      Attention of Importers, Customs Brokers (C.B) and all other stakeholders

is drawn towards Public Notice No. 17/2022-23 dated 30.03.2023 issued by this Commissionerate derived from CBIC Circular No. 07/2020-Cus dated 05.02.2020.

2. In Public Notice No. 17/2022-23 dated 30.03.2023, Chartered Engineers (C.E.) were empanelled for inspection/examination of second-hand/old and used machinery/goods etc. for technical opinion in the jurisdiction of Commissioner of Customs (Import), Mumbai Customs Zone-III.

3. Para 3 of the said Public Notice lists the empanelled Chartered Engineers (Company/firm/individual) with specialization (Mechanical, Civil, Polymer, Chemical, Instrumentation & Control, Aerospace Engineers) mentioned against their names and further provides that importers of old and used second-hand machinery at Air Cargo Complex, Mumbai may avail the services of any of the empanelled Chartered Engineers/Inspection and Certification Agencies.

In this regard, it is to be noted that CBIC Circular No. 07/2020-Cus dated 05.02.2020 at Para 3 states that ascertaining the age of a second hand machine is an engineering exercise and can be performed only by a qualified engineer and at Para 4.9 states that the importer shall be free to select any Chartered Engineer, empanelled by the Custom House for the respective class of goods, if so required.

5. Importers/ Customs Brokers can use the services of any of the empanelled Chartered Engineers who have specialization/expertise in the engineering field which is related to the class/type of imported goods requiring their certification. The choice of selection of the competent Chartered Engineer totally rests with the Importer/C.B., which should be exercised carefully to avoid rejection.
