Ref.: Elections to the Committee of Administration for Panel Members, Regional Chairmen and Vice Chairman of the Council for the term 2022-24 as per Election Rules.

Dear Member,

This is in continuation to the first notification bearing Ref No. Add. DGFT/GJEPC/Election-202224/2022-23/01 dated July 12, 2022 which had been issued to all eligible members of the Council with respect to the Elections to the Committee of Administration for the term 2022-24. Now, this Nomination notice is being issued to all eligible voter members of the Council as per the final voter list for FY 2022-23.

As per the Article 27.8 (a) of the Articles of Association of the Council, the Elections to the Committee of Administration for the term 2022-24 shall be held for the below mentioned Panel members/Group of Panels as well as for all Regional Chairmen and for the Vice Chairman

As per the Election Rule 4.2(n) and Article 27.7 (a3) of the Articles of Association, where an elected member of the Committee has served continuously for 6 [six] years, such elected member shall be deemed to be retired and shall not be eligible for re-election or re-appointment to the Committee whether as Panel Member or Regional Chairman or Vice Chairman or Chairman for a period of two years immediately after completion of such six years.

As per Election rule 4.2(m) and Article 21.1(c) of the Articles of Association, an Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2 (two) years each, shall not be eligible for re-election or re-appointment as a Regional Chairman or as a member of a

Please be informed that for the purpose of Elections, the Panels & Regions have been grouped pursuant to the amended Election Rules as of 11 July 2022 and based on the provisions of the Elections Rules and the Articles of Association (AoA), and the said groups of Panels & Regions are as follows:

  • e In addition, one Seat shall be reserved for a representative of MSME, as required under Article 27.4 (a) of the Articles of Association, on rotation basis to be decided by way of draw of lots in each of the above group of panels.

2. VACANCIES OF PANELS AND REGIONS FOR ELECTIONS FOR THE TERM 2022-24:

Pursuant to the results of Drawing of Lot conducted on 224 July 2022 and based on the provisions of the Election Rules & Articles of Association (AoA), the Elections to the Committee of Administration of GJEPC for the term 2022-24 shall be held for the below mentioned Panels/ Group of Panels:

2.1: PANELS SR. NO. 1: - DIAMOND PANEL:

The Group 1 (Diamond Panel) consists of total O7 (seven) seats (03 seats from the General category and 04 seats from the Reserved category of EH/TH/STH/SSTH).

Shri Sanjay Shah who was elected in the CoA of the Council within the Diamond Panel left for his heavenly abode on 28" April 2022 thus resulting in vacation of his seat in the CoA. Shri Ajesh Mehta and Shri Nilesh Kothari, Members-Diamond Panel were elected based on provisions of Article 20.1 (a) of the Articles of Association of the Council which deals with Casual Vacancies in the CoA. As per Article 20.1(b) of the Articles of Association of the Council, “A person appointed to fill up a casual vacancy shall hold office only for the remainder of the term of the original member.” In this context, Shri Ajesh Mehta and Shri Nilesh Kothari held office as members of the CoA only till the completion of the term 2020-22 pursuant to which their seats shall fall vacant for election purposes.

In consideration of the provisions of Election Rule 4.2(n) and Article 27.7(a3) of the Articles of Association, Shri Manish Jiwani, Shri Dilip Shah and Shri Russell Mehta have completed six continuous years in the CoA and hence shall be deemed to be retired and shall not be eligible for re-election or reappointment to the Committee whether as Panel Member or Regional Chairman or Vice Chairman or Chairman for a period of two years immediately after completion of such six years.

In view of the above, 04 (four) seats in the Reserved category and O1 (one) seat in the General category stands vacant in the Diamond Panel in the Elections for COA for the term 2022-24.

SR. NO.2:- GOLD JEWELLERY AND OTHER PRECIOUS METAL JEWELLERY PANEL

The Group 2 (Gold Jewellery and Other Precious Metal Jewellery Panel) consists of 03 seats (including 02 seats from the category of EH/TH/STH/SSTH)

In consideration of the provisions of Election Rule 4.2(n) and Article 27.7(a3) of the Articles of Association, Shri Shailesh Sangani, Shri Mansukh Kothari and Shri K Srinivasan have completed six continuous years in the CoA and hence shall be deemed to be retired and shall not be eligible for reelection or re-appointment to the Committee whether as Panel Member or Regional Chairman or Vice Chairman or Chairman for a period of two years immediately after completion of such six years.

Pursuant to the Drawing of lots conducted on 22" July 2022 amongst the two remaining Group of panels (COLORED GEMSTONES and PEARLS PANEL AND GOLD JEWELLERY AND OTHER PRECIOUS METAL JEWELLERY PANEL), the Gold Jewellery and Other Precious Metal Jewellery Panel was identified for the purpose of reservation of the MSME seat for the term 2022-24.

In view of the above, 02 (two) seats in the Reserved Category stand vacated in the Gold Jewellery and Other Precious Metal Jewellery Panel, out of which 01 (one) seat shall be reserved for MSME in the Elections for COA for the term 2022-24. In addition, 01 (one) seat in the General category also stands vacated in the Gold Jewellery and Other Precious Jewellery Metal.

SR. NO. 3: - COLOURED GEM STONES PANEL AND PEARLS PANEL: The Group 3 (Coloured Gemstones and Pearls Panel) consists of 01 seat in General Category.

SR. NO. 3: - COLOURED GEM STONES PANEL AND PEARLS PANEL: The Group 3 (Coloured Gemstones and Pearls Panel) consists of 01 seat in General Category.

There is no seat vacant in the Coloured Gemstones Panel and Pearls Panel in the Elections for COA for the term 2022-24.

SR. NO. 4: - SILVER JEWELLERY PANEL: The Group 4 (Silver Jewellery Panel) consists of 01 seat in General Category.

Pursuant to the provisions of Article 27.7 (a3) of the Articles of Association, an elected Panel member of the Committee who has served continuously for 6 [six] years, such shall be deemed to be retired and shall not be eligible for re-election or re-appointment to the Committee, whether as Panel member or Regional Chairman or Vice- Chairman or Chairman, for a period of 2 (two) years immediately after completion of such 6 (six) years.

In view of the same, Shri Ram Babu Gupta would be declared as retired having served 6 (six) continuous years on the seat reserved in the Silver Panel and will not be eligible for selection for the term of 2022-24 for any elected position in the Committee of Administration.

In view of the above, 01 (one) seat in General Category stands vacant in the Silver Jewellery Panel in the Elections for CoA for the term 2022-24.

SR. NO 5.: SYNTHETIC STONES PANEL/COSTUME FASHION JEWELLERY PANEL/SALES TO FOREIGN TOURISTS PANEL

The Group 5 (Synthetic Stones Panel/Costume Fashion Jewellery/ Sales to Foreign Tourists Panel) consists of 01 seat in General Category.

ME FASHION JEWELLERY PANEL/SALES TO FOREIGN TOURISTS PANEL

The Group 5 (Synthetic Stones Panel/Costume Fashion Jewellery/ Sales to Foreign Tourists Panel) consists of 01 seat in General Category.

Shri Badrinarayanan Gupta had filed his nomination from the said Panel as the seat originally reserved for MSME for the term 2020-22 was deemed unreserved as no nomination was received from the MSME representatives in the said Panel.

In view of the above, no seat is vacant in the Synthetic Stones/Costume Fashion/Sales to Foreign Tourist Panel in the Elections of CoA for the term 2022-24.

SR. NO 6.: LAB-GROWN DIAMONDS PANEL

Pursuant to the amended Election Rules of the Council dated 11? July 2022 a new Panel namely the Lab-grown Diamond Panel has been created which has been allocated with 01 (one) seat in the COA.

In view of the above, 01 (one) seat in General Category is vacant in the Lab-grown

Diamond Panel in the Elections for CoA for the term 2022-24.

SR. NO 7.: SEZ PANEL

Pursuant to the amended Election Rules of the Council dated 11'* July 2022, a new Panel namely the SEZ Panel has been created which has been allocated 01 (one) seat in the COA. In accordance to the directives issued by the Ministry of Commerce & Industry vide letter dated 10th June 2022, the seat for SEZ Panel would come into effect as and when vacancy occurs against the incumbent CoA member representing SEZ under the Gold Jewellery and Other Precious Metal Jewellery Panel. As such, by virtue of the amended Election Rules dated 11 July 2022, Shri Suvankar Sen who was representing the SEZ seat inside the Gold Jewellery & Other Precious Metal Jewellery Panel will now represent SEZ Panel for the term 2022-24.

In view of the above, there is no seat vacant in the SEZ Panel for the Elections for the

term 2022-24,

SR. NO 8.: STUDDED JEWELLERY PANEL

Pursuant to the amended Election Rules of the Council dated 11" July 2022, a new Panel namely the Studded Jewellery Panel has been created which has been allocated with 01 (one) seat in the COA.

In view of the above, 01 (one) seat in General Category is vacant in the Studded Jewellery Panel in the Elections for CoA for the term 2022-24.

2.2: - REGIONAL CHAIRMAN-

6 (six) - one from each of the following Regions)

As per Rule No. 7.3(b) of the Election rules, Regional Chairman shall be elected for a term of 2 [two} years. The elections for the office of the Regional Chairman shall be held along with the elections to the Panels of the Committee and shall be regulated by Election Rules as well as the provisions of the Articles of Association.

The Regional Chairman will be elected by the Ordinary members of their respective regions as mentioned here under and as per Rule 8 of the Election Rules. Accordingly, Elections will be held for the following posts of Regional Chairman in the regions covering States and Union Territories as under:

  • (a) Northern Region Chandigarh, Haryana, Himachal Pradesh, Jammu & Kashmir, Punjab, NCT of Delhi, Uttar Pradesh and Uttarakhand

  • (b) Rajasthan Region Rajasthan (c) Eastern Region Arunachal Pradesh, Assam, Bihar, Chhattisgarh, Jharkhand, Manipur, Meghalaya, Mizoram, Nagaland, Odisha, Sikkim, Tripura and West Bengal

  • (d) Southern Region Andaman and Nicobar Islands, Andhra Pradesh, Karnataka, Kerala, Lakshadweep, Puducherry, Tamil Nadu and Telangana

  • (e) Gujarat Region Gujarat (f) | Western Region Maharashtra, Goa, Dadra and Nagar Haveli, Daman and Diu, and Madhya Pradesh

Regional Chairman:

As per Election Rule 4.2(m) and Article 21.1(c) of the Articles of Association, an Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, shall not be eligible for re-election or re-appointment as a Regional Chairman or as a member from a Panel of the Committee or Vice Chairman or Chairman at the next election for the subsequent term of two years.

Further, based on provisions of Articles of Association and the Election Rules, Regional ChairmanRajasthan Region and Regional Chairman-Northern region shall retire and will be re-eligible to file nomination for the elections for the term 2022-24. However, on account of the provisions of Election Rule 4.2 (m) and Article 21.1 (c) of the AoA, the Regional Chairman-Western Region, Regional Chairman-Gujarat Region, Regional Chairman-Southern Region and Regional ChairmanEastern Region shall not be eligible to file nomination for the term 2022-24.

In view of the above, 01 (one) seat of Regional Chairman — Northern Region stands vacant in the Elections for COA for the term 2022-24.

In view of the above, 01 (one) seat of Regional Chairman - Southern Region stands vacant in the Elections for COA for the term 2022-24.

In view of the above, 01 (one) seat of Regional Chairman - Gujarat Region stands vacant in the Elections for COA for the term 2022-24.

In view of the above, 01 (one) seat of Regional Chairman — Western Region stands vacant in the Elections for COA for the term 2022-24.

2.3 (A): - CHAIRMAN a) The term of Chairman shall be of Two years. The Chairman shall hold office for a period of 2 [two] years and shall retire from the post of Chairman accordingly. The Chairman shall be eligible to file nomination as Vice- Chairman only after a gap of not less than 4 (four) years, Page 6 of 24

immediately upon completion of his term of 2 (two) years. However, such person may file nomination for Panel Member or Regional Chairman after a gap of 2 (two) years upon completion of his term of Chairman.

In pursuance to the provisions of Election Rules and Articles of Association, Shri Colin Shah-Chairman, shall retire due to completion of tenure and will not be eligible to file his nomination for any position in the CoA in the Elections for the term 2022-24

  • b) The election of Chairman shall be via Vice-Chairman route. On completion of his term of 2 (two) years, the Vice-Chairman shall succeed to be the Chairman of the Council unless he is unwilling to accept Chairmanship or has incurred any of the disqualifications enumerated in Article 8.1 of the Articles of Association of the Council or in any other circumstances, he is not able to succeed as Chairman. In such case, the election of Chairman shall be made separately by the Ordinary Members of the Council along with the election of other CoA members.

Shri Vipul Shah who was Vice-Chairman for the term 2022-24 would succeed as Chairman of the Council under the provisions of Article 27.1 (1) of the Articles of Association.

2.3 (B) VICE-CHAIRMAN

  • (a) The election of Vice-Chairman shall be made separately by the Ordinary Members of the Council along with the election of other Committee members.

  • (b) The term of Vice-Chairman shall be of 2 (two) years. On completion of the said term, the Vice-Chairman shall be endorsed to succeed the Chairman unless he is unwilling to accept Chairmanship, or he has incurred any of the disqualifications enumerated in Article 8.1 regard to membership of the Council.

  • (c) A person having held the post of Vice-Chairman shall be eligible to file nomination as ViceChairman only after a gap of not less than 4 (four) years, immediately upon completion of his term of 2 (two) years.

  • (d) In case, the Chairman incurs any disqualification or happening of an event which prevent him to continue as Chairman, during his tenure, the respective Vice-Chairman of that term shall act as stand-in Chairman for the balance term. The criteria of one-man-one post shall not apply in such case. Further, on completion of balance term, the said Vice-Chairman shall succeed as Chairman of the Council.

In pursuance to the provisions of Election Rules and Articles of Association, 01 (one)

3. ELIGIBILITY TO VOTE &/OR CONTEST

  • 3.1 Right to vote and/or contest confined to Ordinary Members

  • a) As per Article 4.1 of the Articles of Association only an Ordinary Member shall have the right to vote at, or to offer self as a candidate at elections to various positions in the Council. (The FINAL updated voter list with authorized representatives, prepared in accordance with the notice of No.: Add. DGFT/GJEPC/Election-2022-24/2022-23/04 dated 30° July 2022 is enclosed herewith for reference & record. The same is also displayed on Council’s website http: //www.gjepc.org/ election _coa.php

3.2 Eligibility for Election

  • The Ordinary Members of the Council who have opted for inclusion in any one of the aforesaid 12 (twelve) panels as defined under Election rule 2(a) and respective region shall be eligible to vote only through their nominated authorized representatives as per membership records of the Council in respect of the candidates from that particular Panel/Region/Vice-Chairman/ Chairman.

  • 3.3 Eligibility to Vote — As per Rule 4.1 of the Election Rules

  • (a) As per Article 4.1 of Articles of Association the Ordinary Members shall have the right to vote at the Election of the Council’s Committee of Administration.

  • (b) Only the authorized representative whose name is mentioned as such in the membership application, while applying for membership with the Council, shall have right to vote at the Election.

  • (c) Each Ordinary Member of the Council shall have one vote for every single representation/seat for the respective Groups of Panels as per the Panel opted/ registered with the Council from time to time. (For'example, if a Group of Panels has three vacancies, each member of the Council who is registered in any Panel which is a part of that Group of Panels shall have one vote for each representation/seat in that particular Group of Panels but not exceeding three votes in all).

  • (d) Each Ordinary Member from a particular region of the Council shall also have one vote for electing a Regional Chairman from that particular region where he is registered for the purpose of membership with the Council.

  • (e) Each Ordinary Member of the Council shall have one vote for election of Vice-Chairman. (f) Whenever there is a separate election for the post of Chairman, each Ordinary Member of the Council shall also have one vote for electing a Chairman.

3.4 Eligibility for Candidacy as per Rule 4.2 of the Election Rules

A candidate standing for election to any position in the Council must satisfy the following conditions namely:

(i) A candidate must be the Ordinary Member of the Council;

(ii) Only the authorized representative, whose name is mentioned as such in the membership application, or any of the duly authorised person as stated under Rule 5(d) of Election Rules, while applying for membership with the Council shall be eligible to contest, propose or second at the Election.

However, in the absence / non-availability / unwillingness of such authorised representative, any of the persons as mentioned under Rule 5(d) of the Election Rules and who is duly authorised by all the remaining partners / directors / managing committee member /trustee etc., as the case may be, shall be eligible to contest for the Election. Provided that the name of such person as partner / director/managing committee member/ trustee etc. is registered with Director General of Foreign Trade & reflects in IEC.

(iii) In order to stand for elections, the candidate or the entity represented by him must have to her/ his/ its credit, exports of not less than the following amounts: -

Since the SEZ Panel, Studded Jewellery Panel and Lab-Grown Diamond Panel are newly introduced in the Council vide amended Election Rules dated 11 July 2022, based on the directives contained in the communication dated 10° June 2022 issued by the Ministry of Commerce and Industry and as detailed in the Explanatory statement to the Notice dated 17% June 2022 of the EGM of the Council, and as there is no Election in SEZ Panel for the term 202224, the nominations being filed from Studded Jewellery Panel and Lab-Grown Diamond Panel shall be exempted from the mandatory compliance of consideration of Export Turnover criteria of three years as defined in Rule 4.2 (c) of the Election Rules. In order to stand for reserved seat for MSME category, the candidate or the entity represented by him must have to her/ his/ its credit, the export of not less than Rs. 25 lakhs of respective product, during the financial year immediately preceding the elections, from the panel in which the candidate is enrolled.

The members filling his nomination for the Reserved Seat of EH/TH/STH/SSTH in the concerned panel need to submit the Export House/Status Holder certificate along with the Nomination Form and his name should appear in such list which is maintained by DGFT.

(vi) Any voter/ member de-registered or black-listed under the Foreign Trade Policy with regard to exports/imports will not be eligible to file nominations for election to the Committee of Administration. Therefore, on the original Nomination Form itself the Member organization will also have to submit a declaration in writing signed by the Chairman / Managing Director /Director/ Partner/ Proprietor as the case may be that it is not debarred/black-listed under the aforesaid Policy. (viii) No Ordinary Member who has served as a Regional Chairman for 3 (three) continuous terms of 2(two) years each, shall be eligible for re-election or re-appointment as a Regional Chairman or as a member from a Panel of the Committee or Vice-Chairman or Chairman at the next election for the subsequent term of 2 (two) years. 4. PROCEDURE FOR FILING & DEADLINE FOR SUBMISSION & WITHDRAWAL OF NOMINATION ETC.

(d) A Nomination sent by telex/fax/telegram/e-mail to the Election Authority will be treated as invalid.

(f) In the event of the Election Authority/Regional Election Authority having reasons to doubt the veracity of any of the particulars/information contained in any Nomination Form received by it, the Election Authority/Regional Election Authority may call for particulars/information from the Executive Director of the Council. He/She will also be at liberty to call for Export performance of the member concerned as per the record of the Council from the Executive Director.

(g) The names of the nominee’s panel-wise and region-wise including Vice-Chairman shall be entered in a register and after due scrutiny a list of valid nominations received will be prepared. Copies of such lists duly signed by the undersigned shall be sent to Head Office and all the Regional Offices of the Council as well as the same will be available on the website of the Council (http: //www.gjepc.org/election_coa.php) within 7 days from the expiry of the period. (h) Nomination can be withdrawn by the candidate by a letter signed by him/her within 5 days from the date of aforesaid display of the list of valid nominations by the Election Authority/Regional Election Authority. Original letter of withdrawal of nominations needs to be submitted to the Regional Election Authority or to the undersigned at Mumbai as the case may be. (i) Such a withdrawal shall be final and no subsequent request, for rescinding such withdrawal shall be entertained by the undersigned or the respective Regional Election Authority.

(k) For participating in the online electronic voting process valid E-mail ID and mobile number of the authorised representative whose name is appearing in the Electoral Roll is mandatory.

(1) Ordinary Members who have not registered their mobile number with GJEPC need to do so by sending request addressed to Election Authority on the letterhead indicating Membership Number (BP number) and Mobile Number of the authorised representative by E-mail to election@gjepcindia.com on or before, 19** August 2022.

(m) In case of any mistakes / errors in the E-mail IDs mentioned in the attached list, please inform GJEPC in writing on or before, 19** August 2022.

(n) No further communication will be entertained after 19t* August 2022, in this regard, for any modifications/changes/updation in the record and the details as per GJEPC records will be treated as final and correct.
