अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण अजधसूचना गांधीनगर, 4 जनिरी, 2022 अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बीमा मध्यिती) (संिोधन) जिजनयम, 2021

आई.एफ.एस.सी.ए./2021-22/जी.एन./रेग्यु020.—अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण, अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण अजधजनयम, 2019 की धारा 12 और धारा 13 के साथ पठित धारा 28 की उपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बीमा मध्यिती) जिजनयम, 2021 का संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता है, अथाात्:- 1. संजिप्त नाम और प्रारंभ:

(1) इन जिजनयमों का संजिप्त नाम अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बीमा मध्यिती) (संिोधन) जिजनयम, 2021 है । (2) ये राजपत्र में उनके प्रकािन की तारीख को प्रिृत्त होंगे । 2. अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण(बीमा मध्यिती) जिजनयम, 2021 (जजन्द्हें इसमें से पश्चात् ‘मूल जिजनयम’ कहा गया है, के जिजनयम 13 के उप-जिजनयम (6) के स्ट्थान पर जनम्नजलजखत रखा जाएगा, अथाात्:- “(6) आई.आई.आई.ओ. प्राजधकरण को, अपने कानूनी लेखापरीिक, भारत में व्यिसायरत ककसी चार्ाडा अकाउंर्ेंर्, भारत में व्यिसायरत ककसी कंपनी सजचि, भारत में व्यिसायरत ककसी लागत लेखाकार या ककसी ऐसे अन्द्य व्यजि द्वारा, जजसके पास प्राजधकरण द्वारा यथा-जिजनर्ददष्ट समुजचत अहाता है, जारी ककया गया समादत्त पूंजी और िुद्ध संपजत्त प्रमाणपत्र, छमाही आधार पर प्रस्ट्तुत करेगा ।” सं.

लेखाकार या ककसी ऐसे अन्द्य व्यजि द्वारा, जजसके पास प्राजधकरण द्वारा यथा-जिजनर्ददष्ट समुजचत अहाता है, जारी ककया गया समादत्त पूंजी और िुद्ध संपजत्त प्रमाणपत्र, छमाही आधार पर प्रस्ट्तुत करेगा ।” सं. 3] नई कदल्ली, बुधिार, जनिरी 5, 2022/पौष 15, 1943

मूल जिजनयमों के जिजनयम 22 के उप-जिजनयम (3) के स्ट्थान पर जनम्नजलजखत रखा जाएगा, अथाात्:- “(3) बीमा मध्यिती, लेखापरीजित लेखाओं के साथ, भारत में व्यिसायरत ककसी चार्ाडा अकाउंर्ेंर्, भारत में व्यिसायरत ककसी कंपनी सजचि, भारत में व्यिसायरत ककसी लागत लेखाकार या ककसी ऐसे अन्द्य व्यजि द्वारा, जजसके पास प्राजधकरण द्वारा यथा- जिजनर्ददष्ट समुजचत अहाता है, इन जिजनयमों के अनुपालन की पुजष्ट करते हुए एक प्रमाणपत्र देगा ।” 4. मूल जिजनयमों में, अनुसूची-VI के प्ररूप-ख के स्ट्तंभ (2) के क्रम संखयांक 12 के स्ट्थान पर जनम्नजलजखत रखा जाएगा, अथाात्:-

“सी.ए./सी.एस./सी.एम.ए., आकद से प्रमाणपत्र: भारत में व्यिसायरत ककसी चार्ाडा अकाउंर्ेंर्, भारत में व्यिसायरत ककसी कंपनी सजचि, भारत में व्यिसायरत ककसी लागत लेखाकार या ककसी ऐसे व्यजि से, जजसके पास प्राजधकरण द्वारा यथा-जिजनर्ददष्ट समुजचत अहाता है, इस बात की पुजष्ट करने िाला एक प्रमाणपत्र दें कक आिेदक द्वारा सभी लागू जिजनयमनकारी अपेिाओं का अनुपालन ककया गया है ।” इनजेती श्रीजनिास, अध्यि [जिज्ञापन-III/4/असा./559/2021-22] ठर्प्पण: अंतरराष्ट्रीय जित्तीय सेिा केन्द्र प्राजधकरण (बीमा मध्यिती) जिजनयम, 2021, भारत के राजपत्र, आसाधारण में अजधसूचना सं.

INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY NOTIFICATION Gandhinagar, the 4th January, 2022 International Financial Services Centres Authority (Insurance Intermediary) (Amendment) Regulations, 2021

IFSCA/2021-22/GN/REG020 — In exercise of the powers conferred by sub-section (1) of Section 28 read with Section 12 and 13 of the International Financial Services Centres Authority Act, 2019, the International Financial Services Centres Authority hereby makes the following Regulations to amend the International Financial Services Centres Authority (Insurance Intermediary) Regulations, 2021 namely:-
1. Short title and commencement:-
(1) These Regulations may be called the International Financial Services Centres Authority (Insurance Intermediary) (Amendment) Regulations, 2021. (2) They shall come into force from the date of their publication in the Official Gazette. 2.

In the International Financial Services Centres Authority (Insurance Intermediary) Regulations, 2021 (hereinafter referred to as the ‘Principal Regulations’) sub-regulation (6) of regulation 13 shall be substituted by the following, namely – (6) “The IIIO shall submit to the Authority a paid-up capital and net-worth certificate issued by its statutory auditor, a practicing Chartered Accountant in India, a practicing Company Secretary in India, a practicing Cost Accountant in India or any other person with appropriate qualification, as specified by the Authority, on half yearly basis.” 3. Sub regulation (3) of regulation 22 in the Principal Regulations shall be substituted by the following, namely -
(3) “An insurance intermediary shall, along with the audited accounts, furnish a certificate by a practicing Chartered Accountant in India, a practicing Company Secretary in India, a practicing Cost Accountant in India or any other person with appropriate qualification, as specified by the Authority, confirming compliance with these regulations.” 4. Serial No. 12, column (2) of FORM- B of SCHEDULE – VI in the Principal Regulations shall be substituted by the following, namely –

“Certificate from CA/CS/CMA, etc.: Provide a certificate from a practicing Chartered Accountant in India, a practicing Company Secretary in India, a practicing Cost Accountant in India or any other person with appropriate qualification, as specified by the Authority, confirming that all applicable regulatory requirements have been complied with by the Applicant.” INJETI SRINIVAS, Chairperson
