Minutes of the 134th Unit Approval Committee Meeting of Kandla SEZ held on 29.08.2018 at 11:30 hrs. under the Chairmanship of Shri Upendra Vasishth, Development Commissioner, Kandla Special Economic Zone.

S397 Sse 134.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 134.1.1 Application for setting up of a unit in KASEZ namely M/s. Woco Tech Polymere Kandla Ltd. (Unit-II), Plot No. 341-344, Sector - 4, Kandla Special Economic Zone, Gandhidham - 370 230.

Their proposal is for setting up a unit in Kandla SEZ for Trading activity. Shri. Kirit Sevak, Commercial Manager of the company appeared before the Approval Committee and explained their proposal.

Shri Sevak stated that they are already having a unit in KASEZ for manufacturing of rubber parts, rubber to metal /plastic bonded parts and moulded plastic parts, etc. for automobile industry. He further explained that the proposed new unit for trading will sourcing the items from DTA procurement as well as by import of certain items and will export the same abroad and sell in local automobile industries to their local customers like Ford, etc.

The Approval Committee noted that the company is already having an existing manufacturing unit in KASEZ and the proposed company for trading activity will use the existing premises allotted to the company by creating separate demarcated area within allotted premises. The Approval Committee after due deliberation decided to approve the proposal for trading activity as Unit-II subject to standard terms and conditions. The Committee further directed unit to seek necessary NOC from KASEZ Authority for separation of allotted space for two units. AGENDAITEM NO. 134.1.2 Application for setting up of a unit in KASEZ namely M/s. Motherson Sumi Systems Ltd., (Unit II), Unit 705, C Wing, One BKC, G Block, Bandra Kurla Comlex, Bandra, East, Mumabi, Maharashtra-400051.

Their proposal is for setting up a Manufacturing unit for Wiring Harness, Components & Tools, Wire & Polymer Products for Automotive & Non Automotive Industry in Kandla SEZ.

Shri. Alok Kumar, General Manager of the company and Shri Vivek Milak, authorised representative of the company appeared before the Approval Committee and explained their proposal.

Shri Alok Kumar stated that they are already having a unit in KASEZ for manufacturing of Wiring Harness, Components & Tools, Wire & Polymer Products for Automotive & Non Automotive Industry. Now, they have acquired the PKC Group and now they want to set up a separate unit with the same line of manufacturing in KASEZ. Separate LoA is required as acquired company is a separate entity.

The Approval Committee after due deliberation decided to approve the proposal for manufacturing activity as Unit-II subject to standard terms and conditions.

134.2 REQUEST FOR BROADBANDING

AGENDA ITEM NO. 134.2.1

Request for broad banding of additional items in their existing Letter of Approval/Permission No. KASEZ/1IA/17/2015-16 dated 29.01.2016 of M/s Royal Petro Oil Refinery LLP, KASEZ.

M/s. Royal Petro Oil Refinery LLP, KASEZ is an approved unit for manufacturing of recycling of used lubricating oil and gas oil vide letter F.No. KASEZ/TA/17/2015-16/1665 dated 29.01.2016. The unit has not yet started their authorised operation and there LoA is valid upto 28.01.2019. Now, the said unit has applied for Broad Banding of their LoA for manufacturing activity for additional items viz. Automotive & Industrial Lubricants and Brake Fluids.

Shri. Pramesh Ved, Partner of the unit appeared before the Approval Committee and explained their proposal.

Shri Ved stated that their project for refinery plant has already been completed and had already started trail production. However, the commercial production is yet to start. The Approval Committee noted that the unit could not explain their flow chart of manufacturing process for the proposed two items which they intend to manufacture with the raw materials proposed by the unit. 3 W~

Therefore, the Approval Committee after due deliberation decided to defer the proposal with the request to the unit to furnish detailed process flow chart for each of the items proposed to be broad-banded along with raw materials to be used for manufacturing the proposed two items.

AGENDA ITEM NO. 134.2.2 Request of M/s GKN Enterprises, No. 306, Narmada SDF Complex, Phase-II, KASEZ for Broad-banding of a new item into their Manufacturing activity.

M/s GKN Enterprises, Unit No. 306, Narmada SDF Complex, Phase - I], KASEZ, Gandhidham has been permitted for Manufacturing of Pipe Adhesive (ITC HS - 39042210) vide LoA No. 04/2015-16 dated 18.05.2015 issued vide F. No. KASEZ/IA/04/2015-16 dated 18.05.2015 as amended from time to time.

Now, the said unit has applied for Broad Banding of their LoA for manufacturing activity for additional item viz. LOW VISCOSITY FUEL OIL.

Shri. N. Seenivasan, Manager of the unit appeared before the Approval Committee and explained their proposal.

Shri Seenivasan stated that they want to broad-band their item of manufacture for Low Viscosity Fuel Oil and will supply their finished products to Pipe Industry. He further explained that they are targeting export market and that they do not intend to sale the above products in DTA. The Approval Committee after due deliberation decided to approve the broad-banding of manufacturing activity of above item in their existing LoA subject to no DTA sale shall be permitted.

134.3 MISCELLANEOUS ITEMS

AGENDA ITEM NO. 134.3.1

Request of M/s. Palmon Exports KASEZ, Shed No. 186-187, Sector-I, Kandla SEZ, Gandhidham for permission to trade in all OGL items.

The Office of DC presented the mail received from M/s. Palmon Exports KASEZ dated 27.08.2018. The contents of the letter were gone through and the Committee took objection to the way facts are presented, The Committee discussed the matter and it was informed that the quoted

case of M/s. JSK Enterprises was discussed in 133th UAC meeting held on 16.08.2018 and the unit was not given LoA for general trading items and the LoA was granted to them for general trading of 14 items only as applied by them and that the unit shall procure items/goods from DTA only and the same will be supplied to ships and to intra zone units of KASEZ only. No import and DTA sale of the items were allowed.

Therefore, Committee noted that it is very unfortunate that the unit tends to distort these facts. In any case, unit is aggrieved with any of the decision of Committee, may appeal to BoA as the legal remedies are available to them instead of writing such letters. The Committee took note of the fact that the unit has imported certain items i.e. two consignments in their warehousing approval and were permitted by JDC, KASEZ on the basis of authority given by the Committee earlier for such matters.

It is reiterated that no blanket permission for trading or warehousing can be given and every unit may come up with specific list of items for permission of trading as well as warehousing of items & KYC of clients and decision taken in this regard earlier by Committee must be adhered to.

AGENDA ITEM NO. 134.3.2

Ratification of issues already approved in file

The Approval Committee ratified the permission granted to M/s. Palmon Exports KASEZ by O/o. DC for warehousing of two consignments as requested by the unit.
