Standing Order No. 12/2010 dated 13.04.2010 and Standing Order No.
13/2010 dated 13.04.2010 provides for submissions of certain documents by first time importers who clear their goods through ICDs/ACC of this Commissionerate. As a result, persons who were otherwise regularly engaged in import/export activity at other ports are also subject to verification of identity afresh when they seek to engage in import/export through Customs station of this Commissionerate for the first time.

The Customs (Verification of Identity and Compliance) Regulations, 2021
notified vide Notification No. 41/2021-Cus (NT) dated 05th April, 2021 lay down guidelines for verification of identity of persons who are newly engaging in import or export activity. Consequently, when a person engages in the activity of import/export for the first time after the commencement of this Regulation, 2021 anywhere in the country, verification of identity as required under Regulation 4 shall necessarily be carried out at that Port. Clearly in such situations the provisions of Standing Order No. 12/2010 dated 13.04.2010 and Standing Order No. 13/2010 dated 13.04.2010 are at variance with the Regulations in this regard.

In view of the above, Standing Order No. 12/2010 dated 13.04.2010 and
Standing Order No. 13/2010 dated 13.04.2010 is hereby withdrawn with immediate effect.

All pending applications shall be disposed accordingly. Needless to say that
if a person is newly engaging in import/export and intends to start the activity of import/export for the first time at Customs station under the jurisdiction of this Commissionerate, then the provisions of the Customs (Verification of Identity and GEN/TECH/PN/17/2022-TECH-O/o PR COMMR-CUS-AHMEDABAD I/2715672/2025

In order to ensure that verification of a person newly engaging in the activity
of import/export is duly carried out in accordance with the Regulations, the following procedure shall be followed: i. Where the person has been importing/exporting through some Customs station and is not a new person engaging first time in import/export, normally there shall be no requirement for any further compliance. The Customs Broker or first-time importer/exporter seeking self-clearance shall immediately intimate the respective Deputy/Assistant Commissioner of Customs (seeking assistance in clearance), if required.
ii. In respect of a person newly engaging in the activity of import/export after the commencement of the Customs (Verification of Identity and Compliance) Regulations, 2021, the documents mentioned in Regulation 4 shall be submitted not later than 30 days of engaging in import/export.
Any difficulties in the implementation of this Public Notice shall be immediately
brought to the notice of the undersigned.
