee noted that the applicant has requested for various items for trading activity apart from tobacco products which includes garments, spices, etc. and directed the applicant to state whether they wish to withdraw the other items for trading activity. On this the Proprietor of the unit stated that they have no objection if tobacco products are approved for trading and other items are not approved in their trading activity.

The Approval Committee after due deliberation approved the proposal of manufacturing activity subject to standard terms and conditions for such units which include no DTA Sale/clearance of any goods and no import of Betel nuts (supari) and also subject to furnishing an affidavit/undertaking for use of plastic packaging as detailed under Item No. 117.1.2 in terms of the Apex Court’s judgement. Further, the Committee also approved the proposal for trading activity of only tobacco products viz. Sr. No. 1, 2, 3, 4,5 & 16, subject to standard terms and conditions

i) Any restrictions on import/export of above items and its raw materials will apply.
ii) None of the items which are restricted or prohibited will be allowed to be traded and any restrictions on import/export of any items will apply.
iii) | Items allowed for the trading activity will be 100 % exported and no DTA sale & intra-zone sale of any traded items will be allowed.
iv) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
v) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
vi) The above permission is also subject to further condition that the unit shall maintain separate accounts for manufacturing and trading activity and earmark separate space for both the activities.
vii) Further, the applicant will submit separate APRs for both of their manufacturing and trading activity activities.
vill) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 162.1.3

Application for setting up of a unit in KASEZ namely M/s. Cargo Care Agency, Sub Plot No. 03, Plot no. 44, Ward-7/A, 1st Floor, Gandhidham370201.

A proposal was submitted by M/s Cargo Care Agency, Gandhidham for setting up a unit in Kandla SEZ for warehousing and trading activity.

Shri Goda Prabhakar, Partner of the firm explained their proposal. Shri Prabhakar explained that they want to set up a unit for warehousing and trading activities in KASEZ and further stated that they are having 12 years experience in clearing and forwarding work and have dealt in items which they now proposed to do for their proposed warehousing and trading activities in KASEZ. He further stated that they are already doing CHA work in Delhi, Mumbai, Chennai and Mundra.

The Approval Committee after due deliberation decided to approve the proposal for trading and warehousing service activity subject to standard terms and conditions: -

i) The approval is subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
li) Further, none of the items which are restricted or prohibited will be allowed to be traded/warehoused and any restrictions on import/export of any items will apply.
iii) Further, with respect to traded/warehoused item at Sr. No. 1 viz. Nutritional Supplements, it is directed that the applicant needs to give an undertaking that the traded/warehoused goods will be re-exported to the tune of 75% to 80% and also whenever any traded/warehoused goods are cleared into DTA the same shall be subject to compliance of FSSAI norms and all other statutory compliance viz. NOC from Animal Husbandry Department, etc. before such clearance.
iv) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
v) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
vi) The above permission is also subject to further condition that the unit shall maintain separate accounts for trading and warehousing service activity and earmark separate space for both the activities.
vii) Further, the applicant will submit separate APRs for both of their trading and warehousing service activities.
viii) Further, the applicant will maintain separate stock register for trading and warehousing which will be subject to regular checking by the KASEZ customs authorities.
ix) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous oor require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

162.2 REQUEST FOR BROADBANDING

AGENDA ITEM NO. 162.2.1

Request for broad banding of additional item for manufacturing activity in their existing Letter of Approval issued from ff. _ no. KASEZ/IA/GKN/04/2015-16 dated 14.10.2019 issued to M/s GKN Enterprises.

M/s. GKN Enterprises, KASEZ is an approved unit with LoA dated 18.05.2015 issued from F. No. KASEZ/IA/04/2015-16 for manufacturing and trading activity subject to certain terms and conditions enumerated in the aforesaid Letter of Approval.

Now the said unit has requested for broad banding of their manufacturing activity and submitted list of following finished goods along with their ITC HS Code:

Shri G. Seenivasan, Partner of the firm explained their proposal. Shri Seenivasan explained that their proposal was discussed in the last UAC meeting with direction to submit details of capital goods with machine names and detailed manufacturing process and flow chart. Now they have submitted flowchart of their proposed manufacturing activity and also - as

details of cost of plant & machinery. He further stated that they will require about 5 acres of land for their proposed broad-banded items.

The Committee noted that their proposal for broad-banding was taken up in the last UAC meeting and was deferred with direction to the unit to submit additional details. Now the unit has submitted the details of capital goods, manufacturing process flow chart of the items proposed and name of machines required for their proposed broad-banded items.

The Committee noted that the applicant has requested for broadbanding of Special Boiling Point Solvent (Sr. No. 4) where import is allowed through State Trading Enterprises and asked the applicant whether they want to broad-band the said item or want to exclude the same. On this the Proprietor of the unit stated that they want to include the said item and will 100 % export the same and no DTA sale will be done for this item.

The Approval Committee after due deliberation decided to approve the broad-banding of manufacturing activity of above items in their existing LoA subject to strict compliance of SOPs submitted by them in their project. Further the unit will comply with all the Central/State laws for storage/handling/usage of these items. This approval is further subject to the following terms and conditions:

i) Any restrictions on import/export of above items and its raw materials will apply.
li) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iii) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
iv) The above permission is also subject to further condition that the unit shall maintain separate accounts for Manufacturing and trading activity and earmark separate space for both the activities.
v) Item mentioned at serial No. 4 i.e. Special Boiling Point Solvent will be 100% export only and no DTA sale is allowed.
vi) Naptha, in any form, will not be allowed to be cleared in DTA and the same will be allowed for export purpose only.
vii) Further, the unit will submit separate APR for their manufacturing and trading activities.

M/s Shreyas Packaging Industries, KASEZ is an approved unit for manufacturing activity of corrugated cartons and other packaging material and trading and warehousing activity in Kandla Special Economic Zone vide Letter of Approval No. FTZ/1IA/1559/94 dated 17.02.1995, amended from time to time.

Shri Dhaval Chellani, Partner of the firm explained their proposal. Shri Chellani explained that they want to include plastic lumps in their trading and warehousing activity. He further stated that they are presently doing warehousing of virgin polymers of plastic floor sweeping, off grade. The Committee asked the unit to submit map showing trading, warehousing and manufacturing activity separately. On this the Partner of the unit stated that presently they are doing warehousing activity and not doing trading activity. He requested to allow them warehousing activity of plastic lumps and not trading activity.

The Approval Committee after due deliberation decided to approve the proposal of only warehousing activity of above items subject to standard terms and conditions: -

v) The above permission is also subject to further condition that the unit shall maintain separate accounts for manufacturing, trading and warehousing activity and earmark separate space for all these activities.
vi) Further, the applicant will submit separate APR for their manufacturing, trading and warehousing activities.
vii) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or _ require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
vill) Further, the applicant will not be allowed to import and warehouse the above items in their premises on behalf of their clients unless the unit submit architectural design for earmarking of space for manufacturing, trading and warehousing activities.

AGENDA ITEM NO. 162.3.1

Extension of in principle Letter of approval for one year: Request of M/s Leaf Fibre Private Limited, KASEZ

M/s. Leaf Fibre Private Limited, KASEZ had been issued in-principle Letter of Approval dated 17.03.2020 for manufacturing activity of Filter Tobacco, Spit Tobacco, Khaini, Gutkha and Non Tobacco products with Nicotine which is valid for six months i.e. upto 16.09.2020.

Now, the unit has submitted that due to COVID 19 pandemic and pan India lock down all the activities have come to stand still and gradually things are getting back to normal under phased unlock in various parts of the country and requested to extend their in principal LOA for further one year period in which they will participate in MSTC bidding and once space is allotted the project will be implemented and commencement activities will be done.

Shri Ritesh Patawari, Director of the company explained their proposal. Shri Ritesh explained that due to present Covid pandemic their project could not be implemented and hence request to extend in-principle LOA for further one year period. The Approval Committee after due deliberation decided to approve the request of the unit for extension of their in-principle LoA for further one year period subject to the unit submitting an undertaking that they will commence their authorised activity within the said one year period and if they fail to commence their authorized activity within the stipulated extended period, their LoA will be cancelled.

AGENDA ITEM NO. 162.3.2

Request of M/s. Aditya Exports, KASEZ for renewal of their LOA for Manufacturing and Trading Activity.

M/s Anshita Tradelinks (now M/s. Aditya Exports) was issued LoA from F.No. KASEZ/IA/1909/2002-03 dated 03.03.2003 for trading activity of Agro Products, Plastic Products, Chemicals, Dies, Textiles, Utensils and all items except prohibited, canalized & restricted items as per amended from time to time. The units LOA was broad-banded various times. The LoA of the Unit has expired on 21.01.2014 and the same has not been renewed after 21.01.2014. The unit vide letter dated 12.03.2015 has requested this office for renewal of their LoA, but the same was not processed as the unit had not paid the outstanding rental dues of Rs. 6,12,700/- pending upto 31.03.2015 and user charges of Rs. 75,330/- pending for F.Y 2013-14.

M/s Dipi Enterprise, KASEZ is an approved unit for warehousing activity and trading activity as approved vide LoA No. KASEZ/IA/03/201516 dated 13.05.2015.

Now the unit has intimated that vide dissolution deed dated 22.06.2020 w.e.f 01.04.2020 the constitution of business has been changed from Partnership firm to Proprietorship firm. Earlier there were two partners in the firm Smt. Pankti Joshi and Sh. Kushal Pinakin Shah. Now, Smt. Pankti Joshi will be the proprietor of M/s Dipi Enterprise and she has undertaken to take all the assets and liability of the firm M/s Dipi Enterprise. Further, the new proprietor has undertaken to any dues/tax or any kind of obligation which has arisen or may arise in future for the firm M/s Dipi Enterprise.

Guma wants to exit from SEZ and they want to take over the super structure & liabilities also of M/s. Guma, KASEZ. The Committee noted that M/s. Shri Anand Mehta, Authorised Representative of the company explained their proposal. Shri Mehta explained that they intend to broadband additional manufacturing activity of engineering items in their existing LoA for manufacturing activity. He further stated they will invest Rs. 4 crores in plant and machinery and the export turnover for 5 years period will be Rs. 168 crores and will employ about 35 persons. They are already having two sheds with open space and they will start their broad-banded activity in their existing sheds and if need be will ask for additional space.

The Approval Committee after due deliberation decided to approve the proposal of manufacturing activity of above items subject to standard terms and conditions:-

i) Any restrictions on import/export of above items and its raw materials will apply.
ii) Further, this approval will be subject to the conditions that the items falling under Chapter 72 &73 will be subject to compulsory registration under Steel Import Monitoring System (SIMS).
iii) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
iv) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
v) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
