the Customs Act, 1962, I, Shiv Kumar Shans Principal eat oe, Ahmedabad, hereby appoint ‘M/s. Adani Logistics Ltd.’ to be the Custodian of the imported goods received at the Inland Container Depot (ICD), located at Village: Virochannagar, Ahmedabad, until these are cleared for home consumption, or are warehoused, or are transshipped in accordance with the provisions of Chapter VII and VIII of the Customs Act, 1962, and of the export cargo brought into the said Inland Container Depot for examination and stuffing, till their exportation. Z Further, in exercise of the powers conferred upon me under Regulation 10 of the ‘Handling of Cargo in Customs Areas Regulations, 2009’, I, Shiv Kumar Sharma, Principal Commissioner of Customs, Ahmedabad, approve ‘M/s. Adani Logistics Ltd.’ as the ‘Customs Cargo Service Provider’ for the entire Customs Area of ICD, Virochannagar located in LC-33, Sanand- Viramgam Highway, Virochannagar, Ahmedabad, subject to the following conditions: ; The Custodian, ‘M/s.

Adani Logistics Ltd.’ approved as Customs Cargo Service Provider for the said ICD, Virochannagar shall, comply with the provision of Section 45(2) of Customs Act, 1962, all other provisions of the Customs Act, 1962 and the Regulations of the ‘Handling of Cargo in Customs Areas Regulations, 2009’as amended. The Custodian shall abide by and follow such Rules, Regulations, Notifications, Circulars, Public Notices and Orders issued by the CBIC/ Principal Commissioner/Commissioner of Customs from time to time in this regard.

The Custodian shall be accountable for the proper receipt, handling and storage ofimported goods and shall be accountable for the loss of imported goods after the landing and before clearance, as well as goods meant for export/transshipment. - iv. The Custodian shall provide a safe, secure and spacious place for loading, unloading and storage of the Cargo. examination areas are physically demarcated. An uninterrupted thoroughfare shall be provided to the Customs officials throughout the entire premises of the customs area. y. No alteration of the plan in the Customs area, shall be made without the concurrence of the Principal Commissioner/Commissioner of Customs, Ahmedabad Customs. In case, the Custodian wishes to sublet any of the functions inside the Customs Area or connected with customs area, the same should be done with the prior approval of the Principal Commissioner/Commissioner of Customs, Ahmedabad Customs. The imported /export/transshipment goods, which are not cleared for home consumption, warehoused, transshipped or exported within 30 days or unloading thereof, or within such further time period as the proper officer may allow or the imported goods to which the importer relinquishes his title as provided in section 23(2) of the Customs Act, 1962, should not be disposed off by the Custodian without obtaining permission from the proper officer of Customs. vii. The Principal Commissioner/Commissioner of Customs, Ahmedabad, shall have the right to review the appointment of ‘M/s. Adani Logistics Ltd.” as ‘Custodian’ and / or as ‘Customs Cargo Service Provider’ before the completion of two years, in case of failure to comply with the provisions of the Customs Act, 1962 in general and/ or the ‘Handling of Cargo in Customs Areas Regulations, 2009” in particular. xiii. Custodian shall give the necessary undertakings as prescribed under HCCAR, 2009 as amended, before the commencement of any import/export activity. The Custodian shall undertake to indemnify the Principal Commissioner of Customs from any possible liability arising on account of damages caused or loss suffered on imported or export goods, due to accident, damage, deterioration, destruction or any other unnatural cause during their receipt,

xiv. ‘M/s Adani Logistics Ltd’ shall ensure the installation of RFID (Radio Frequency Identification) scanners at the entry and exit gates in the ICDs and the integration of LDB (Logistics Data Bank) with the E-trade system for Electronic Data Interchange between Customs, ICDs, Railways and stakeholders for real time tracking of the containers’ movement before the commencement of operations.

xv. Adequate arrangements must be made for gender-appropriate sanitary facilities, water supply, canteen facilities, and other facilities as specified by the Competent Authority for officers stationed at the ICD. The Custodian must provide for increased space and infrastructure as requisitioned by Customs.

xvi. No rent or demurrage shall be charged for goods seized, detained, or confiscated by the Customs Department under the Customs Act, 1962, or any other prevailing law.

xvii. The Custodian shall be responsible for any improper removal of goods and liable for appropriate duties, cess, etc., on such removals. ,

xviii. Unclaimed or abandoned goods must be disposed of within ninety days, with the possibility of extension by the Commissioner for sufficient cause.
