sss. 159.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 159.1.1

Application for setting up of a unit in KASEZ namely M/s. Kutch Bio Product Private Limited, Plot No. 121, Sector-9C, Gandhidham, Kutch, Gujarat.

A proposal was submitted by M/s Kutch Bio Product Private Limited, Gandhidham for setting up a unit in Kandla SEZ for manufacturing activity.

Shri Anand Mehta, Authorised Representative of the company explained their proposal. Shri Anand Mehta explained that they propose to set up a unit for manufacturing of Bio Diesel and Glycerol and majority of the finished products will be exported. The Committee noted that two of the raw materials required for manufacturing of Bio Diesel are in restricted category and asked the applicant whether they want to remove the said raw materials and to approve their proposal without the restricted items. Shri Anand Mehta stated that the said two raw materials are their main ingredients without which their project is not viable.

The Approval Committee after due deliberation decided to defer their matter and take up the same in the next UAC as the Committee in its last meeting has referred one of the matter of restricted items to the Board of Approval. The proposal of the unit may be placed in the next meeting after the outcome of Board of Approval regarding restricted items.

AGENDA ITEM NO. 159.1.2

Application for setting up of a unit in KASEZ namely M/s. Suhavi Pharma, DBZ-N-180, Nr. Gurudwara, Gandhidham - Kutch - 370 201. A proposal was submitted by M/s. Suhavi Pharma, Gandhidham for setting up a unit in Kandla SEZ for manufacturing activity.

Shri Nankani explained that they want to set up a manufacturing unit for sterile water for injection in plastic ampoules and the finished products will be exported globally. Looking to the present scenario of COVID 19 pharma manufacturing is better sector for investment. The Committee asked the applicant whether they will apply for space in KASEZ or will take over any existing unit in KASEZ.

Shri Nankani stated that they are in deliberation with one of the existing unit of KASEZ M/s. PNJT Realty (formerly known as M/s. Vifor Laboratories) for taking over their area provided they are given approval for setting up of unit in KASEZ. Shri Nankani further stated that M/s. PNJT has agreed with common terms once the taking over permission is granted by KASEZ.

The Approval Committee after due deliberation decided to approve the proposal of manufacturing activity of above items subject to standard terms and conditions. However, the proposal for taking over of the existing unit’s premises will be placed before the KASEZ Authority and the decision will be taken by the KASEZ Authority.

AGENDA ITEM NO. 159.1.3

Application for setting up of a unit in KASEZ namely M/s. Prasar Enterprises (Unit - II), Shed No. 316-317, A-II Type, Kandla Special Economic Zone, Gandhidham - Kutch - 370 230.

A proposal was submitted by M/s Prasar Enterprises (Unit - II), KASEZ, Gandhidham for setting up a unit in Kandla SEZ for manufacturing activity and warehousing service activity. Shri Atul Parekh, Partner of the firm explained their proposal. Shri Parekh explained that they are in the business of plastic products and having a unit of plastic recycling in KASEZ. They are the highest exporters for plastic products in KASEZ during last 5 years which are physically exported out of the country. Now, they want to set up a unit for manufacturing and warehousing service activity in KASEZ and will import plastics in primary forms which are free under OGL for manufacturing and warehousing. He further stated that currently they are having 5 sheds in KASEZ for plastic scrap manufacturing, out of which they will use one shed for their proposed new manufacturing activity and for warehousing service activity they will take one shed from KASEZ through bidding.

The Committee noted that the applicant has requested for manufacturing and warehousing service activity of following items: -

The Approval Committee after due deliberation decided to approve the
proposal of manufacturing activity of above items and warehousing activity of above items subject to standard terms and conditions:i) Any restrictions on import/export of above items and its raw materials will apply.
ii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

iv) The approval is also subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
v) Further, the applicant will submit separate APR for both of their manufacturing and warehousing service activities and will submit architectural design for earmarking of space for manufacturing and warehousing activities.
vi) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or _ require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.

AGENDA ITEM NO. 159.1.4 Application for setting up of a unit in KASEZ namely M/s. Luckystar International Private Limited (Unit - II), 211/213, 2.4 Floor, Kalbadevi Road, Mumbai, Maharashtra.

A proposal was submitted by M/s Luckystar International Private Limited (Unit - II), KASEZ, Gandhidham for setting up a unit in Kandla SEZ for manufacturing activity and warehousing service activity.

Shri Sheetal Jain, Authorised Representative of the company explained their proposal. Shri Jain explained that they are in KASEZ since more than 20 years for plastic recycling. Now, they want to set up a unit for manufacturing and warehousing service activity in KASEZ and will import plastics in primary forms which are free under OGL for manufacturing and warehousing. He further stated that they will utilise their existing premises i.e. Plot No. 23-24, 33-34, Sector - 1, KASEZ admeasuring 6600 sq. mtrs. for their proposed new manufacturing and warehousing service activity. The Approval Committee after due deliberation decided to approve the

A proposal was submitted by M/s. Chetaki Trade Exim Private Limited, Delhi for setting up a unit in Kandla SEZ for trading and warehousing activity.

Shri Anil Maurya, Director of the company explained their proposal. Shri Maurya explained that they want to set up a unit in KASEZ for trading and warehousing activity. He stated that they have experience of about 15 years in the field of memory cards, perfumes, deodorant, PVC Boards, etc.

159.2 REQUEST FOR BROADBANDING

AGENDA ITEM NO. 159.2.1 Addition of packaging services - Request of M/s. Milak Warehouse, KASEZ.

M/s Milak Warehouse, KASEZ is an approved unit with LoA No. 1836/2001-02 dated 10.08.2001, as amended, for Trading, Manufacturing and warehousing service activity.

Request of the unit for addition of packaging services was placed before 158% UAC meeting held on 18.06.2020 wherein the Committee decided to defer their proposal with direction to the unit to furnish separate APRs for manufacturing, trading and warehousing activities.

The Committee noted that the unit has submitted separate APRs for manufacturing, trading and warehousing activities.

Shri Vivek Milak, Partner of the firm explained their proposal. Shri Milak explained that they are in the business of manufacturing, trading and warehousing in KASEZ and further stated that they want to include packaging services in their warehousing activities which was deferred in the last meeting.

AGENDA ITEM NO. 159.2.2 Broad banding of Manufacturing Activity (Addition of 01 new product in unit’s LoA) - Request of M/s Flax Apparels Pvt. Ltd., KASEZ.

M/s Flax Apparels Pvt. Ltd., KASEZ is an approved unit vide LOA No. F.No. KASEZ/IA/1627/96/1213 dated 15-05-1996, as amended, for manufacturing activity for reprocessing of used garments for export.

Now the unit has requested for broad-banding of their LoA for setting up of spinning unit for manufacturing activity of following item: -

The Committee informed the applicant that their raw material for above said manufacturing activity is old and used worn clothing, which is restricted item for import, and the matter of renewal of Letter of Approval of worn and used clothing units are under consideration before the Board of Approval. The Committee asked Shri Sanjay Mehra whether they want to wait till the decision of the BoA regarding renewal of old & used clothing. Because, the availability of Raw Material is dependent upon the outcome of BoA Meeting and if the renewal of Old and Used clothing units is not granted than the investment made by them in this project will not be of any use. In reply, Shri Mehra stated that the machines required for pulled fibre are not big and expensive and will require lesser space and they have urgent export orders for the proposed pulled fibre and has undertaken the full responsibility of his decision to set up this facility. Now the unit has requested for broad-banding of their LoA for setting up of spinning unit for manufacturing activity of following item: -

He further stated that they will install automatic machine amounting to Rs. 48 lakhs which require less space for their proposed new item and will give employment to 100 persons. Shri Shailendra Limbani, Director of the company explained their proposal. Shri Limbani explained that they want to include shoes covers for manufacturing and also for trading activity and Coverall in trading activity in their existing LoA. He further stated that the proposed items for manufacturing and trading activities will be supplied to Hospitals and Government agencies and they do will not make any exports of the proposed items. Brigadier Ranvir Singh Vasistha, COO and Shri Bhavesh Sharma, Assistant Manager, of the firm explained their proposal. Brigadier stated that their proposal was rejected in the last meeting as the items proposed to be warehoused are falling under prohibited category for exports. He further stated that the DGFT vide Notification No. 01/2015-2020 dated 06.04.2018 has amended the export policy of edible oils are amended from prohibited to free category and requested to allow them the warehousing of edible oils on behalf of their clients.

The Committee after due deliberation decided to take on records the
items to be warehoused by the above unit on behalf of Foreign/DTA clients as submitted by the unit except Sr. No. 16 & 21 subject to the conditions:i) None of the items which are restricted or prohibited will be allowed to be warehoused
ii) Any restrictions on import/export of any items will apply. iii) | The above said items will be 100 % exported and no DTA sale of any item will be allowed.
iv) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
v) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

The Committee after due deliberation decided to take on records the item to be warehoused by the above unit on behalf of DTA clients as submitted by the unit subject to the conditions:-

i) The items falling under Chapter 72 & 73 will be subject to compulsory registration under Steel Import Monitoring System (SIMS).
ii) None of the items which are restricted or prohibited will be allowed to be warehoused.
iii) | Any restrictions on import/export of any items will apply. iv) Further, with respect to warehoused item Sr. No. 5 & 8 viz. Whey Proteins concentrate and Nutritional Supplements, the Committee directed the applicant to give an undertaking that the warehoused goods will be re-exported to the tune of 75% to 80% and also whenever any warehoused goods are cleared into DTA the same shall be subject to compliance of FSSAI norms and all other statutory compliance viz. NOC from Animal Husbandry Department, etc. before such clearance.
v) Further, the items will be subjected to the Policy Conditions specified in DGFT’s ITC HS Code wherever applicable.
vi) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.

M/s Renew Plastics, KASEZ is an approved unit for manufacturing of Plastic Granules/Shredding/Grinding/Pieces, etc. from waste/scrap/ discarded/obsolete plastic items, etc. in Kandla Special Economic Zone vide Letter of Approval No. KFTZ/IA/1607/95/2845 dated 25.01.1996, as amended.

The Committee after due deliberation decided to discourage such request of temporary sharing of premises by KASEZ units and rejected the request of M/s. Oswal Agrimpex for temporary sharing of premises.

M/s. AVB International, Unit No. 107-308-309, Ganga SDF Complex, Phase-II, KASEZ vide letter dated 21.07.2020 has made a request seeking permission to take over the assets & liabilities of M /s. G. K. Tobacco Industries Pvt. Ltd., Shed No. 327, 328 and 329, STD Type, Sector-I, KASEZ under Rule 74A of SEZ Rules, 2006.

In this regard, they have also submitted NOC for transfer of assets & liabilities issued by M/s. G. K. Tobacco Industries Pvt. Ltd. situated at Shed No. 327, 328 and 329, STD Type, Sector-I, KASEZ.

AVB International, KASEZ fulfils all eligibility criteria applicable to a unit and has been issued Letter of Approval No. 22/2016-17 dated 27.02.2017 and has commenced production from 13.05.2019.

The Committee further noted that M/s. G. K. Tobacco Industries Pvt. Ltd. intends to exit from the SEZ and M/s. AVB International want to take over the said company under Rule 74A of the SEZ Rules, 2006.

have started commencement of their authorised operation in KASEZ and requested for grant of broad banding permission for manufacturing, trading and warehousing service activities.

The Approval Committee after due deliberation decided to approve the proposal of manufacturing, trading and warehousing activity of above items subject to standard terms and conditions:-

i) None of the items which are restricted or prohibited will be allowed to be traded/warehoused.
ii) Any restrictions on import/export of any items will apply. lii) In case of any discrepancy/mismatch between the above ‘Description of Goods’ as provided by the Unit & ‘Description of goods as per DGFT Import Policy’, the later will prevail.
iv) The approval is also subject to the additional condition that the applicant should seek a prior approval of any additional items they intend to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity.
v) The above permission is also subject to further condition that the unit shall maintain separate accounts for manufacturing, trading and warehousing service activity and earmark separate space for all the activities.
vi) Further, the applicant will submit APR separately for their manufacturing, trading and warehousing service activities and will submit architectural design for manufacturing, trading & warehousing activities.
vii) Further, the applicant will give an undertaking that none of the items proposed above are falling under negative list and are not hazardous or require environmental clearance for storage/transmission/handling and if the items are found in negative list or hazardous in nature, penal action will be initiated against them.
