का.आ. 940(अ).—केंद्रीय सरकार, अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधजनयम, 2019 (2019 का 50) की धारा 31 की उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए, यह जनिेि िेती है दक जििेष आर्थिक िोन अजधजनयम, 2005 (2005 का 28) और जििेष आर्थिक िोन जनयम, 2006 के कजतपय उपबंध, िैसा दक सारणी 1 और सारणी 2 के स्ट्तंभ संख्या (2) में जिजनर्ििष्ट है, यथाजस्ट्थजत जित्तीय उत्पािों, जित्तीय सेिाओं या जित्तीय संस्ट्थानों पर, उि सारजणयों के स्ट्तंभ संख्या (3) में यथाजिजनर्ििष्ट ऐसे पररितिनों सजहत अंतरराष्ट्रीय जित्तीय सेिा केंद्र के मामले में भी लागू होंगे, अथाित्:

THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) "इस धारा में अंतजिष्ट दकसी भी बात के होते हुए भी, यदि दकसी इकाई को अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधजनयम, 2019 (2019 का 50) की धारा 4 की उप-धारा (1) के अधीन स्ट्थाजपत अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण द्वारा मान्यता, रजिस्ट्रीकरण, लाइसेंस या प्राजधकार की आिश्यकता होती है तो उप-धारा (3) के अधीन प्रित्त िजियों के जसिाय, इस धारा के अधीन जिकास आयुि की िजियों और कृत्यों का जनििहन अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण द्वारा "प्रिासक (आईएफएससीए) " के रूप में नाजमत दकसी अजधकारी द्वारा दकया िाएगा। 2. धारा 13 की उप-धारा (2) का खंड (च) धारा 13 की, उपधारा (2) में, खंड (च) के पश्चात्, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित् :-
‘परन्तु अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण द्वारा दकसी भी इकाई को मान्यता, रजिस्ट्रीकरण, लाइसेंस या प्राजधकार की आिश्यकता होती है तो धारा 13 की उपधारा (2) के खंड (क) के अधीन अनुमोिन सजमजत का अध्यक्ष "प्रिासक (आईएफएससीए)" होगा।‘।
3 धारा 15 की उपधारा (1), उपधारा (2)और उपधारा(9) धारा 15 में,
(क) उपधारा (1) में, परंतुक के पश्चात, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित् :- ‘परन्तु यह और दक कोई भी व्यजि ऐसी कोई इकाई स्ट्थाजपत करने का आिय रखता है, जिसमें अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण द्वारा मान्यता,
रजिस्ट्रीकरण , लाइसेंस या प्राजधकार की आिश्यकता होती है तो िह "प्रिासक

कोई भी व्यजि ऐसी कोई इकाई स्ट्थाजपत करने का आिय रखता है, जिसमें अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण द्वारा मान्यता,
रजिस्ट्रीकरण , लाइसेंस या प्राजधकार की आिश्यकता होती है तो िह "प्रिासक (आईएफएससीए)" को एक प्रस्ट्ताि प्रस्ट्तुत करेगा।‘ । (ख) उपधारा (2) में, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित् :- “ परन्तु उपधारा (1) के िूसरे परंतुक के अधीन प्राप्त ऐसे दकसी भी प्रस्ट्ताि को अनुमोिन सजमजत के पास उसके अनुमोिन के जलए भी भेिा िाएगा। (ग) उपधारा (9) में, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकए िाएंगे, अथाित् :- " परन्तु प्रिासक (आईएफएससीए) उप-धारा (3) में जनर्ििष्ट प्रस्ट्ताि के अनुमोिन के
पश्चात, संबंजधत व्यजि को दकसी भी ऐसी इकाई को स्ट्थाजपत करने और उसके प्रचालन का अनुमोिन िे सकता है, जिसके जलए अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण द्वारा मान्यता, रजिस्ट्रीकरण, लाइसेंस या प्राजधकार की आिश्यकता होती है: परन्तु यह और दक ऐसी इकाइयों के संबंध में सुसंगत िानकारी प्रिासक (आईएफएससीए) द्वारा एसईिेड के जिकास आयुि के साथ माजसक आधार पर या समय-समय पर िब भी आिश्यक हो, साझा की िाएगी। सारणी 2 जििेष आर्थिक िोन जनयम, 2006 क्र.सं.

(जनयम 17 के उप-जनयम (1) का परंतुक िेखें)

जििेष आर्थिक िोन में इकाइयों की स्ट्थापना;
आयातक जनयाितक कोड संख्या का आिंटन;
जििेष आर्थिक िोन में भूजम/औद्योजगक िेड/कायािलय स्ट्थान का आिंटन;
रजिस्ट्रीकरण -सह-सिस्ट्यता प्रमाणपत्र;
िीएसटी/जबक्री कर रजिस्ट्रीकरण;
राज्य सरकार से अपेजक्षत कोई अन्य अनुमोिन।

आिेिन नीचे उजल्लजखत जििरण के अनुसार कांडला जििेष आर्थिक िोन के िेतन और लेखा अजधकारी को पांच हिार रुपये की राजि के भुगतान के सुसंगत जििरण के साथ प्रस्ट्तुत दकया िाना चाजहए, साथ ही प्रस्ट्ताजित कायिकलापों का जििरण िेते हुए एक पररयोिना ररपोटि भी प्रस्ट्तुत की िानी चाजहए।

S.O. 940(E).—In exercise of the powers conferred by sub-section (1) of section 31 of the International Financial Services Centres Authority Act, 2019 (50 of 2019), the Central Government hereby directs that certain provisions of the Special Economic Zones Act, 2005 (28 of 2005) and the Special Economic Zones Rules, 2006, as specified in column number (2) of Table 1 and Table 2, shall apply with such modifications, as specified in column number (3) of the said Tables, to the financial products, financial services or financial institutions, as the case may be, in an International Financial Services Centre, namely: TABLE 1 THE SPECIAL ECONOMIC ZONES ACT, 2005 Sl.No. Section Modifications (1) (2) (3) 1. Sub-section (6) of section 12 In section 12, after sub-section (6), the following sub-section shall be inserted namely:

‘(7) “Notwithstanding anything contained in this section, in case any Units requiring recognition, registration, license or authorisation by the International Financial Services Centres Authority established under sub-section (1) of section 4 of the International Financial Services Centres Authority Act, 2019 (50 of 2019), the powers and functions of the Development Commissioner under this section, except the powers conferred under sub-section (3), shall be discharged by an officer

7 2. Clause (f) of sub-section (2) of section 13
In section 13, in sub-section (2), after clause (f), the following proviso shall be inserted, namely: -

‘Provided that for a Unit requiring recognition, registration, license or authorisation by the International Financial Services Centres Authority, the Chairperson of the Approval Committee under clause (a) of sub- section (2) of section 13 shall be the “Administrator (IFSCA)”.’. 3 Sub-sections (1), (2) and (9) of section 15 In section 15 (a) in sub-section (1), after the proviso, the following proviso shall be inserted, namely:

‘Provided further that any person intending to set up a Unit, requiring recognition, registration, license or authorisation by the International Financial Services Centres Authority, shall submit a proposal to the “Administrator (IFSCA)”.’.

“Provided that the Administrator (IFSCA) may, after approval of the proposal referred to in sub-section (3), grant the letter of approval to the person concerned to set up any Unit and undertake such operations, requiring recognition, registration, license or authorisation by the International Financial Services Centres Authority: Provided further that relevant information regarding such Units shall be shared by the Administrator (IFSCA) with the Development Commissioner of the SEZ on a monthly basis or as may be required from time to time”.

“Provided that, an application seeking permission for setting up a Unit requiring recognition, registration, license or authorisation by the International Financial Services Centres Authority shall be made to the Administrator (IFSCA) in Form FA, and Form F shall not be applicable to such Unit.”.

Allotment of land/industrial sheds/Office Space in the Special Economic Zone; 4. Registration-cum-Membership Certificate; 5. GST/Sales Tax registration; 6. Any other approval as may be required from the State Government.
