Minutes of the 149th Unit Approval Committee Meeting of Kandla SEZ held on 10.10.2019 at 11:30 hrs. under the Chairmanship of Dr. Amiya Chandra, Development Commissioner, Kandla Special Economic Zone.

149.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 149.1.1

Application for setting up of a unit in KASEZ namely M/s. Concept Highcon. (P) Ltd. having its registered office at C-3/112, Ashok Vihar, Phase-II, Delhi-110052.

A proposal was submitted by M/s. Concept Highcon (P) Ltd., Delhi for setting up a unit in Kandla SEZ for warehousing service activity at FTWZ developed by M/s Kandla Free Trade Warehousing Private Limited in KASEZ.

Shri Inder Aggarwal, Director of the company appeared before the Approval Committee and explained their proposal. Shri Aggrawal stated that they propose to set up warehousing service unit at FTWZ of KASEZ for 24 items. He further stated that they are a construction based company and distributor for Birla having marketing background. He submitted additional 6 items apart from items submitted with the original proposal for Committee’s consideration to be included for warehousing service activity at FTWZ of KASEZ. The Committee noted that the applicant has requested for warehousing of following 30 items (24 original items and additional 6 items):

The Approval Committee after due deliberation decided to approve the proposal for 27 items except Fertilizers & plastic granules and Agro Commodities (as the HSN Classification code submitted was too wide) subject to standard terms and conditions and also subject to additional condition that the unit should seek a prior approval of any additional items they intent to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised activity. As regards the warehousing of Nutritional Supplements/Foods Suppitements (ITC HS 2106 1000) the Committee asked the applicant to give an undertaking that the warehoused goods will be re-exported to the tune of 75% to 80% and also whenever any warehoused goods are cleared into DTA the same shall be subject to compliance of FSSAI norms and all other statutory compliance viz. NOC from Animal Husbandry Department, etc. before clearance of the same in DTA.

AGENDA ITEM NO. 149.1.2

Application for setting up of a unit in KASEZ namely M/s. Unicorn Multimode Logistics having its registered office at H 57, Township Bageshree 5, Varshamedi, Anjar, Kachch, Gujarat.

A proposal was submitted by M/s. Unicorn Multimode Logistics, Varshamedi, Anjar for setting up a unit in Kandla SEZ for warehousing service activity at FTWZ developed by M/s Kandla Free Trade Warehousing Private Limited in KASEZ. Shri Goda Prabhakar, Proprietor of the firm appeared before the Approval Committee and explained their proposal. Shri Prabhakar stated that he proposes to set up warehousing service unit at FTWZ of KASEZ. He further stated that he has \expememce “ol 15. years m.-the: field: of transportation, logistics, warehousing & customs clearing and has sound financial backing to undertake warehousing activity. He submitted letter dated 10.10.2019 containing the details of funds available for the — development of the project. The Approval Committee after due deliberation decided to approve the proposal subject to standard terms and conditions and also subject to additional condition that the unit should seek a prior approval of any additional items they intent to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised activity.

AGENDA ITEM NO. 149.1.3

Application for setting up of a unit in KASEZ namely M/s. S F Express Pvt. Ltd., A-58, IlIrd Floor, Amrit Nagar Kotla Mubarakpur, New Delhi — 110 003.

A proposal was submitted by M/s. S F Express Pvt. Ltd., New Delhi for setting up a unit in Kandla SEZ for trading activity and warehousing service activity. | Shri Anand Mehta, Authorised Representative of the company appeared before the Approval Committee and explained their proposal. Shri Mehta stated that they want to set up trading and warehousing unit in KASEZ. He further submitted letter dated 10.10.2019 to the Committee intimating that the investment and initial capital required for the proposed project will be induced by one of the Director Ms. Renu Kataria and also submitted IT return of the said Director for 2019-20, 2018-19 & 2017-18.

The Committee noted that the applicant has also submitted list of 12 items for trading activity vide their letter dated 10.10.2019.

The Approval Committee after due deliberation decided to approve the proposal for trading activity and warehousing service activity subject to standard terms and conditions and also subject to additional condition that the unit should seek a prior approval of any additional items they intent to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised warehousing activity. Further, the approval for warehousing service activity will be subject to the condition that none of the items which are restricted or prohibited will be allowed to be warehoused and any restrictions on import/export of any items will apply. Further, for warehousing of items under ITC HS Code 9803 and 9804, the proposed unit will comply with the conditions as provided under Customs and Baggage Rules and Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993.

Application for setting up of a unit in KASEZ namely M/s. Pooja Life Spaaces Pvt. Ltd., Office No. 3, Vania Street, Kundrathur, Chennai — 600 069 (Table Agenda).

A proposal was submitted by M/s. Pooja Life Spaaces Pvt. Ltd., Chennai for setting up a unit in Kandla SEZ for warehousing service activity at FTWZ developed by M/s Kandla Free Trade Warehousing Private Limited in KASEZ. The Committee noted that. the applicant has requested for warehousing of Free and OGL items as per ITC HS Policy and directed the applicant to furnish specific items to be warehoused. The Approval Committee after due deliberation decided to approve the proposal subject to standard terms and conditions & the applicant furnishing specific list of items to be warehoused and also subject to additional condition that the unit should seek a prior approval of any additional items they intent to warehouse and submit KYC details of clients to the Office of the Development Commissioner before undertaking the authorised activity.

149.2 REQUEST FOR BROADBANDING

AGENDA ITEM NO. 149.2.1 d Request of M/s Hindustan Oil Industries, KASEZ for Broad Banding of their LoA for inclusion of 07 trading items.

M/s. Hindustan Oil Industries, KASEZ is an approved unit for manufacturing activity of Light Solvents, Fuel Oil, Light Fuel Oil, Light Viscocity Base Oil, High Viscosity Base Oil, Rubber Process Oil/ Residue only for Crude Oil processing vide Letter of Approval F. No. KASEZ/IA/006/201314/4965-67 dated 08.08.2013, as amended. AGENDA ITEM NO. 149.2.2 Request of M/s. Sun Products, KASEZ for Broad-banding of Trading activity in their existing LoA for Manufacturing activity.

The Committee observed that no representative from the unit came to present the proposal. As such, the Committee decided to defer the proposal till the next meeting.

AGENDA ITEM NO. 149.2.3 Requestof M/s. Parekh Bulk Pack, KASEZ for Broad-banding of Trading activity in their existing in-principle LoA for Manufacturing activity.

M/s. Parekh Bulk Pack, KASEZ was granted in-principle LoA dated 20.06.2018 for setting up manufacturing unit for FIBC PP Woven Bags Sacks/Jumbo Bags, PP Woven Sacks Small Bags, LLDPE Liner and Filler Cord.

Now the unit has requested for broad-banding of their in-principle LoA for trading activity for following items: -

Shri Parekh stated that they have been already granted in-principle LoA for manufacturing activity and due to non-allotment of plot, they could not start their manufacturing activity in KASEZ. Now, they want to incorporate the trading activity in their in-principle LoA. Shri Parekh further stated that they will not import any items for trading activity and will procure from DTA and intra-zone and will made 100% export.

The Approval Committee after due deliberation decided to approve the broad-banding of trading activity of above items in their existing in-principle LoA for manufacturing activity subject to the condition that the above items will be procured from DTA only or intra-zone basis and 100% exported & no DTA sale will be allowed. Further, the unit will maintain separate accounts for manufacturing and trading activity and furnish separate demarcation of space for manufacturing and trading activity (to be informed to the Customs formation of SEZ).

AGENDA ITEM NO. 149.2.4

Request for broad banding of Warehousing Activity in their existing Letter of Approval No. 8/13/88-FTZ dated 01.11.1988 (as amended) by M/s Pet Plastics Ltd., KASEZ.

M/s. Pet Plastics Ltd., KASEZ is an approved unit for Manufacturing and Trading activities vide Letter of Approval No. 8/13/88-FTZ dated 01.11.1988, as amended.

Now the unit has requested for broad-banding of their LoA for warehousing activity on behalf of DTA/Foreign clients.

Shri Ritesh Vakil, Director of ,the company appeared before the Approval Committee and explained their proposal. Shri Vakil stated that they intend to include warehousing service activity in their existing LoA for manufacturing and trading activity. The Committee asked the applicant if they are doing manufacturing activity in KASEZ after their LoA was renewed by the office of DC, KASEZ in 2015-16, for which the applicant informed that no manufacturing activity is being undertaken by the unit at present.

Therefore, the Approval Committee after due deliberation decided to reject their proposal with the direction to the unit to first start their manufacturing activity in KASEZ.

AGENDA ITEM NO. 149.2.5

Request of M/s Hazel Mercantile Limited, KASEZ for Broad Banding of their LoA for inclusion of 64 trading items.

The Committee observed that no representative from the unit came to present the proposal. As such, the Committee decided to defer the proposal till the next meeting.

AGENDA ITEM NO. 149.2.6

Broad banding of Manufacturing Activity (Addition of new products in unit’s LoA — Request of M/s. GKN Enterprises, KASEZ, Gandhidham.

M/s. GKN Enterprises, KASEZ is an approved unit with “LoA No. KASEZ/TA/04/2015-16/1785-1788 for manufacturing & trading activity, as amended. '

Now the unit has requested for broad-banding of their manufacturing activity for following items:

Shri Seenivasan, Proprietor of the firm appeared before the Approval Committee and explained their proposal. Shri Seenivasan stated that he intend to add new item viz. Paint Solvent N80 in their existing LoA for manufacturing activity. He further stated that as the proposed item and its raw material are hazardous he undertakes to comply with all the Central/ State laws for manufacture/storage/handling of these products.

The Approval Committee after due deliberation decided to approve the broad-banding of manufacturing activity of above item in their existing LoA subject to strict compliance of SOPs submitted by them in their project and the condition that any restrictions on import/export of above items and its raw materials will apply. Further the unit will comply with all the Central/State laws for storage/handling/usage of these items.

149.3 MISCELLANEOUS ITEMS

AGENDA ITEM NO. 149.3.1 Request of M/s. Vishvajoti Packaging, KASEZ for Import of Precious Metals - Silver under Warehousing Approval.

M/s. Vishvajoti Packaging, Plot No. 453/472, Sector-I, KASEZ is holding LoA No. KASEZ/IA/07/2007-08 dated 22.06.2007 as amended/extended from time to time for warehousing & packaging for the units in SEZ and/or from abroad for exports.

Now the unit has requested for permission to import precious metals - Silver under warehousing approval. The subject matter was placed before the 148th UAC meeting, wherein the UAC had directed the applicant to submit detailed project report including SOPs, details of overseas clients, local nominated agencies, security audit of precious metals and entire procedure they intend to follow for warehousing the precious metal.

The Committee noted that the unit has submitted the required details vide their letter dated 04.10.2019.

Shri. Vivek Milak, Constituted Attorney of the firm appeared before the Approval Committee and further explained their proposal.

The Committee after due deliberation decided to approve their proposal’ under Rule 18(5) of SEZ. Rules, 2006 subject to following conditions: -

The establishment of vaulting facility and entire security arrangements shall be strictly in conformity with the international norms for storage and movement of such precious metals.
No sub-leasing of space to be given to for non-SEZ entity. However, the unit may hire the services of any agency/contractor for-putting

up the above facility with prior approval of the Development Commissioner.

Risk coverage of the duty amount shall be the sole responsibility of the warehousing unit.
The unit will furnish a comprehensive insurance coverage equivalent to the duty involved in favour of Govt. of India for transit from Port of importation to your warehousing facility in KASEZ as well as storage in the warehouse.

Proper security arrangements along with deployment of gunmen by the wit.
DC, KASEZ is authorised to get the completed vaulting facility audited for the security aspect from any of the reputed security agencies and the cost to this regard will be borne by the unit.
Commencement/operationalization of vaulting facility shall be allowed only after receipt of satisfactory security audit report of such agency and any other additional measures with regard to security and entry exit facility as deemed necessary by the DC, KASEZ.

All transactions shall be in freely convertible foreign currency in terms of Section 2(z) of SEZ Act, 2005 and Rules 75 read with Rule 18(5) of SEZ Rules, 2006.
Such material shall be warehoused only on behalf of foreign clients subject to strict compliance of RBI regulations.

AGENDA ITEM NO. 149.3.2

Permission to warehouse goods on behalf of DTA client - Request of M/s. Mysore Scents Company (Unit-II), KASEZ, Gandhidham. :

The Committee noted that the unit vide letter dated 10.10.2019 has requested for withdrawal of their present application.

Therefore, the Committee decided to accede to the request of the applicant for withdrawal of their present request.

AGENDA ITEM NO. 149.3.3 : Permission to warehouse goods on behalf of DTA client/Foreign Client - Request of M/s. Stash Barn Enterprises, KASEZ.

The Committee observed that no representative from the unit came to present the proposal. As such, the Committee decided to defer the proposal till the next meeting.
