107.1 NEW UNIT APPLICATION

AGENDA ITEM NO. 107.1.1 Application for setting up a Warehousing service activity unit in KASEZ namely M/s. Rishi Vistara, Plot No.113-116, Rishi House, Ward No.6, Industrial Area, Gandhidham, Gujarat - 370201.

Their proposal is for setting up a unit for Warehousing Activity in Kandla SEZ, Gandhidham. Shri. Manoj Mansukhani, Partner of the unit appeared before the Approval Committee.

Shri Mansukhani explained that they propose to set up warehousing facility in Kandla SEZ and will import timber, steel on behalf of their client and later on fertilizers and: will sell the same in DTA on their clients instructions. He further, however, added that their main proposed item of warehousing would be wooden logs/timbers.

The Chairman informed them that various kinds of timbers are prohibited for export under the present FTP, 2015-2020.

The Approval Committee after due deliberation noted that one of the main objective of SEZ under Section 5 of the SEZ Act is promotion of export of goods and services. The Committee further noted that the proposal does not involve any export on behalf of the client but mainly DTA oriented and moreover wooden log/timber is under prohibited list for export and thus a sensitive item. Therefore, the Committee noted that there is no justification in giving them permission for such sensitive items for warehousing activity.

Therefore, the Approval Committee after due deliberations rejected their request for warehousing activity in Kandla SEZ.

AGENDA ITEM NO. 107.1.2 Application for setting up of a Warehousing Activity unit in KASEZ namely M/s New Vibe International, Shed No. 380, AS-IV Type, Sector - IV, KASEZ :

Their proposal is for setting up a unit for Warehousing Activity in Kandla SEZ, Gandhidham.

The representative of the unit telephonically informed about unavailability of any authorised representative and sought deferment. Hence, the Committee decided to defer the proposal.

107.2 TABLE AGENDA

TABLE AGENDA ITEM NO. 107.2.1 Request of M/s GKN Enterprises, Kandla SEZ for one time permission for import of 25600 kgs. of Low Aromatic White Spirit.

M/s GKN Enterprises had requested to grant them one time permission for clearance of import of 25600 kgs. of Low Aromatic White Spirit for trading as the said goods had already arrived at Mundra Port. The request of the unit for inclusion of the above item for trading was rejected in the 105 UAC meeting held on 08-12-2016.

The Approval Committee discussed their present issue in detail and noted that even otherwise import of the white spirit is to be done only through STC/IOC and no direct import is allowed as per ITC HS Policy conditions for trading activity. Hence, the import of the above item for trading is not allowed under Rule 26 of the SEZ Rules, 2006. Therefore, the Approval Committee after due deliberation decided to reject their request:
